WATERMAINS AND SANITARY SEWER MAINS AND APPURTENANCES TO I SERVE THE ADJOINING PROPERTIES, MORE SPECIFICALLY AS FOLLOWS: A SIX (6 ) INCH WATERMAIN AND APPURTENANCES IN WESTRIDGE DRIVE AND IN AN EASEMENT WESTERLY THEREFROM, AND AN EIGHT (8) INCH SANITARY SEWER MAIN AND APPURTENANCES IN WESTRIDGE DRIVE IN THE FIGGINS ADDITION AND EXTENDING WESTERLY INTO THE SUMMIT ENGINEERING ANNEXATION. THE CON- STRUCTION AND INSTALLATION TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIALS, CAST IRON WATERMAIN, VALVES, FITTINGS, HYDRANTS, SERVICE LINES AND OTHER NECESSARY APPUR- TENANCES TO PROVIDE WATER TO THE LOTS IN THE DISTRICT, ALONG WITH ALL SEWER PIPE, MANHOLES, WYES, SERVICE LINES AND APPUR- TENANCES NECESSARY TO PROVIDE A SEWAGE SYSTEM TO ALL LOTS WITHIN THE DISTRICT. WHEREAS, there has been filed with the Clerk of the City Commission of the city of Bozeman a petition in due form of certain owners of property situated within the boundaries of Special Improvement District No. 569, as hereinafter more specifically described, asking that a special improvement district be created for the purpose of constructing and installing lateral watermains and sanitary sewer laterals to serve the lots within the district; and, WHEREAS, that at a regular meeting of the City Commission of the city of Bozeman, held on the 26th day of February, 1976, the aforesaid petition was respectively considered and granted. I NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention It is hereby declared to be the intention of the City Commission of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement District No. 569 of the City of Bozeman for the purpose of constructing and installing lateral watermains and sanitary sewer laterals, said project to include all appurtenant work to provide water and sewer service to all the lots within the district. Section 2 Boundaries The boundaries of Special Improvement District No. 569 are described as follows: Beginning at the North one quarter (No\; ) corner of Section 24, T2S, R5E, M.P.M., marked by a 2" x 26" galvanized iron pipe set 24" in the ground and brass cap, thence North 89002' East on and along the North line of theNbrtheast one quarter (NEo\;) of said Section 24 a distance of seven hundred fifty- four and forty-six hundredths (754.46) feet to the true point of beginning, thence South 00021' West a distance of four I hundred thirteen and twenty-one hundredths (413.21) feet, thence North 89002' East a distance of seven hundred six and thirty-three hundredths (706.33) feet, thence North 30025' East a distance of four hundred eighty-three and eighty- nine hundredths (483.89) feet, thence South 89002' West a distance of nine hundred forty-eight and forty-nine hundredths (948.49) feet to the true point of beginning. Included in the described boundaries are the east three hundred (300.00) feet of tract 1 and all of tract 2, Summit Engineering Annexation to the City of Bozeman, Montana. . ______.__.._.__._._..... __.n...__ _ _........_... _n._..__..__ ----------------- - ----..-------------------------------------- .. 8ti Section 3 Character of Improvements The character of the improvement to be made is the construction and installa- tion of a six (6) inch cast iron watermain and an eight (8) inch sanitary sewer main, including all trench excavation and backfill, bedding materials, watermain, I valves, hydrants, fittings, sewer pipe, manho les, .. wye s , service lines, and all other work appurtenant thereto. Section 4 Estimate of Cost The estimated cost of the improvements within the district, including engineering, legal, administration, and contingency is $86,000.00. Section 5 Method of Assessment The cost of the improvements is to be assessed against the entire district, each lot, block, tract, or parcel of land within the district will be assessed for that portion of the whole cost which its area bears to the area of the entire district, exclusive of streets, avenues, alleys, and public places. The total actual assessable area within the entire district is 341,763.0 square feet, which is the area on which all protests will be received, considered, and deter- mined, and on which all assessments will be calculated. Section 6 I Payments The payments for the improvements shall be made in twenty (20) annual install- ments over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 569, as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and desig- nated as Special Improvement District No. 569 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for that purpose on said Special Improvement District No. 569. Said bonds shall draw a simple interest from the date of their registration until called for payment, which interest shall be chargeable as part of the cost of construction and installation of said improve- ments. The bonds will be issued and sold in accordance with the provisions of I Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title 11 of the Revised Codes of Montana, 1947, relating to special improvement districts and cities and towns, and any amendments thereof or thereto. CO~I$SION RESOLUTION NO. 1805 0__ -~ ... - .. .".-- ,. - . .......... .. - -...-.""".---.-- -.. --- ---- - 87 Section 7 Protests and Notice The regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 28th day of July, 1976, at the hour of 1:15 o'clock p.m. of said day, is the I time and place, when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 569, the improvements proposed to be made pursuant thereto, and the extent and character thereof, or either thereof; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for -the time as by law required, of the adoption of this resolution of intention. That Wednesday, the 28th day of July, 1976, at 1:15 p.m. o'clock, at the Commission Room of the City Hall, Bozeman, Montana, is designated by Commission Resolution No. 1805 as the time when and the place where the City Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district.
