COMMISSION RESOLUTION NO. 1747 {btllj' A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 557 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF A SANITARY SEWER LINE TO SERVE A PORTION OF THE I BOZEMAN CREEK ANNEXATION TO THE CITY OF BOZEMAN, MONTANA, MORE SPECIFICALLY DESCRIBED AS FOLLOWS: AN EIGHT INCH SANITARY SEWER AND NECESSARY APPURTENANCES IN AN EASEMENT THROUGH TRACTS 11 AND 12 OF THE BOZEMAN CREEK ANNEXATION TO BOZEMAN, MONTANA. THE CONSTRUCTION AND INSTALLATION OF SAID SANITARY SEWER IS TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIAL, SEWER PIPE, MANHOLES, NECESSARY WYES, AND OTHER NECESSARY APPURTENANCES. WHEREAS, there has been filed with the City Commission a petition in due form asking that a Special Improvement D~strict be created for the purpose of constructing and instal- ling a sanitary sewer line to serve said district; and WHEREAS, at a regular meeting of the City Commission of the City of Bozeman, held on the 14th day of May, 1975, the aforesaid petition was respectively, considered and granted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention It is hereby declared to be the intention of the City of Bozeman to create a Special Improvement District to be known and designated as Special Improvement District No. 557 of the City of Bozeman for the purpose of constructing and installing a sanitary sewer main, said project to include all appurtenant work for the construction and installation of a I sanitary sewer line to serve the area within the district. Section 2 Boundaries The boundaries of said Special Improvement District No. 557 are described as follows: Beginning at a point in the East line of the Butte Addition to Bozeman, Montana, said point being the intersection of the East line of Lot 12, Block 19, Butte Addition and the West line of the C.M.St. P. & P. Railroad right of way: Thence North 00 02' 46" West along the East line of the Butte Addition a distance of 419.73 feet to the South- west corner of the Eck Addition; thence South 890 56' 00" East a distance of 89.48 feet , to the Southeast corner of said Eck Addition; thence North 80 41' 26" East along the East line of said Eck Addition a distance of 227.53 feet to the Southeast corner of Langhor's First Addition; thence North 190 42' East a distance of 257.02 feet; thence Northerly along a circular curve to the left having radius 320.75 feet through a central angle of 190 46' and arc distance of 110.68 feet; thence North 00 04' West a distance of 124.7 feet to the Southwest corner of the Spring Dell Addition; thence South 690 09' East a distance of 372.3 feet to the Southeast corner of said Spring Dell Addition, said point being on the West right of way line of the C.M.St. P. & P. Railroad; thence South 300 16' West along said west railroad right of way line a dis- tance of 1138 feet more or less to the point of beginning. Contained within the above described exterior boundaries are the following Lots, Blocks and Tracts of Land to wit: Tracts 11 and 12 of the Bozeman Creek Annexation to the City of Bozeman. I Section 3 Character of Improvements The character of improvements is the construction and installation of an eight inch sanitary sewer main, including trench excavation and backfill, bedding materials, sewer mains, manholes, wyes, and all other work appurtenant thereto. I . ...,J;_ Section 4 Estimate of Cost The total estimated cost of the improvements within the district including engineering, legal, administrative, and contingency is $18,500. Section 5 I Method of Assessment The cost of such improvements is to be assessed against the entire district, each lot, block, or tract of land within the district to be assessed for that portion of the whole cost which its area bears to the entire district, exclusive of streets, avenues, alleys, and public places. The total actual assessable area within the district is 206,469 square feet and is the ~rea on which all protests will be received, considered and determined. It is also th~ figure on which all assessments will be calculated. Section 6 Extended District The City Commission of the City of Bozeman does hereby find that the contemplated work and improvements are, in the opinion of the City Commission, or more than local or ordinary public benefit and that the cost and expense of such improvements shall be chargeable on an extended district and the City Commission does hereby declare that the above district and all lots therein shall be assessed to pay the costs and expenses thereof. Section 7 I Payments The payments will be made in twenty (20) annual installments over a period of nine- teen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 557, as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 557 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for the purpose on said Special Improve- ment District No. 557. Said bonds shall draw a simple interest from the date of their registration until called for payment, at a rate not to exceed seven (7) percent per annum, which interest shall be chargeable as part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of I Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title 11 of the Revised Codes of Montana, 1947, relating to special improve- ment district in cities and towns, and any amendments thereof or thereto. Protests must be made in writing and delivered I to the Clerk of the City Commission within 15 days after date of the first publication of this notice. The general character of improvements is the purpose of construction and installation of a sanitary sewer line to serve a portion of the Bozeman Creek Annexation to the City of Bozeman, Montana.
