AVENUE ANbLANGOHR AVENUE IN FIGGIN'S ADDITION, PHASE II,
TO THE CITY OF BOZEMAN. THE CONSTRUCTION AND INSTALLATION
TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING
MATERIALS, SEWER PIPE, MANHOLES, WYES, LAMPHOLES,
SERVICE
LINES AND OTHER NECESSARY APPURTENANCES.
WHEREAS, there has been filed with the Clerk of the City Commission of the
City of Bozeman, Montana, a petition in due form of certain owners of properties
situated within the boundaries of Special Improvement District No. 567 as herein-
after more specifically described, asking that a special improvement district be
created for the purpose of constructing and installing of sanitary sewer lateral
mains and appurtenances to serve lots within said district.
WHEREAS, that at a regular meeting of the City Commission of the City of
Bozeman held on the 26th day of February, 1975, the aforesaid petition was respec-
tively considered and granted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section'l
Declaration of Intention
It is hereby declared to be the intention of the City of Bozeman to create a I
special improvement district to be known and designated as Special Improvement
District No. 567 of the City of Bozeman for the purpose of constructing and
installing sanitary sewer lateral mains, said project to include all appurtenant
work to provide sewers for all lots within the district.
Section 2
Boundaries
The boundaries of said Special Improvement District No. 567 are more
particularly described as follows:
Beginning at the east quarter corner of Section 24, T2S,
R5E,
M. P.M. , thence North 0013'00" East a distance of three hundred
eighty and eighty-five hundredths (380.85) feet;
thence South
89018'00" West a distance of forty and one hundredths (40.01)
feet to the true point of beginning, thence South 89018'00"
West a distance of five hundred three and seventy-five hundredths
(503.75) feet; thence South 00 06'47" West a distance of three
hundred fifty-one and three hundredths (351. 03) feet,
thence
South 89017'05" West a distance of five hundred forty-seven and
fifty-six hundredths feet to the southwest corner of lot 11,
said Block 6, thence North 0006'47" East a distance of one
thousand ninety-six and one hundredths (1096.01) feet,
thence
South 89018'00" West a distance of twenty-two and forty-three I
(22.43) feet, thence North 0006'47" East a distance of one
hundred seventy and no one hundredths (170.00)
feet to the
northwest corner of lot 4, block 8, Figgin's Addition, thence
North 89018'00" East a distance of two hundred ninety and no
one hundredths (290.00) feet, thence North 0007'00"

distance of twenty and fifty-five hundredths (20.55)

thence North 89018'00" East a distance of four hundred ninety
and no hundredths (490.00) feet to the northeast corner of
lot 51, block 1, Figgin's Addition, thence South 0007'00"

(456.05) feet to the southwest corner of lot 10, Block 4,
thence North 89018'00" East a distance of ninety and no one
hundredths (90.00) feet, thence South 0007'00" West one

Containing within the above described exterior boundaries
I the following lots, blocks and tracts of land,
to wit:
Lots 51 to 57 inclusive,
Block 1, Figgin's Addition, Lots
1 to 4 inclusive, Block 5, Lots
1 to 24 inclusive, Block 6,
Lots 1 to 8 inclusive, Block
4 to Lots 11 to 36 inclusive,
Block 4, Lots 6 to 8 inclusive,
Block 3 and a portion of
Future Block 5.
Section 3
Character of Improvements
The character of improvements to be made is the installation and construction
of eight (8 ) inch sanitary sewer mains, including trench excavation and backfill,
bedding material, manholes, lampholes or clean outs, wyes and sanitary
sewer
service lines and other appurtenant work thereto.
Section 4
Estimate of Cost
The total estimated costs of the improvements within the district, including
engineering, legal and contingency is $100,000.00.
Section 5
Method of Assessment
I The cost of such improvement is to be assessed against the entire district,
each lot, block, tract or parcel of land within the district will be assessed
for that portion of the whole cost which its area bears to the area of the entire
district exclusive of streets, avenues, alleys and public places.
The total
actual assessable area within the district is 772,622.14 square feet,
and is
the area on which all protests, will be received, considered and determined.
It
is also the figure on which all assessments will be figures.
Section 6
Payments
The payments for said improvements shall be made in twenty (20)
annual
installments extending over a period of nineteen (19 )
years, but this shall not
be construed to prevent payment in full at any regular payment date by any
property owner who desires to do so. It is proposed to pay the entire cost and
expense of the construction and installation of said improvements with cash to
be obtained from the sale of bonds of said Special Improvement District No. 567,
as authorized by law. Such bonds will be in denominations of $100.00 each,
and
I fractions or multiples of $100.00 where necessary, to be issued and chargeable
against a fund to be known and designated as Special Improvement District No. 567
Fund of the City of Bozeman. The bonds will be redeemable at the option of the
city, singly or in multiples, and in the order of their registration, whenever
funds are available for the purpose in said Special Improvement District No. 567.
Said bonds shall draw a simple interest from the date of their registration until
called for payment, which interest shall be chargeable as part of the cost of

construction and installation of said improvements. The bonds will be issued
and sold in accordance with the provisions of Section 11-2232 and Section 11-2271,
Revised Codes of Montana, 1947, and all other applicable provisions of Title II
of the Revised Codes of Montana, 1947, relating to special improvement districts
in cities and towns, and any amendments thereof or thereto. I
Section 7
Protests and Notice
That the regular session of the City Commission of the City of Bozeman, to be
held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday,
the 28th day of July, 1976, at the hour of one fifteen o'clock p.m. of said day,
is the time and place, when and where the City Commission will hear and pass upon
all protests duly and regularly made and filed against the creation of said pro-
posed Special Improvement District No. 567, the improvements proposed to be made
pursuant thereto and the extent and character thereof, or either thereof; and the
Clerk of the City Commission be, and she is hereby directed to give notice in the
manner and for the time as by law required, of the adoption of this Resolution of
Intention.
ADOPTED by the Commission of the City of Bozeman, Montana, at a regular and
stated session of said Commission held on the 30th day of June, 1976.

NOTICE IS HEREBY GIVEN that on the 30th day of June, 1976, at a regular
session of the City Commission of.. the City of Bozeman, Commission Resolution
No. 1803, entitled:

was passed and adopted.
That Wednesday, the 28th day of July, 1976, at 1:15 p.m. o'clock, at the
Commission Room of the City Hall, Bozeman, Montana, is designated by Commission
Resolution No. 1803 as the time when and the place where the City Commission of

the City of Bozeman will hear and pass upon all protests that may be made against
the making of such improvements, or the creation of said district. Protests
must
be made in writing and delivered to the Clerk of the City Commission within 15
days after date of the first publication of this notice.

For a description of the boundaries of said Special Improvement District No. 567
reference is hereby made to Commission Resolution No. 1803 of the City Commission
of the city of Bozeman, declaring the intention to create said district, which is
on file in the office of the undersigned Clerk of the said City Commission in the
City Hall of said City of Bozeman, Montana, and open for inspection to all interested
parties and the public generally.
This notice is given pursuant to the provisions of Section 11-2204, Revised
Codes of Montana, 1947.
