WHEREAS, there has been filed with the Clerk of the Commission of the City of Bozeman, Montana,
a petition in due form of certain property owners in Block One of the Brunton-Palffy Rearrangement
of a portion of Durston Subdivision asking that a Special Improvement Lighting District be created
for the purpose of operating and maintaining a lighting system to light the north-south alley in
said Block One in the City of Bozeman, Gallatin County, Montana;
WHEREAS, at a regular meeting of the City Commission of the City of Boz-eman held on the 25th-
day of June, 1975, the aforesaid petition was respectively considered and granted;
NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
Declaration of Intention.
It is hereby declared to be the intention of the City of Bozeman to create a Special Improve-
ment District to be known and designated as Special Improvement District No. 556 of the City of
Bozeman for the purpose of operating and maintaining a lighting system to light the north-south
alley between North Tenth Avenue and North Eleventh Avenue from West Villard Street to Durston Road.
Sec tion 2
Boundaries
The Boundaries of said Special Improvement Lighting District No. 556 are described as follows:
Beginning at the Northwest Corner of Block 1 of the Brunton-Palffy Re-
arrangement of a portion of the Durston Subdivision to Bozeman, Montana,
said point being also the intersection of the East Line of North Eleven-
th Avenue and the South line of Durston Road; thence Easterly along the
I South line of Durston Road a distance of 235.6 feet to the Northeast
corner of said Block 1; thence Southerly along the West line of North
Tenth Avenue a distance of 877.4 feet to the Southeast corner of said
Block No.1; thence westerly along the north line of West Villard
Street a distance of 257~5 feet to the Southwest corner of said Block
No.1; thence Northerly along the East line of North Eleventh Avenue a
distance of 881.34 feet to the Northwest corner of said Block No.1, the
place of beginning.
Contained within the above described exterior boundaries are the following Lots, Block, and
Tracts of Land to wit:
Lots 1 through 24 inclusive of Block No.1 of the Brunton-Palffy Re-
arrangement of a portion of Durston Subdivision to Bozeman. Montana.
Section 3
Character of Improvements
The character of improvements to be installed and paid for by the Montana Power Company is
the erection and installation of six (6) 100-Watt (3.500 Lumens) Type III Mercury Vapor Luminaries
to be mounted on existing distribution poles in the alley. All lights are to be served by overhead
conductors. The system shall be equipped with all necessary appliances for sale and proper operation
of the system.
Section 4
Estimated Cost of
Maintenance and Electrical Current
An estimate of the cost of maintaining such lighting system is $1.94 per unit per month or the
tota\ of $139.68 per year plus an annual administration charge of $147.18.

Method of Assessment
The cost of maint~1ning such improvement is to be assessed against the ~tire district; each
lot or parcel of land within such district will be assessed for that part of the whole cost which
its area bears to the total area within the district. The total area within the district is
199.220.37 square feet a-ad is the area on which all protests will be received, considered. and

Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 20th day of August, 1975, at the
hour of 1:15 o'clock p.m. of said da~ is the time and place where and when the City Commission will
hear and pass upon all protests duly and regularly made and filed against the creation of said pro-
posed Special Improvement District No. 556, the improvements proposed to be made pursuant thereto,
and the extent and character thereof, or either thereof; and the Clerk of the City Commission be,
and she is hereby directed to give notice in the manner and for the time as by law required, of the
adoption of this resolution of intention.

ADOPTED by the City Commission of the City of Bozeman, at a regular and stated session of
said City Commission, held on the 30th day of July, 1975.

NOTICE IS HEREBY GIVEN that on the 30th day of July, 1975, at a regular session of the City
Commission of the City of Bozeman, Commission Resolution No. 1743, entitled:

was passed and adopted.
That Wednesday, the 20th day of August, 1975, at 1:15 p.m. o'clock, at the Commission Room
of the City Hall, Bozeman, Montana, is designated by Commission Resolution No. 1743 as the time
when and the place where the City COmmission of the City of Bozeman will hear and pass upon all
protests that may be made against the making of such improvements, or the creation of said district.
Protests must be made in writing and delivered to the Clerk of the City Commission within 15 days
after date of the first publication of this notice.
The general character of improvements is the purpose of operating and maintaining a lighting
system to light the IiIIOrth-south alley between North Tenth Avenue and North Eleventh Avenue from
West Villard Street to Durston Road, said lighting system to be installed and paid for by the
Montana Power Company under authority of and in conformance with Section 11-2245 to 11-2257 inclus-
ive of the Revised Codes of Montana, 1947.
The estimated cost of maintaining said lighting system is $1.94 per unit per month or the total
of $139.68 per year plus an annual administration charge of $1.25 per unit or a total annual charge
of $147.18 to be assessed against the properties within the district.
For a description of the boundaries of said Special Improvement District No. 556 reference is
hereby made to COmmission Resolution No. 1743 of the City Commission of the City of Bozeman, de-
claring the intention to create said district, which is on file in the office of the undersigned
Clerk of the said City Commission in the City Hall of said City of Bozeman, Montana, and open for
inspection to all interested parties and the public generally.
This notice is given pursuant to the provisions of Section 11-2204, R.C.M., 1947.
