If I( . TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 565 FOR THE PURPOSE OF ESTABLISHING OFF-STREET PARKING FACILITIES. WHEREAS, the Parking Commission of the City of Bozeman, Montana, and the I Bozeman Downtown Development Association, Inc. have jointly requested the creation of a special improvement district for the purpose of establishing off-street parking facilities in the City of Bozeman, Montana; and WHEREAS, at a regular meeting of the City Commission of the City of Bozeman, Montana, held on the 26th day of November 1975, said request was considered by said City Commission: NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AS FOLLOWS: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman, Montana, to create an extended Special Improvement District to be known and designated as Special Improvement District No. 565 for the purpose of establishing off-street parking facilities in the City of Bozeman, Montana. Section 2 Boundaries I That the boundaries of said Special Improvement District No. 565 are described as follows: Beginning at the center of the intersection of North Rouse Avenue and East Mendenhall Street in the City of Bozeman, Montana, as described in the description of the Original Townsite of Bozeman, thence northerly along the centerline of North Rouse to the center~ line of East Lamme Street, thence westerly along the centerline of Lamme Street to the intersection of North Bozeman Avenue thence northerly along the centerline of North Bozeman Avenue to the center- line of East Beall Street, thence northwesterly along the centerline of East Beall Street to the centerline of North Black Avenue, thence northerly along the centerline of North Black Avenue approximately one hundred seventy six and fifty hundredths (176.50) feet to the center of the alley running east and west between Black Avenue and Tracy Avenue and Beall Street and Villard Street; thence along the centerline of said alley to the northeast corner of lot 7, block 3, Beall's 3rd Addition to the City of Bozeman, thence westerly along the north boundary of lots 7 and 18 of said block 3, lots 7 and 18 of block 4, Beall's 3rd Addition, and continuing westerly alo~g the north boundary of lot 7, block 8 to the center of the north-south alley between West Beall and West Villard, thence southerly along the centerline of said alley to the centerline of West Beall Street, and continuing southeasterly to the northwest corner of lot 16, block C Tracy's 3rd Addition, thence southerly along the west boun- dary of lots 16, 14 and 5 of said Block C to the centerline of West Lamme Street, thence westerly along the centerline of West Lamme to the centerline of North~Third; thence southerly to the centerline-of West Babcock Street; thence easterly along the centerline of West I Babcock Street to the centerline of South Grand Avenue, thence southerly along the centerline of South Grand Avenue to the center- line of West Olive Street; thence easterly along the centerline of West Olive Street to the centerline of South Tracy Avenue, thence northerly along the centerline of South Tracy Avenue to the center- line of the east-west alley between West Main and West Babcock Streets, thence easterly along the centerline of said alley a distance of one hundred fifty-one (151) feet, thence south along the east boundary of Lot 18, Block A of the Original Townsite of Bozeman a distance of approximately one hundred sixty (160) feet to the centerline of East Babcock Street, thence easterly along said centerline to the center- line of South Black, thence southerly along said centerline of South COMMISSION RESOLUTION NO. 1795 56 Black Avenue to the centerline of East Olive Street, thence along the centerline of East Olive Street easterlx to the centerline of South Bozeman Avenue, thence northerly along the centerline of South Bozeman Avenue approximately one hundred eighty and no one hundredths (180.00) feet, thence easterly along the north boundary of lots 1, 4, 5, 6, 7, -% Acre Lot 1, and part of ~ Acre Lot 2, all of Guy's Addition to the City of Bozeman; thence along the north boundary of lots 11 thru 18 inclusive, Block A, Harper's Addition; thence southeasterly from the northeast corner of said lot 11 to a point twenty'(20) feet south of the north boundary of lot 6, said block A, Harper's Addition thence I easterly along a line ten (10) feet north and parallel to the south boundary of said Lot 6, to the west boundary of Church Avenue, thence northerly along the west boundary of Church Avenue to the centerline of West Mendenhall Street, thence west along the centerline of West Mendenhall to the point of beginning at the intersection of center- lines of North Rouse and East Mendenhall. Section 3 Purpose That the purpose of the creation of said Special Improvement District is to finance the establishing of public off-street parking facilities in the City of Bozeman on the following described site: Beginning at the Northwest corner of Block E of the Original Town- site of Bozeman, Montana, and proceeding eastward to the northeast corner of lot 18, Block E, thence south one hundred fifty and no one hundredths (150.00) feet to the southeast corner of lot 18, Block E, thence westerly to a point on the