A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING
IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL hOIIt __

FIGGIN'S ADDITION TO THE CITY OF BOZEMAN.
WHEREAS, there has been filed with the Clerk of Commission of the City of Bozeman, Montana,
a petition in due form of certain owners of properties situate in the Figgins Addition to the City
of Bozeman asking that a Special Improvement District be created for the purpose of constructing
and installing an asphaltic concrete pavement project to include integral concrete curbs and gutters
and other work incidental thereto, and
WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held on the
day 0 f , 197__, the aforesaid petition was respectively considered and granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section I
Declaration of Intention
It is hereby declared to be the intention of the City of Bozeman to create a Special
Improvement District to be known and designated as Special Improvement District No. 558 for the
purpose of constructing and installing pavement on Morrow Street, Spring Creek Drive, Langohr Avenue,
between Arnold Street and Westridge Drive, Arnold Street between Langohr Avenue and South Third
Avenue, and Westridge Drive between Langohr Avenue and South Third Avenue in the Figgin's Addition.
Said pavement project to include construction of an asphaltic-concrete type pavement, integral
concrete curb and gutter, and other work incidental thereto.
Section 2
Boundaries.
The boundaries of said Special Improvement District No. 558 are described as follows:
Beginning at the East one-quarter corner of Section 24, Township 2 South, Range
I 5 East, M.P.M., Gallatin County, Montana; thence North 0013'00" East a distance
of 1050.78 feet; thence South 89018'00" West a distance of 40.01 feet to the
true point of beginning, said true point of beginning being the southeast corner
of Lot 1, Block 3, of the Figgin's Addition to the City of Bozeman; thence North
0013'00" East a distance of 275.00 feet; thence North 0000'05" East a distance
of 1086.14 feet to a point on the east line of Lot 1, Block 9, Figgin's Addition;
thence South 89018'00" West a distance of 163.39 feet to a point; thence South
0000'05" West a distance of 140 feet to the northeast corner of Lot 7, Block 1,
Figgin I s Addition~ thence South 37057'24" West a distance of 144.07 feet to the
southwest corner of Lot 7, of said Block 1; thence South 34043'24" East a distance
of 144.07 feet to the southeast corner of said Lot 8 of Block 1; thence South
0007'00" West a distance of 40 feet to the northeast corner of Lot 21 of said
Block 1; thence South 37034'02" West a distance of 148.01 feet to the southwest
corner of said Lot 21; thence South 89018'00" West a distance of 490.00 feet;
thence south 0007'00" West a distance of 573.10 feet; thence North 89018'00"
East a distance of 490.00 feet to the northwest corner of Lot 50 of Block 1,
Figgin's Addition; thence South 34027'55" East a distance of 158.57 feet to the
southeast corner of said Lot 50; thence South 0007'00" West a distance of 60
feet; thence North 89018'00" East a distance of 60 feet to the northwest corner
of Lot 1, Block 4, Figgin's Addition, thence South 54018'57" East a distance of
128.94 feet to the southeast corner of said Lot 1, the true point of beginning.
Contained within the above-described exterior boundaries are the following Lots, Blocks,
and Tracts of land, to-wit:
The southeast one-half of Lot 7, the northeast one-half of Lot 8,
the southeast one-half of Lot 21, all of Lots 22 thru 49 inclusive,
and the northeast one-half of Lot 50, all in Block 1; Lots 1 thru
13 inclusive of Block 2; and the northeast one-half of Lot 1 of
Block 3, all of the above in the Figgins Addition to the City of
Bozeman.

Character of Improvement
Construction of a pavement project with integral concrete curb and gutter and necessary
appurtenances to said construction on Morrow Street, Spring Creek Drive, Langohr Avenue between
Arnold Street and Westridge Drive, Arnold Street between Langohr Avenue and South Third Avenue, and
Westridge Drive between Langohr Avenue and South Third Avenue in the Figgin's Addition to the City
of Bozeman, said pavement project to include excavation, installation of gravel sub-base and asphal-
tic concrete base and surface course, concrete curb and gutter and other appurtenant work necessary
to complete said pavement project.

Section 4
Estimate of Cost
The preliminary estimate of cost is $170,000.00 including construction costs, engineering, legal,
administration, and contingency.
Section 5
Method of Assessment
The cost of said improvement is to be assessed against the entire district, each lot or parcel I
of land within such districts will be assessed for that part of the whole cost which its area bears
to the area of the entire district, exclusive of streets, alleys, and public places, and further,
each square foot of land within the district lying within 25 feet of the line of the street on which
the improvements herein provided for are made shall bear double the amount of the assessment per
square foot of such land that each square foot of any other land within the district shall bear.
The total action assessable area within the entire district is 551,439.37 square feet, and is
the area on which all protests will be received, considered, and determined. It is also the figure
on which all assessments will be calculated.
Section 6
Extended District
The City Commission of the City of Bozeman does hereby find that the contemplated work and
improvements are, in the opinion of the City Commission, of more than local or ordinary public bene- <
fit and that the cost and expense of such improvements shall be chargeable on an extended district
and the City Commission does hereby declare that the above district and all lots included therein shall
be assessed to pay the costs and expenses thereof.
Section 7
Payments
The payments for the improvements shall be made in twenty annual installments over a period of
nineteen years, but this shall not be construed to prevent payment in full at any regular payment
date by any property owner who desires to do so. It is proposed to pay the entire cost and expense
of the construction and installation or said improvements with cash to be obtained from the sale of I
bonds of said Special Improvement District No. 558, as authorized by law. Such bonds will be in de-
nominations of $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and
chargeable against a fund to be known and designated as Special Improvement District No. 558 fund of
the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples,
and in the order of their registration, whenever funds are available for the purpose on said Special
Improvement District No. 558. Said bonds shall draw a simple interest from the date of their regis-
tration until called for payment at a rate not to exceed percent per annum, which interest
shall be chargeable as part of the cost of construction and installation of said improvements.
The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and
Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title II
of the Revised Codes of Montana, 1947, relating to special improvement districts in cities and towns,
and any amendements thereof or thereto.
Sec tion 8
Protests and Notice
The regular session of the City Commission of the City of Bozeman, to be held at the Commission
Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 4th day of February, 1976, at the hour
of 1:15 o'clock p.m. of said day, is the time and place when and where the City Commission will hear
and pass upon all protests duly and regularly made and filed against the creation of said proposed
Special Improvement District No. 558, the improvements proposed to be made pursuant thereto, and the
extent and character thereof, or either thereof; and the Clerk of the City Commission be, and she is
hereby directed to give notice in the manner and for the time as required by law, of the adoption of I
this resolution of intention.
ADOPTED by the City Commission of the City of Bozeman, at a regular and stated session of said
Ci ty Commission, held on the 7th day of January, 1976. , . _, /

NOTICE IS HEREBY GIVEN that on the 7th day of January 1976, at the regular meeting of the
City Commission of the City of Bozeman, the said City Commission duly and regularly passed and adopt-

NOTICE IS HEREBY FURTHER GIVEN that Wednesday, the 4th day of February, 1976, at 1:15 o'clock
p.m. at the Commission Room in the City Hall BUilding, Bozeman, Montana, is designated as the time,
and place to hear objections to the creation of the Special Improvement District more fully des-
cribed in said resolution of intention numbered 1774, and is the time and place any person whose
property abuts upon said territories may appear and object tothe proposed creation of the Special
Improvement District.
This notice is given pursuant to Section 11-3310, Revised Codes of Montana, 1947.
