The undersigned property owner of the Lot, on behalf of itself and its successors in interest, does hereby declare and provide notice that the provision of water rights for the Lot required pursuant to the JCD Annexation Agreement recorded May 02, 2006, as document number 2226694 and the conditions of approval for the Southbridge Subdivision Phase 1, dated April 25, 2011 , have been provided for the Lot in the form of a cash-in-lieu of water rights payment in an amount sufficient only for the development of four (4) units on the Lot. Such payment was made at the time of approval of the final plat of Southbridge Subdivision Phase IA. The property owner, on behalf of itself and its successors in interest, therefore acknowledges and agrees that the City of Bozeman may restrict development on the Lot in excess o C four (4) units until such time as additional water rights or an additional payment-in-lieu of water rights are provided to the City in an amount required for each additional unit above four units, pursuant to the requirements of Section 38.23.180, Bozeman Municipal Code, as amended. The property owner, on behalf of itself and its successors in interest, further acknowledges and agrees water rights or a payment-in-lieu shall be made to the City pursuant to the requirements of the Bozeman Municipal Code prior to any land use approval by the City including approval of a building pen-nit. The City may, in its sole discretion, determine whether to accept water rights or require a cash- in-lieu payment. Such determinations shall be based upon the provisions of the Bozeman Municipal Code and any adopted administrative procedures in place at the time of any building pen-nit, development review, site plan review or subdivision review, whichever occurs first. Lot I Block 3 Southbridge Subdivision Phase IA Page 1 oft Fee in Lieu of Water Right Agreement The property owner, on behalf of itself and its successors in interests, agrees this restriction shall run with the land and bind all future owners of Lot 1, Block, 5 of the Southbridge Subdivision Phase IA. The owner shall record this notice in the office of the Gallatin County Clerk and Recorder and provide a copy of this notice and restriction to each purchaser of the Lot and to the City with any application for a site specific development.
