HomeMy WebLinkAboutResolution 1838 Special Improvement Lighting District 572 175 COMMISSION RESOLUTION NO. 1838 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNWON AS SPECIAL IMPROVEMENT LIGHTING DISTRICT NO. 572 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF OPERATING AND MAIN- TAINING A LIGHTING DISTRICT TO LIGHT THE NORTH-SOUTH ALLEY IN BLOCK 4 OF THE BRUNTON-PALLFY REARRANGEMENT OF A PORTION OF DURSTON SUBDIVISION, AND BLOCK 12 OF THE SPRINGBROOK ADDITION, SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POWER COMPANY UNDER AUTHORITY OF AND IN CONFORMANCE WITH SEC- I TION 11-2245 to 11-2257 INCLUSIVE OF THE REVISED CODES OF MONTANA, 1947. WHEREAS, at a regular session of the City Commission of the City of Bozeman, held on the 27th day of October 1976, the said City Commission duly passed Commission Resolution No. 1833, declaring it to be the intention of the said City Commission to create a special improvement lighting district to be known and designated as Special Improvement Lighting District No. 572 of the said City for the purpose of operating and maintaining a lighting district, and to specially assess the entire cost of maintaining said lighting district to the property owners on an area basis, and said Commission Resolution No. 1833 is hereby referred to and made a part hereof for further particulars in respect to the boundaries of said Special Improvement Dighting District No. 572, the estimated cost of maintaining said improvement, and the method of assessing the same against the property of said district; and, WHEREAS, notice of the passage of said Commission Resolution No. 1833 was duly published, as required by law, in the Bozeman Daily Chronicle, a daily newspaper of general circulation printed and published in the City of Bozeman, Montana, and by sending a copy of such notice by u.S. mail to each person, firm, or corporation having property within the proposed district at his or its last known address, upon the same date that such notice was first published as aforesaid, a due proof having been made of the publication and service of said notice; and, WHEREAS, within the time provided by law and said published and served notice, there were not sufficient protests against the creation of said proposed Special Improvement Lighting District No. 572, and the City Commission was in regular session the 24th day of November, 1976, at 1:15 o'clock p.m. of said day, at the Commission Chamber in the City Hall in the said City of Bozeman, Montana, I the same being the time and place designated in said notice for passing upon all protests, if any, against the proposed work or against the creation or extent of said district, or both or either; and it further appearing that all of the proceedings for the creation of said district have been lawful and regular. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 That the said Special Improvement Lighting District No. 572 of the City of Bozeman be, and the same is hereby created for the purpose of making the improvements as in said Commission Resolution No. 1833 and hereinafter described. Section 2 That said special improvements be, and the same are, hereby ordered to be made in said Special Improvement District No. 572 as follows: THE PURPOSE OF OPERATING AND MAINTAINING A LIGHTING DISTRICT NO. 57 2 FOR THE PURPOSE OF OPERATING AND MAINTAINING A LIGHTING DISTRICT TO LIGHT THE NORTH- SOUTH ALLEY IN BLOCK 4 OF THE BRUNTON-PALFFY REARRANGEMENT OF A PORTION OF DURSTON SUBDIVISION, AND BLOCK 12 OF THE SPRINGBROOK ADDITION, SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POWER COMPANY UNDER AUTHO- RITY OF AND IN CONFORMANCE WITH SECTION 11-2245 TO 11-2257 INCLUSIVE OF THE REVISED CODES OF MONTANA, 1947. Section 3 That the entire cost of maintaining the special improvements herein referred to in said Special Improvement Lighting District No. 572 is $1.94 per unit per monhh or the total of $93.12 per year which will be charged to the property owners on an area basis. I Section 4 The cost of maintaining such improvements is to be assessed against the entire district; each lot or parcel of land within such district will be assessed for that part of the whole cost which its area bears to the total area within the district. The total area within the district is 110,338.88 square feet and is the area on which all assessments will be calculated. Section 5 That the City Engineer be, and he is hereby directed to prepare plans and specifications for the doing of said work and the making of said improvements.