southwest corner of lot 24 in Block F of said Original Townsite; thence north to the northwest corner of lot 24, Block F, thence easterly to the beginning point at the northwest corner of Block E. Section 4 Estimate of Cost That the preliminary estimate of cost of establishing and financing said off-street parking facilities is $750,000.00. I Section 5 Extended District That the City Commission is of the opinion that the cost of establishing off-street parking facilities is of more than local or ordinary public benefit and that the expense of said improvement shall be chargeable upon an extended district to include assessment of lots and parcels of land not fronting on said off-street parking facility, which extended district the city commission hereby declared to be the district benefited by said work and improvements and to be the area assessed to pay the costs and expenses thereof. Section 6 Method of Assessment That the cost of establishing said off-street parking facilities is to be assessed against the lots and parcels of land within said district in accordance with a formula established by Ordinance numbered 962 of the City of Bozeman, Montana, which is hereby declared to be the formula for assessment, which formula I is set forth in Exhibit "A" hereunto attached and by this reference incorporated in and made a part of this resolution as fully as if set forth herein. Section 7 Payments That the payments for said improvements shall be made in twenty (20) annual installments extending over a period of nineteen (19) years, but this shall not be .----- COMMISSION ~ESQLUTION NO. 1795 .. ...._--,---~-- . ~. .. -.------".- -~'7 -..Ct) construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is prcposed to pay the entire cost and expenses of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 565 as authorized by law. Such bonds will be in denominations of $1,000.00 each, and fractions or multiples of $1,000.00 where I necessary to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 565 Fund of the City of Bozeman. The bonds will be redeemable at the option of the city, singly or in multiples and in the order of their registration, whenever funds are available for that purpose in said Special Improvement District No. 565. Said bonds will draw a simple interest from the date of their registration until called for payment, which interest shall be chargeable as a part of the cost of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title II of the Revised Codes of Montana, 1947, relating to special improvement districts in cities and towns and any amendments thereof or thereto. Section 8 Protests and Notice That the regular session of the City Commission of the City of Bozeman to be held at the commission chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 7th day of July, 1976, at the hour of two o'clock p.m. of said day, is the I time and place, when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said Special Improvement District No. 565, the improvements proposed to be made pursuant thereto and the extent and character thereof, and the clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this resolution of intention. " **************** NOTICE IS HEREBY GIVEN that on the 16th day of June, 1976, at a regular session of the City Commission of the City of Bozeman, Commission Resolution No. 1795 I entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 565 FOR THE PURPOSE OF ESTABLISHING OFF-STREET PARKING FACILITIES. was passed and adopted. -------.."... .-...-.- ,.-- COMMISSION RESOLUTION NO. 1795 59 That Wednesday, the 7th day of July, 1976, at 2:00 o'clock p.m., at the Commission Room of the City Hall, Bozeman, Montana, is designated by Commission Resolution No. 1795 as the time when and the place where the City Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district. Protests I must be made in writing and delivered to the Clerk of the City Commission within 15 days after date of the first publication of this notice. The purpose of the creation of said Special Improvement District is to finance the establishing of public off-street parking facilities in the City of Bozeman on the following described site: Beginning at the Northwest corner of Block E of the Original Town- site of Bozeman, Montana, and proceeding eastward to the northeast corner of lot 18, Block E, thence south one hundred fifty and no one hundredths (150.00) feet to the southeast corner of lot 18, BIQCk E, thence westerly to a point on the southwest corner of lot 24 in Block F of said Original Townsite; thence north to the northwest corner of Lot 24, Block F, thence easterly to the beginning point at the north- west corner of Block E. The estimated cost of establishing and financing said off-street parking facilities is $750,000.00. For a description of the boundaries of said Special Improvement District No. 565 reference is hereby made to Commission Resolution No. 1795 of the City Commission of the City of Bozeman, declaring the intention to create said dis- trict, which is on file in the office of the undersigned Clerk of the said City I Commission in the City Hall of said City of Bozeman, Montana, and open for inspection to all interested parties and the public generally.
