A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING
IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE SPECIAL IMPROVEMENT
LIGHTING DISTRICT NO. 572 FOR THE PURPOSE OF OPERATING AND MAINTAINING A
LIGHTING DISTRICT TO LIGHT THE NORTH-SOUTH ALLEY IN BLOCK 4 OF THE BRUNTON-
PALFFY REARRANGEMENT OF A PORTION OF DURSTON SUBDIVISION, AND BLOCK 12 OF THE
SPRINGBROOK ADDITION, SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY
THE MONTANA POWER COMPANY UNDER AUTHORITY OF AND IN CONFORMANCE WITH SECTION
I 11-2245 to 11-2257 INCLUSIVE OF THE REVISED CODES OF MONTANA, 1947.
WHEREAS, there has been filed with the Clerk of the Commission of the City of Bozeman, Montana,
a petition in due form of certain property owners of Block Four of the Brunton-Palffy Rearrangement
of a portion of Durston Subdivision and Block 12, Springbrook Addition asking that a Special Improve-
ment Lighting District be created for the purpose of operating and maintaining a lighting system to
light the north-south alley in said Blocks 4 and 12 in the City of Bozeman, Gallatin County, Montana;
WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held on the 4th
day of October, 1976, the aforesaid petition was respectively considered and granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
Declaration of Intention
It is hereby declared to be the intention of the City of Bozeman to create a Special Improvement
District to be known and designated as Special Improvement District No. 572 of the City of Bozeman
for the purpose of operating and maintaining a lighting system to light the north-south alley between
North Tenth Avenue and North Eleventh Avenue from West Villard Street to Lamme Street.
Section 2
Boundaries
The boundaries of said Special Improvement Lighting District No. 572 are described as follows:
Beginning at the Northwest corner of Block 4 of the Brunton-Palffy Rearrangement
of a portion of the Durston Subdivision to Bozeman, Montana, said point being
the intersection of the east line of North 11th Avenue and the south line of
Villard Street, thence easterly 258.93 feet to the northeast corner of said
I Block 4, thence southerly along the west line of North 10th Avenue,
to the
southeast corner of Block 12 of the Springbrook Addition to the City of Bozeman,
Montana, thence westerly along the south line of said Block 12 a distance of
212.00 feet, thence northerly along the east line of North 11th Avenue to the
point of beginning.
Contained within the above described exterior boundaries are the following
Lots, Blocks, and Tracts of land, to wit:
Lots 1-8, Block 4, Brunton-Palffy
Rearrangement of a portion of the Durston Subdivision and Lots 1-16, Block 12
of the Springbrook Addition to Bozeman, Montana.
Section 3
Character of Improvements

That character of improvements to be installed and paid for by the Montana Power Company is the
erection and installation for four (4) 100 Watt (3,500
Lumens) Type III Mercury Vapor Luminaries to
be mounted on existing distribution poles in the alley. All lights are to be served by overhead
conductors. The system shall be equipped with all necessary appliances for sale and proper opera-
tion of the system.
Section 4
Estimated Cost of
Maintenance and
Electrical Current
An estimate of the cost of maintaining such lighting system is $1.94 per unit per month or the
total of $93.12 per year which will be charged to the property owners on an area basis.
Section 5
Method of Assessment
The cost of maintaining such improvement is to be assessed against the entire district; each lot
I or parcel of land within such district will be assessed for that part of the whole cost which its
area bears to the total area within the district. The total area within the district is 110,338.88
square feet and is the area on which all protests will be received, considered, and determined,
and on which all assessments will be calculated.
Section 6
Protests and Notices
The regular session of the City Commission of the City of Bozeman, to be held at the Commission
Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 24th day
of November 1976, at the
hour of 1:15 o'clock p.m. of said day is the time and place when and where the City Commission will
hear and pass upon all protests duly and regularly made and filed against the creation of said

proposed Special Improvement District No. 572, the improvements proposed to be made pursuant thereto,
and the extent and character thereof, or either thereof; and the Clerk of the City Commission be,
and she is hereby directed to give notice in the manner and for the time as by law required, of the
adoption of this resolution of intention.
ADOPTED by the City Commission of the City of Bozeman, at a regular and stated session of
said City Commission, held on the 27th day of OctO?~r.~ 1976.

OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN
AND DESIGNATED AS "SPECIAL IMPROVEMENT DISTRICT NO. 572".
NOTICE IS HEREBY GIVEN that on the 27th day of October 1976, at a regular session of the City
Commission of the City of Bozeman, Commission Resolution No. 1833, entitled:

That Wednesday, the 24th day of November, 1976, at 1:15 o'clock p.m., at the Commission Room
of the City Hall, Bozeman, Montana, is designated by Commission Resolution No. 1833 as the time when
and where the City Commission of the City of Bozeman will hear and pass upon all protests that may
be made against the making of such improvements, or the creation of said district. Protests must
be made in writing and delivered to the Clerk of the City Commission within 15 days after date of
the first publication of this notice.
The general character of improvements is the operation and maintenance of a lighting district
to light the North-South Alley in Block 4 of the Brunton-Palffy Rearrangement of a portion of Durston
Subdivision and Block 12 of the Springbrook Addition.
The estimated cost of maintaining such lighting system is $1.94 per unit per month or the

For a description of the boundaries of said Special Improvement District No. 572 reference is
hereby made to Commission Resolution No. 1833 of the City Commission of the City of Bozeman,
declaring the intention to create said district, which is on file in the office of the undersigned
Clerk of the said City Commission in the City Hall of said City of Bozeman, Montana, and open for
inspection to all interested parties and the public generally.
This notice is given pursuant to the provisions of Section 11-2204, Revised Codes of Montana,
1947.
