SUBJECT: Resolution to transfer ownership of Use of Force Simulator from the City
of Bozeman to the Gallatin Field Authority.

RECOMMENDATION: Authorize Mayor Becker to sign resolution #4455 authorizing
transfer of ownership of Use of Force Simulator from the City of Bozeman to the Gallatin Field
Authority, Department of Public Safety.
BACKGROUND: In 2002 the City of Bozeman purchased a use of force training simulator
(simulator) with grant funding in 2002 for training by the police department and other regional
law enforcement agencies. Between 2002 and 2008, the used the simulator at various non-
permanent locations in the City. On June 2, 2008, the City entered into a Mutual Aid Agreement with the Gallatin Airport Authority, Department of Public Safety (Airport Authority). The
agreement included a permanent storage and training location for the simulator and agreement to
allow the City of Bozeman use of the training facility. Continued maintenance, installation of
necessary software updates, and full control of the simulator has become difficult to complete for
equipment located away from the City. If ownership is transferred to the Airport Authority, they have agreed to pay for and complete necessary service and maintenance of the simulator and
continue to allow the City of Bozeman Police Department, and other regional law enforcement
agencies, use of the simulator and training room.
UNRESOLVED ISSUES: None
FISCAL EFFECTS: There are no continued ownership requirements pursuant to the initial
grant approval. The City will be relieved of continuing maintenance costs and continue to have
access to the simulator for on-going training needs.

COMMISSION RESOLUTION NO. 4455
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE
CITY OF BOZEMAN TO TRANSFER A CERTAIN SURPLUS ITEM FROM
THE POLICE DEPARTMENT TO A COUNTY OR OTHER POLITICAL SUBDIVISION WITHIN THE STATE OF MONTANA.
WHEREAS, the City of Bozeman purchased a use of force training simulator (simulator) with grant funding in 2002 for training by the police department and other regional law enforcement agencies; and
WHEREAS, between 2002 and 2008, the City of Bozeman used the simulator at various
non-permanent locations in the City; and WHEREAS, on June 2, 2008, the City of Bozeman entered into a Mutual Aid Agreement with
the Gallatin Airport Authority, Department of Public Safety (Airport Authority). The agreement
included a permanent storage and training location for the simulator and agreement to allow the City of
Bozeman use of the training facility. The agreement is still in effect; and WHEREAS, continued maintenance, installation of necessary software updates, and full control
of the simulator has become difficult to complete for equipment located away from the City; and
WHEREAS, the Airport Authority has agreed to pay for and complete necessary service and maintenance of the simulator and continue to allow the City of Bozeman Police Department, and other agencies, use of the simulator and training room; and
WHEREAS, Section 7-8-101(2), Montana Code Annotated, grants the City of Bozeman the
power to dispose of any property which is not necessary for the conduct of the City business to any county or other political subdivision without an ordinance, public auction, bids or appraisal.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:
Section 1
That it is hereby declared to be in the best interests of the City of Bozeman to transfer ownership
of the use of force training simulator, Asset #3083, to the Gallatin airport Authority, Department of Public
Safety, a political subdivision of the State of Montana.
Section 2

That, pursuant to Section 7-1-4127, M.C.A., the Clerk of the Commission shall cause notice to
be published in the Bozeman Daily Chronicle at least once a week for three (3) successive weeks, which notice shall be to the effect that such Resolution has been duly and legally passed and further expressing the City’s intent to dispose of the item listed in Section 1, in the manner described herein.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 5th day of August, 2013.

PUBLIC NOTICE The City of Bozeman, having passed Commission Resolution No. 4455, and pursuant to the
provisions of Section 7-8-101(2), Montana Code Annotated, hereby serves notice of its intent to dispose of
a use of force simulator previously used in the City of Bozeman to the Gallatin Field Authority,
Department of Public Safety, a political subdivision of the State of Montana.
