RESOLUTION PC2013-05
A RESOLUTION OF THE PARKING COMMISSION OF THE CITY OF
BOZEMAN, MONTANA AUTHORIZING THE PARKING MANAGER TO
ENTER INTO A LICENSE AGREEMENT FOR THE NON-PARKING USE OF
THE SURFACE LOT LOCATED AT THE SOUTH EAST CORNER OF
WILLSON AVENUE AND MENDENHALL STREET (AKA ARMORY LOT),
SUBJECT TO CITY ATTORNEY APPROVAL.
WHEREAS, pursuant to city Resolution 3803, the Bozeman Parking Commission has
jurisdiction over three parking districts: the downtown B-3 Zoning District, the Montana State
University Residential Parking District, and the Bozeman High School Residential Parking
District; and
WHEREAS, Sect. 7-14-4501(3), MCA, authorizes the Bozeman Parking Commission,to
charge for use of parking facilities, and
WHEREAS, Sect. 7-14-4622(6), MCA, authorizes the Bozeman Parking Commission to
acquire, construct, rent, lease, maintain, and repair real and personal property used for parking
services; and
WHEREAS, the Bozeman Parking Commission adopted Policy PC2010-01 to allow for the
renting of surface parking lots for special events; and
WHEREAS, in 2008, the City and Parking Commission agreed to the creation of a
supervisory position, hereinafter referred to as Parking Manager, that would serve as a
representative of the Parking Commission, under direct supervision and operational control of
the Parking Commission, and who would supervise personnel and operations specific to the
parking garage and surface parking lots and to issues regarding the three parking districts.
NOW, THEREFORE, BE IT RESOLVED that:
1. The Parking Commission may enter into agreements for the license of surface
parking lots or specific spaces in any of the City owned surface lots subject to the
City Attorney approving the licensing documents.

2. Before entering into a license agreement for use of parking spaces or lots the City
and Parking Commission shall ensure there will be no interference with transit
functions located at the Bridger Park.
3. The City and Parking Commission shall manage and account for revenues and
expenditures of the license agreement.
4. The Parking Manager is authorized to enter into licenses for the surface parking
spaces or lots subject to the provisions of this Resolution.
PASSED and adopted by the Parking Commission of the City of Bozeman, Montana, on
first reading at a session held on the 14th day of August, 2013.
