HomeMy WebLinkAboutResolution 1832 Disposition of Property Through Community Development Block Grant -......... ---..- 160 COMMISSION RESOLUTION NO. 1832 A RESOLUTION PROVIDING FOR THE DISPOSITION OF A PARCEL OF REAL PROPERTY OWNED BY THE CITY OF BOZEMAN, LOCATED WITHIN THE CITY LIMITS OF BOZEMAN, MONTANA, AND ACQUIRED THROUGH THE PROCEDURES SET FORTH IN REGULATIONS COVERING COMMUNITY DEVELOPMENT BLOCK GRANTS ADMINISTERED BY THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT AND MORE SPECIFICALLY THOSE REGULATIONS FOUND UNDER TITLE 24, CHAPTER V, PART 570. WHEREAS, The City of Bozeman, Montana, has been a successful candidate for a Community Development Block Grant for acquisition and preparation of a site for rent subsidized housing; and I WHEREAS, The City of Bozeman wishes to fulfill its obligations to the United States Department of Housing and Urban Development as regards the city of Bozeman's programs as outlined in the Community Development Block Grant application and particularly those portions of the application titled: The Community Development Plan and the Housing Assistance Plan; and WHEREAS, The Community Development Block Grant program calls for grantee initiative to achieve application goals; and WHEREAS, The regulations applicable to Community Development Block Grants provide under Title 24 (Housing and Urban Development), Chapter V, Part 570, Subpart C (Eligible Activities) 1/570.200 (a)(7), to whit: "Disposition, through sale, lease, donation or otherwise of any real property acquired pursuant to this PART or its retention for public purposes, provided that the proceeds from any disposition shall be expended only for activities in accordance with this PART."; and WHEREAS, The parcel of property which is the subject of this resolution was acquired pursuant to such PART; NOW THEREFORE BE IT RESOLVED, That the Commission of the City of Bozeman, Montana, will make the site acquired under the Community Development Block Grant available through the Department of Housing and Urban Development, Helena Insuring Office, 616 Helena Avenue, Helena, Montana, for a cash price of SIXTY-SEVEN THOUSAND FIVE HUNDRED DOLLARS ($67,500). BE IT FURTHER RESOLVED, That the Commission of the City of Bozeman, Montana, places certain considerations upon the property, and that the purchaser of the property must comply with these directives from the City Commission, to whit: That the developer/owner of the property, at the I time new rent assisted units are completed, first offer the new units to those who qualify and are now living in the present substandard American Legion housing on North Tracy Avenue, Bozeman, and further, that the developer present his plans for the project to the city of Bozeman under the city of Bozeman's Planned Unit Development ordinance.
