SPECIAL IMPROVEMENT DISTRICT NO. 555 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF A SANITARY SEWER TRUNK LINE TO SERVE A PORTION rl,,/tf OF FIGGIN'S ADDITION TO BOZEMAN, MONTANA, MORE SPECIFICALLY DESCRIBED AS FOLLOWS: A TEN (10) INCH SANITARY SEWER AND NECESSARY APPURTENAN- CES IN SOUTH THIRD AVENUE BETWEEN HILL STREET AND KAGY BOULEVARD AND I A TEN (10) INCH SANITARY SEWER AND APPURTENANCES IN KAGY BOULEVARD BETWEEN SOUTH THIRD AVENUE AND SOUTH TRACY AVENUE IN THE CITY OF BOZ- EMAN . THE CONSTRUCTION AND INSTALLATION OF SAID SANITARY SEWER TRUNK LINE TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIAL, SEWER PIPE, MANHOLES, NECESSARY WYES, AND OTHER NECESSARY APPURTENANCES. WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, a petition in due form of certain owners of properties situated within the boundaries of Special Improvement District No. 555 as hereinafter more specifically described, asking that a Spe- cial Improvement District be created for the purpose of constructing and installing a sanitary sewer trunk line to serve the area within the district. WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held on the 26th day of February, 1975, the aforesaid petition was respectively considered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention It is hereby declared to be the intention of the City of Bozeman to create a Special Improvement District to be known and designated as Special Improvement District No. 555 of the City of Bozeman for the purpose of constructing and installing a sanitary sewer trunk line, said project to include all trench excavation and backfill, bedding material, sewer pipe, manholes, necessary wyes, and other necessary appurtenances. Sec tion 2 Boundaries The boundaries of said Special Improvement District No. 555 are described as follows: I Beginning at the East one-quarter corner of Section 24. Township 2 South, Range 5 East of M.P.M., Gallatin County, Montana, said point being also the Southeast corner of Figgin's Addition to the City of Bozeman, Montana; thence along the South line of said Figgin' s Addition, South 890 17' 05" West a distance of 1332.17 feet to the Southwest corner of said Figgin's Addition; thence North 00 19' 41" East along the West line of Figgin's Addition a distance of 1567.27 feet; thence North 890 04' 00" East a distance of 9.05 feet; thence Northeasterly along a circular curve to the right having radius 1382.5 feet through a central angle of 250 01' 49" an arc distance of 603.96 feet; thence North 300 25' 00" East a distance of 271.70 feet to the Southwest corner of Lot 1, Block 9, Figgin's Addition; thence South 590 35' 00" East a distance of 146.29 feet; thence South 310 42' 00" East a distance of 60 feet; thence Northeasterly along a circular curve to the right having radius 220 feet through a central angle of 310 00' 00" an arc distance of 61.74 feet; thence South 00 07' 00" West a distance of 105.08 feet; thence South 330 47' 00" West a distance of 92.59 feet; thence South 450 23' 00" East a distance of 71.96 feet; thence South 00 07' 00" West a dis- tance of 906.15 feet; thence North 890 18' 00" East a distance of 489.97 feet; thence South 00 07' 00" West a distance of 265.50 feet; thence North 890 18' 00" East a distance of 150.00 feet; thence South 00 07' 00" West a distance of 103.21 feet; thence North 890 18' 00" East a distance of 144.31 feet; thence South 00 13' 00" West a distance of 760.07 feet to the point of beginning. Contained within the above described exterior boundaries aE the following lots. blocks. and tracts of land to wit: Lots 6 thru 8 inclusive of Block 3, Lots 1 thru 8 inclusive and Lots 11 thru 36 inclusive of Block 4. all of Unplatted Block 5, Lots 1 thru 24 inclusive of Block 6, Lots 1 thru 5 inclusive of Block 8, and all unplat~ed portions of Blocks 6, 7. 8 and 9. all in the Figgin's Addition to the City of Bozeman. Section 3 I Character of Improvements The character of the improvements to be made is the construction' and installation of a ten (10) inch sanitary sewer main, including trench excavation and backfill, bedding material, sewer pipe, manholes, wyes, and other work appurtenant thereto. Section 4 Estimate of Cost The total estimated cost of the improvements within the district including engineering, legal. administration, and contingency is $48,000.00. "" .'. - .'- .-...'...... 406 tract or parcel of land within the district will be assessed for that portion of the whole cost which its area bears to the area of the entire district exclusive of streets, avenues, alleys and public places. The total actual assessable area within the district is 1,644,260.90 square feet and is the area on which all protests will be received, considered, and determined. It is also the figure on which all assessments will be calculated. Section 6 Extended District I The City Commission of the City of Bozeman does hereby find that the contemplated work and im- provements are, in the opinion of the City Commission, of more than local or ordinary public benefit and that the cost and expense of such improvements shall be chargeable on an extended district and the City Commission does hereby declare that the above district and all lots therein shall be assessed to pay the costs and expenses thereof. Section 7 Payments The payments for the improvements shall be made in twenty (20) annual installments over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 555, as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 555 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for the purpose on said Special Improvement District No. 555. Said Bonds shall draw a simple interest from the date of their registration until called for payment, at a rate not to exceed seven (7) percent per annum, which interest shall be chargeable as part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11~2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title 11 I of the revised codes of Montana, 1947, relating to special improvement districts in cities and towns, and any amendments thereof or thereto. Section 8 Protests and Notice The regular session of the City Commission of the City of Bozeman to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 25th day of June, 1975, at the hour of 1:15 o'clock p.m. of said day, is the time and place when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 555, the improvements proposed to be made pursuant thereto, and the extent and character thereof, or either thereof; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this resolution of intention. I That Wednesday, the 25th day of June, 1975, at 1:15 p.m. o'clock, at the Commission Room of the City Hall, Bozeman, Montana, is designated by Commission Resolution No. 1737 as the time when and the place where the City Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district. Pro- tests must be made in writing and delivered to the Clerk of theCity Commission within 15 days after date of the first publication of this notice. The general character of improvements is the construction and installation of a sanitary sewer trunk line to serve a portion of Figgin's Addition to Bozeman, Montana, more specifically described as follows: A ten (10) inch sanitary sewer and necessary appurtenances in South Third Avenue be- tween Hill Street and Kagy Boulevard and a ten (10) inch sanitary sewer and appurtenances in Kagy Boulevard between South Third Avenue and South Tracy Avenue in the City of Bozeman. The constru- ction and installation of said sanitary sewer trunk line to include all trench excavation and backfill, bedding material, sewer pipe, manholes, necessary wyes, and other necessary appurtenances. The estimated cost of said improvements within the district, including engineering, legal, administration, and contingency, is $48,000.00. For a description of the boundaries of said Special Improvement District No. 555 reference is hereby made to Commission Resolution No. 1737 of the City Commission of the City of Bozeman, declaring the intention to create said district, which is on file in the office of the undersigned Clerk of the said City Commission in the City Hall of said City of Bozeman, Montana, and open for Ed inspection to all interes~parties and the public generally.
