TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 570 FOR THE ..IJl/ (I.., PURPOSE OF CONSTRUCTION AND INSTALLATION OF AN ASPHALTIC- CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS, AND NECESSARY APPURTENANCES THERETO ON ARNOLD STREET WEST OF I LANGOHR AVENUE, LANGOHR AVENUE BETWEEN ARNOLD STREET AND STAUDAHER STREET, HENDERSON STREET, STAUDAHER STREET BETWEEN SECOR AVENUE AND SOUTH 3RD AVENUE, SECOR AVENUE AND ERWIN AVENUE, IN THE FIGGIN'S ADDITION, PHASE II, TO THE CITY OF BOZEMAN. WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman a petition in due form of certain owners of properties situated in the Figgin's Addition to the City of Bozeman asking that a Special Improvement District be created for the purpose of construction and installation of an asphaltic concrete pavement project to include integral concrete curbs and gutters and other work incidental and thereto, and WHEREAS, at a regular meeting of the City Commission of the City of Bozeman, held on the 26th day of February, 1975, ' the aforesaid petition was respectively considered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention It is hereby declared to be the intention of the City of Bozeman to create a I special improvement district to be known and designated as Special Improvement District No. 570 for the purpose of construction and installation of pavement on Arnold Street and Staudaher Street, Henderson Street, Staudaher Street between Secor Avenue and South Third Avenue, Secor Avenue and Erwin Avenue, in the Figgin's Addition, Phase II, in the City of Bozeman. Said pavement project to include construction of an asphaltic-concrete type pavement, integral concrete curb and gutter, and necessary appurtenances thereto. Section 2 Boundaries The boundaries on said Special Improvement District No. 570 are described as follows: Beginning at the East quarter corner of Section 24, Township 2 South, Range 5 East, M.P.M., thence South 89017'05" West a dis- tance of 502.90 feet to the true point of beginning, thence South 89017'05" West a distance of 547.56 feet thence North 0006'47" East a distance of 1126.03 feet, to the northwest corner of Lot 24, Block 6, Figgins Addition, Phase II to the City of Bozeman, thence South 89018'00" West a distance of 102.56 feet, thence North 0006'47" East a distance of 60.00 feet to the southwest corner of Lot 5, Block 8, Figgin's Addi- I tion, thence northeasterly to the northeast corner of said Lot 5, thence North 89018'00" East a distance of 290.00 feet to the northeast corner of Lot 1, said Block 8, thence North 0007'00" East a distance of 20.55 feet to the northwest corner of Lot 57, Block 1, Figgins Addition, thence North 89018'00" East a distance of 490.00 feet to the northwest corner of Lot 50, said Block 1, thence southeasterly to the southeast corner of said Lot 50, thence southerly across Arnold Street to the northeast corner of Lot 9, Block 4, Figgin's Addition, Phase II, thence across Langohr Avenue to the northwest corner of Lot 1, Block 3, thence southeasterly across said Lot 1 to its southeast corner, thence South 0013'00" West a distance COMMISSION RESOLUTION NO. 1806 - __..____.__._._."._.._...____._.________m._.no"_."".__.__._....._...__.... .- -.. _n ._....._____ _. u____ -.-...-.--....- ~_. 90 of 669.93 feet, thence South 89018'00" West a distance of 496.91 feet, thence South 0006'47" West a distance of 334.65 feet to the true point of beginning. Contained within the above described exterior boundaries are the following Lots, Blocks, and tracts of land to wit: Lots 50 thru 57 inclusive in Block 1, Lots 1 thru 5 inclusive in Block 8, Lots 1 thru 36 inclusive, Block 4, Lots 1 thru 8 inclusive, Block 3, Lots 1 thru 24 inclusive, Block 6 and a portion of I Future Block 5, all of the Figgin's Addition to the City of Bozeman, Montana. Section 3 Character of Improvements The character of improvements is the construction and installation of an asphaltic-concrete type pavement project with integral concrete curbs and gutters, and necessary appurtenances thereto on Arnold Street West of Langohr Avenue, Langohr Avenue between Arnold Street and Staudaher Street, Henderson Street, Staudaher Street between Secor Avenue and South 3rd Avenue, Secor Avenue and Erwin Avenue, in the Figgin's Addition, Phase II, to the city of Bozeman. Section 4 Estimate of Cost The estimated cost of the improvements within the district, including engineering, legal, administration, and contingency is $320,000. Section 5 Method of Assessment The cost of said improvement is to be assessed against the entire district, I each lot or parcel of land within such districts will be assessed for that part of the whole cost which its area bears to the area of the entire district, exclu- sive of streets, alleys, and public places, and further, each square foot of land within the district lying within 25 feet of the line of the street on which the improvements herein provided for are made shall bear double the amount of the assessment per square foot of such land that each square foot of any other land within the district shall bear. The total actual assessable area within the entire district is 1,073,681.95 square feet, and is the area on which all pro- tests will be received, considered and determined. It is also the figure on which all assessments will be calculated. Section 6 Payments The payments for the improvements shall be made in twenty annual installments over a period of nineteen years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installa- I tion of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 570, as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 570 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City singly or in multiples and in the order of COMMISSION RESOLUTION NO. 1806 - -- ---- .-. ---..-..- -.-.---.- 01 .:iJ. their registration, whenever funds are available for the purpose on said Special Improvement District No. 570. Said bonds shall draw a simple interest from the date of their registration until called for payment, which interest shall be chargeable as part of the cost of construction and installation of said improve- I ments. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title II, of the Revised Codes of Montana, 1947, relating to special improvement districts in cities and towns, and any amendments thereof or thereto. Section 7 Protests and Notice The regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 28th day of July, 1976, at the hour of 1:15 o'clock p.m. of said day, is the time and place when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 570, the improvements proposed to be made pur- suant thereto, and the extent and character thereof, or either thereof; and the Clerk of the City Commission be and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this resolution of I intention. ".. -.... --.-.-...-....-.-. .....----... 92 That Wednesday, the 28th day of July, 1976, at 1:15 p.m. o'clock, at the Commission Room of the City Hall, Bozeman, Montana, is designated by Commission Resolution No. 1806 as the time when and where the City Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of ~said district. Protests must be made in I writing and delivered to the Clerk of the City Commission within 15 days after date of the first publication of this notice. The general character of improvements is the construction and installation of an asphaltic-concrete type pavement project with integral concrete curbs and gutters, and necessary appurtenances thereto on Arnold Street West of Langohr Avenue, Langohr Avenue between Arnold Street and Staudaher Street, Henderson Street, Staudaher Street between Secor Avenue and South 3rd Avenue, Secor Avenue and Erwin Avenue, in the Figgin's Addition, Phase II, to the City of Bozeman. The estimated cost of said improvements within the district, including engineering, legal, administration, and contingency is $320,000.00. For a description of the boundaries of said Special Improvement District No. 570 reference is hereby made to Commission Resolution No. 1806 of the City Commission of the City of Bozeman, declaring the intention to create said district, which is on file in the office of the undersigned Clerk of the said City Commission in the City Hall of said City of Bozeman, Montana, and open for inspection to all interested parties and the public generally.
