RECOMMENDED MOTION: “The City Commission having previously heard and considered public testimony, the materials presented in the application, and the review criteria for amendment of the growth policy and having directed the preparation of a resolution to implement the previously approved application P13013, I adopt Commission Resolution 4456.” BACKGROUND: The Department of Community Development received an application to amend Figure 3-1, the future land use map, in the Bozeman Community Plan for approximately 1.63 acres of property generally located east of North 5th Avenue and north of Main Street to change the future land use designation from Community Commercial Mixed Use to Community Core. The City Commission conducted a public hearing on June 24, 2013 to consider the application. After consideration of the matter the City Commission approved application P13013 subject to two contingencies and directed Staff to bring back an implementing resolution. The attached resolution 4456 implements the June 24, 2013 initial approval of the application. UNRESOLVED ISSUES: None FISCAL EFFECTS: None established at this time. ALTERNATIVES: 1. Attachments: Resolution 4456 Map Exhibit Report compiled on: July 16, 2013 74 1 COMMISSION RESOLUTION NO. 4456 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING FIGURE 3-1 OF THE BOZEMAN COMMUNITY PLAN FOR APPROXIMATELY 1.63 ACRES OF PROPERTY LOCATED EAST OF NORTH 5TH AVENUE AND NORTH OF MAIN STREET FROM COMMUNITY COMMERCIAL MIXED USE TO COMMUNITY CORE. WHEREAS, the City of Bozeman has had a comprehensive plan (growth policy) since 1958; and WHEREAS, the City of Bozeman adopted its growth policy known as the Bozeman Community Plan (BCP) through Resolution 4163 on June 1, 2009, and WHEREAS, the City of Bozeman adopted its most recent amendments to the growth policy known as the Bozeman Community Plan (BCP) through Resolution 4195 on August 3, 2009, and WHEREAS, an application has been receive to amend Figure 3-1 the future land use map of the growth policy, and WHEREAS, the City of Bozeman Planning Board conducted a public hearing on the application on June 4, 2013, and 75 Resolution No. 4456 2 WHEREAS, in accordance with 76-1-602, Mont. Codes Ann., the City Commission conducted a public hearing on June 24, 2013 prior to taking any action to adopt or revise the growth policy, and WHEREAS, the City Commission considered the application, received public testimony, and the criteria for amendment established in Section 17.4 of the Bozeman Community Plan; and WHEREAS, the City Commission being fully informed on the matter did take action on a motion to approve the application. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that: Section 1 Figure 3-1 of the Bozeman Community Plan be amended to change the future land use designation from Community Commercial Mixed Use to Community Core upon approximately 1.63 acres of property generally located east of North 5th Avenue and north of Main Street, and addressed as 323, 403, 407, 411 and 421 West Main Street, and more particularly described as: Lots 10-21, Block D, Tracy’s Addition to Bozeman, and one-half of the adjacent streets and alley, located in the Southeast Quarter of the Northeast Quarter of Section 12, Township 2 South, Range 5 East of the Principal Meridian of Montana, City of Bozeman, Gallatin County, Montana, and being further described as follows: Beginning at the Southeast corner of said Lot 10, Block D; 76 Resolution No. 4456 3 thence South 00E24'52" East along the extension of the east line of said Lot 10, a distance of 45.00 feet; thence South 89E49'36" West, a distance of 362.03 feet; Thence North 00E23'36" West along the centerline of North Fifth Avenue, a distance of 195.96 feet; Thence North 89E53'22" East along the centerline of the alley in said Block D, a distance of 361.96 feet; Thence South 00E24'52" East along the East line of said Lot 10, Block D, a distance of 150.57 feet, to the Point of Beginning containing 1.6268 acres as shown on the attached Exhibit.
