TO STORM DRAINAGE ON PORTIONS OF REMINGTON WAY SHOWN ON THE
AMENDED SUBDIVISION PLAT OF THE REARRANGEMENT OF LOT 2 AND
LOT 6, REMINGTON ADDITION TO THE CITY OF BOZEMAN, MONTANA.
WHEREAS, there has been filed with the Clerk of the City Commission of the
City of Bozeman a petition in due form of certain owners of property situated
within the boundaries of Special Improvement District No. 566 as hereinafter
more specifically described, asking that a special improvement district be
created for the purpose of constructing and installing an asphaltic concrete
type pavement, together with integral concrete curb and gutter, and necessary
appurtenances thereto, and'necessary storm drainage facilities appurtenant to
such pavement, to serve the lots within the district; and,
WHEREAS, that at a regular meeting of the City Commission of the City of
Bozeman, held on the 16th day of June, 1976, the aforesaid petition was
respec-
tively considered and granted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
Declaration of Intention

It is hereby delcared to be the intention of the City Commission of the City
of Bozeman to create a special improvement district to be known and designated as
Special Improvement District No. 566 of the City of Bozeman for the purpose of
constructing and installing an asphaltic concrete type pavement on portions of
Remington Way, said project to include construction and installation of integral
concrete curb and gutter and necessary appurtenances thereto, together with
necessary storm drainage facilities appurtenant to such paving.
Section 2
Boundaries
The boundaries of Special Improvement District No. 556 are described as follows:
Beginning at the northeast corner of Lot 6, Remington Addition
to the City of Bozeman, thence South 00032'21" West along the
east line of said Lot 6, a distance of 249.43 feeti thence
North 89055'13" West, parallel to and 50. feet north
of the
South line of said Lot 6, a distance of 417.20 feet to the
west line of said Lot 6; thence North 00038'34" East a dis-
tance of 472.16 feet, thence North 89023'28" West a distance
of 10 feet, thence North 0036'32" East a distance of 163.76
feet to the northwest corner of Lot 3 of said Remington
I
Addition; thence South 89051'20" West a distance of 153.21
feet, thence South 5016'55" West a distance of 130.03 feet
along the east boundary of said Lot 3, thence North 85041'51"
East a distance of 165.55 feet to the northeast corner of
Lot 2, thence South 0024'37" West a distance of 269.94 feet,
thence North 89051'20" East a distance of 117.56 feet to the
point of beginning.
Included within these exterior boundaries are the following
lots: Lots 2, 3, and a portion of Lot 6,
all in the Remington
Addition to the City of Bozeman.

Section 3
Character of Improvements
The character of improvements is the construction and installation of a pavement
project with integral concrete curb and gutter, together with storm drainage and
I necessary appurtenances to said construction on portions of Remington Way as shown
on the Amended Subdivision Plat of the Rearrangement of Lot 2 and Lot 6, Remington
Addition to the City of Bozeman, said project to include construction of gravel
sub-base', an asphaltic concrete type base and surface course, all necessary excavation
and backfill, and other appurtenant work thereto.
Section 4
Estimate of Cost
The estimated cost of the improvements within the district, including engineer-
ing, legal, administration, and contingency is $21,000.00.
Section 5
Method of Assessment
The cost of the improvements is to be assessed against the entire district;
each lot, block, tract, or parcel of land within the district will be assessed for
that portion of the whole cost which its area bears to the area of the entire dis-
trict, exclusive of streets, avenues, alleys,
and public places. The total actual
assessable area within the entire district is 186,641.92 square feet,
which is the
I area on which all protests will be received, considered, and determined,
and on
which all assessments will be calculated.
Section 6
Payments
The payments for the improvements shall be made in twenty (20)
annual install-
ments over a period of nineteen (19) years, but
this shall not be construed to pre-
vent payment in full at any regular payment date by any property owner who desires
to do so. It is proposed to pay the entire cost and expense of the construction
and installation of said improvements with cash to be obtained from the sale of
bonds of said Special Improvement District No. 566, as authorized
by law. Such
bonds will be in denominations of $100.00 each, and fractions or multiples of
$100.00 where necessary, to be issued and chargeable against a fund to be known
and designated as Special Improvement District No. 566 Fund of the City of Bozeman.
The bonds will be redeemable at the option of the City, singly or in multiples,
and in the order of their registration, whenever funds are available for the pur-
pose on said Special Improvement District No. 566. Said bonds
shall draw a
I simple interest from the date of their registration until called for payment,
which interest shall be chargeable as part of the cost of construction and installa-
tion of said improvements. The bonds will be issued and sold in accordance with
the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana,
1947, and all other applicable provisions of Title II of the Revised Codes of
Montana, 1947, relating to special improvement districts in cities and towns,
and
any amendments thereof or thereto.

Section 7
Protests and Notice
The regular session of the City Commission of the City of Bozeman to be held
at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday,
the 14th day of July, 1976, at the hour of 1:15 o'clock p.m. of said day, is the
time and the place, when and where the City Commission will hear and pass upon I
all protests duly and regularly made and filed against the creation of said pro-
posed Special Improvement District No. 566, the improvements proposed to be made
pursuant thereto, and the extent and character thereof, or either thereof; and
the Clerk of the City Commission be, and she is hereby directed to give notice in
the manner and for the time as by law required, of the adoption of this resolution
of intention.
ADOPTED by the City Commission of the City of Bozeman, at a regular and
stated session of said City Commission, held on the 23rd day of June 1976.

NOTICE IS HEREBY GIVEN that on the 23rd day of June, 1976, at a regular
session of the City Commission of the City of Bozeman, Commission Resolution
No. 1796, entitled:

MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF
BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT

was passed and adopted.
That Wednesday, the 14th day of July, 1976, at 1:15 p.m. o'clock, at the I
Commission Room of the City Hall, Bozeman, Montana, is deSigna~ed by c~mm~ssion
Resolution No. 1796 as the time when and the place where the Clty CommlSSlon of
the City of Bozeman will hear and pass upon all protests that may be made against
the making of such improvements, or the creation of said district. Protest must
be made in writing and delivered to the Clerk of the City Commission within 15
days after date of the first publication of this notice.

No. 566 reference is hereby made to the Commission Resolution No. 1796 of the City
I Commission of the City of Bozeman, declaring the intention to create such district,
which is on file in the office of the undersigned Clerk of the said City Commission
in the City Hall of said City of Bozeman, Montana, and open for inspection to all
interested parties and the public generally.
This notice is given pursuant to the provisions of Section 11-2204, Revised
Codes of Montana, 1947.
