MINUTES OF THE MEETING OF THE CITY COMMISSION BOZEMAN, MONTANA June 10,2013 The Commission met in the City Commission Room, City Hall at 121 North Rouse on Monday, June 10, 2013. Present were Mayor Sean Becker, Deputy Mayor Krauss, Commissioner Carson Taylor, Commissioner Chris Mehl, Commissioner Cyndy Andrus, City Manager Chris Kukulski, City Attorney Greg Sullivan, and City Clerk Stacy Ulmen. *These minutes are not word for word and should be considered along with the audio recording. 0:03:25 A. Call to Order—5:30 p.m. — Commission Room, City Hall, 121 North Rouse Mayor Becker called the meeting to order. 0:03:33 B. Pledge of Allegiance and a Moment of Silence 0:04:07 C. Changes to the Agenda Mayor Becker asked City Manager Chris Kukulski if there were any changes to the agenda. Mr. Kukulski stated no. 0:04:10 D. Minutes—May 6, 2013 0:04:13 Motion and Vote to approve the minutes of May 6, 2013. It was moved by Cr. Mehl, seconded-ky Cr. Andrus to approve the minutes of May 6, 2013. Those voting Aye being Crs. Work Session— General Fund and Planning Fund Budget Presentations (Rosenberry) 0:04:38 Anna Rosenberry, Director of Administrative Services Ms, Rosenberry gave the staff presentation regarding the General Fund and Planning Fund Budget. She spoke regarding revenue and expenditure balances, significant issues in staffing levels, operational efficiency improvements, growth in public safety, the number of FTEs requested in the budget, the personnel costs in the budget, labor groups and levy amounts, 0:24:30 Commission questions for Staff The Commission and Staff discussed the staff cuts due to the recession, the building department budget and landfill operation changes. 0:30:50 Continued staff presentation Ms. Rosenberry continued the presentation by highlighting capital improvements, the tax levy, taxable values, the entitlement share,the planning fund and special requests. 0:43:00 Commission questions for Staff The Commission and Staff discussed the timing of the budget adoption, the population figures, employee counts, public safety efficiencies, battalion chiefs and their purpose, best practices across the state, service delivery, projections of growth rates, response times, the amount of calls of service, the retail traffic impact, tourism, the concern of being too stretched, the lack of continuity, the ISO rating, the library FTE and their purpose of focusing on computer education in the Library, target audiences and demand in the Library, construction activity, increment districts, standard deviations, the Administration Department staff request, the code compliance officer, the Parks and Trails Bond work, mower replacements, staffing of a splash park and the strategy for economic development. 1.59.30 Public Comment Mayor Becker opened public comment. 1:59.42 Jerry Pape. Authorize City Manager to sign a Notice of Award to Big Sky Asphalt in the amount of $374,464.40 for 2013 Street Improvements (Kerr) 3. Authorize City Manager to sign a Notice of Award to Layne Inliner, LLC in the amount of $1,529,435 for the 2013 Sewer Rehabilitation Project (Murray) 2:03:53 Motion to approve Consent Items F. 1-3 as submitted. It was moved by Cr. Andrus, seconded by Cr. Taylor to approve Consent Items F. 1-3 as submitted. 2:04:00 Public Comment Mayor Becker opened public comment on the Consent Agenda. No person commented. Public Comment Mayor Becker opened public comment. 2:04-46 Shelia Thomas, Public Comment Ms. Thomas stated that she is with the Gallatin County Spay and Neuter Task force and thanked the Commission for their support. Mayoral Proclamation—In Appreciation and Memory of Jeanne Eggert Mayor Becker read a Mayoral Proclamation in Appreciation and Memory of Jeanne Eggert. He then presented the family with the proclamation and in.turn family and friends spoke regarding Ms. Eggert's service. It was moved by Cr. Page 5 of 8 Minutes of the Bozeman City Commission,June 10,20.1.3 3:17:21 Commission Questions for Applicant The Commission and Applicant discussed the revised condition relating to infrastructure, the look of the development, parking, timing,the site plan process, the demolition permit, and the timing of impact fees. 3:42:16 Public comment Mayor Becker opened public comment. 3:42:29 Brian Caldwell,Public Comment Mr. Caldwell spoke regarding the downtown core, the existing homes located in the project area and the timing of demolition. 3:45:19 Brian Eckenrod, Public Comment Mr. Eckenrod of 402 North Tracey spoke regarding the existing houses for sale in the area of this development and the impact on the new housing proposed. He also spoke regarding parking and maintenance of Tracey. 3:48:41 Public comment closed Mayor Becker closed public comment. 3:48:52 Commission Questions for Applicant The Commission and the Applicant spoke regarding Condition 1, and phasing. 3:52:38 Motion'that having reviewed application materials, considered public comment, and all information presented, I hereby adopt the findings presented in the staff report for application Z-13072 and move to approve the site plan with certificate of appropriateness with conditions with condition I modified, and subject to all applicable code provisions. It was moved by Deputy Mayor Krauss, seconded by Cr. Mehl that having reviewed application materials, considered public comment, and all information presented, I herebv adopt the findings presented in the staff report for application Z-13072 and move to approve the site plan with certificate of appropaiateness with conditions with condition I modified, and subject to all al2j2licable code provisions. Condition I modification: 1. Prior to the issuance of'a demolition permit for any of the three existing residences on the eastern portion of the block the applicant will have first obtained final infrastructure approval from the City of Bozeman for the subdivision reviewed and approved under File 9-P-13010. Page 6 of 8 Minutes of the Bozeman City Commission,June 10,2023 3:53:42 Commission Discussion on the Motion The Commission spoke regarding successes and failures, improvements, street capacity, the neighborhood, the zoning of the area and Condition 11 relating to street improvements, the type of development this project is, impact on existing areas around the project and the intensive use of the area. 4:22:15 Vote that having reviewed application materials, considered public comment, and all information presented, I hereby adopt the findings presented in the staff report for application Z-13072 and move to approve the site plan with certificate of appropriateness with conditions with condition I modified, and subject to all applicable code provisions. Those voting Aye being Deputy Mayor Krauss, Crs. Mehl,Andrus, Taylor and Mayor Becker. Those voting No being none. The motion passed 5-0. 4:22:313. (Re)Appointments to the Parking Commission (Brunckhorst) 4:22:47 Motion and Vote to approve the Mayoral appointments of Dennis Bechtold, Benjamin Bennett and Ryan Olson to the Parking Commission. It was moved by Cr. Mehl, seconded by Cr. Andrusto approve the Mayoral appointments of Dennis Bechtold,Benjamin Bennett and Ryan Olson to the Parking Commission. Those voting Aye being Crs. Mehl, Andrus, Taylor, Deputy Mayor Krauss and Mayor Becker. Those voting no being none. The motion passed 5-0. 4:23:301 FYI/Discussion 4:23:31 1. The next two City Commission meetings will start at 5:30 p.m. 4-23:42 2. Parks and Trails committee has met and are working on criteria for applicants and bonds 4:24.03 3. CUP Distillery on Main Street/downtown appropriate area Mayor Becker would like City Attorney to look at the subordinate use language and to come back to Commission with more appropriate language to allow for production of goods downtown.
