-
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN,
MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN
AS SPECIAL IMPROVEMENT DISTRICT NO. 571 FOR THE PURPOSE OF
CONSTRUCTION AND INSTALLATION OF LATERAL WATERMAINS AND
APPURTENANCES TO SERVE THE ADJOINING PROPERTIES, MORE SPECIF-
ICALLY AS FOLLOWS: A TWELVE INCH WATERMAIN IN LINCOLN STREET
AND SIX INCH WATERMAINS ADJACENT TO THE CENTER FOR VETERINARY I
RESEARCH. THE CONSTRUCTION AND INSTALLATION TO INCLUDE ALL
TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIALS, CAST IRON
WATERMAIN, VALVES AND FITTINGS AND HYDRANTS, SERVICE LINES A
AND OTHER NECESSARY APPURTENANCES TO PROVIDE WATER TO ALL
LOTS IN THE DISTRICT.
WHEREAS, there has been filed with the City Clerk of the City of Bozeman, ~1
Montana, a petition in due form of certain owners of properties situated within
the boundaries of Special Improvement District No. 571 as hereinafter more specif-
ically described asking that a Special Improvement District be created for the
purpose of constructing and installing watermains to provide water to lots within
the district.
WHEREAS, that a regular meeting of the City Commission held on the 9th day
of June, 1976, the aforesaid petition was respectively considered and granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1

Dee~aration of Intebnion
THAT IT IS HEREBY DECLARED to be the intention of the City of Bozeman, Montana,
to create a Special Improvement District to be known and designated as Special I
Improvement District No. 571 of the City of Bozeman, for the purpose of constructing
and installing lateral watermains, said project to include all appurtenant work
for the construction and installation of watermains to provide water for all the
lots within the district.
Section 2
Boundaries

The boundaries of S~~cial Improvement District No. 571 are more particularly
described as follows:
Beginning at the East quarter corner of Section 14, Town-
ship 2 South, Range 5 East, M.P.M., thence west along the
quarter section line a distance of 660.00 feet, thence
north a distance of 660.0u feet parallel to the east
boundary of said Section 14, thence easterly a distance
of 660.00 feet on a line parallel with the north boundary
of said Section 14, a distance of 660.00 feet to the
point of begjnning.
Contained within the above described exterior boundaries
is the SE~ of the SE~ of the NE~ of Section 14, Township 2.

Section 3

Estimate of Cost
The total estimated costs of the improvements within the district including
engineering, legal and contingency is $32,000.00.
Section 4
Method of Assessment
The cost of such improvement is to be assessed against the entire district,
each lot, block, tract or parcel of land within the district will be assessed for

that portion of the whole cost, which its area bears to the area of the entire
district exclusive of streets, avenues, alleys,
and public places. The total
actual assessable area within the entire district is ten acres and is the area on
which all protests will be received, considered and determined. It
is also the
I figure on which all a~sessments will be figured.
Section 5
Payment~
The payments for the improvements shall be made in twenty
(20) annual install-
ments over a period of nineteen (19) years,
but this shall not be construed to pre-
vent payment in full at any regular payment date by any property owner who desires
to do so. It is proposed to pay the entire cost and expense of the construction
and installation of said improvements with cash to be obtained from the sale of
bonds of said Special Improvement District Noi=57l as authorized by law. Such
bonds will be in denominations of $100.00 each, and fractions or multipleso6f
$100.00
where necessary, to be issued and chargeable against a fund to be known and desig-
nated as Special Improvement District No. 571 Fund of the City of Bozeman.
The
bonds will be redeemable at the option of the City, singly or in multiples,
and in
the order of their registration, whenever funds are available for the purpose on
said Special Improvement District No. 57l. Said bonds
shall draw a simple interest
from the date of their registration until called for payment, which interest shall
I be chargeable as part of the cost of construction and installation of said improve-
ments. The bonds will be issued and sold in accordance with the provisions of
Section 11-2232 and Section 11-2271, Revised Codes of Montana,
1947, and all other
applicable provisions of Title II of the Revised Codes of Montana, 1947,
relating
to special improvement districts in cities and towns, and any amendments thereof
or thereto.
Section 6
Protests and Notice
The regular session of the Ci.ty Commission of the City of Bozeman to be held
at the Commission Chamber, City Hall Building, Bozeman, Montana,
on Wednesday,
the 18th day of August, 1976, at the hour of 1:15 o'clock p.m.
of said day, ~s
the time and place, when and where the City commission will hear and pass upon all
protests duly and regularly made and filed against the creation of said proposed
Special Improvement District No. 571, the improvements proposed to be made pur-
suant thereto, and the extent and character thereof, or either thereo[t
and the
Clerk of the City Commission to, and she is hereby directed to give notice in the
I manner and for the time as by law required, of the adoption of this resolution of
intention.
ADOPTED bY the City Commission of the City of Bozeman at a regular and stated
session of said City Commission, held on the 28th day of July, 1976.

That Wednesday, the 18th day of August, 1976, at 1:15 p.m.
o'clock, at the
Commission Room of the City Hall, Bozeman, Montana, is designated by Commission
Resolution No. 1815 as the time when and where the City Commission of The City of
Bozeman will hear and pass upon all protests that may be made against the making
of such improvements, or the creation of said district. Protests must be made in
writing and delivered to the Clerk of the City Commission within 15 days after date
of the first publication of this notice.

The general character of improvements is the construction and installation
of lateral watermains and appurtenances to serve the adjoining properties, more
specifically as follows: A twelve inch watermain in Lincoln Street and six inch
watermains adjacent to the Center for Veterinary Research. The construction and
installation to include all trench excavation and backfill, bedding materials,
cast iron watermain, valves and fittings and hydrants, service lines and other
necessary appurtenances to provide water to all lots in the district.
The estimated cost of said improvements within the district, including
engineering, legal, administration, and contingency is $32,000.00.
For a description of the boundaries of said Special Improvement District
No. 571 reference is hereby made to Commission Resolution No. 1815 of the City
Commission of the City of Bozeman, declaring the intention to create said district,
which is on,file in the office of the undersigned Clerk of the said City Commission
in the City Hall of said City of Bozeman, Montana, and open for inspection to all
interested parties and the public generally.
This notice is given pursuant to the provisions of Section 11-2204, Revised
