HomeMy WebLinkAboutResolution 1861 Vacate Remaining Portion of Street Between Blocks 41 & 46, Northern Pacific Addition 221 COMMISSION RESOLUTION NO. 1861 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE THE REMAINING PORTION OF STREET BETWEEN BLOCKS 41 & 46, NOR- THERN PACIFIC ADDITION TO THE CITY OF BOZEMAN, MONTANA. WHEREAS, there has been filed with the Clerk of the City Commission of the City I of Bozeman a petition by the owners of properties abutting on said portion of Mulberry (Davis) Street of the Northern Pacific Addition to the city of Bozeman, Montana, re- questing that said street be vacated; and, WHEREAS, it appears to the City Commission to be in the best interest of the City of Bozeman and the inhabitants therein that said street be vacated. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That remaining portion of Mulberry (Davis) Street between Block 41 and 46 of the Northern Pacific Addition to the City of Boze- man lying between Broadway Avenue and that portion of Mulberry Street vacated by Ordinance 148 on February 18, 1897, a parcel of land approximately sixty (60) feet by one hundred (100) feet. Section 2 Notice That the City Manager of the City of Bozeman is hereby directed to cause notice of the adoption of this resolution of intention to be served in the same manner that service of summons is required on all persons whose property abuts upon that portion I of Mulberry (Davis) Street remaining between Blocks 41 & 46 of the Northern Pacific Addition to the city of Bozeman, Montana, which will be affected by the proposed vacation and by pUblication once in a daily newspaper in general circulation of the city of Bozeman, Montana. Section 3 Time for Objections That the regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber in~the City Hall Building, Bozeman, Montana, on Wed- nesday, the 23rd day of March, 1977, at the hour of 1:15 o'clock p.m. of said day, is the time and place when and where the City Commission will hear and pass upon all objections to the vacating of said street. Notice is hereby given that on the 16th day of February, 1977, at a regular session of the City Commission of the City of Bozeman, Commission Resolution No. 1861 entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE THE REMAINING PORTION OF STREET BETWEEN BLOCKS 41 & 46, NOR- I THERN PACIFIC ADDITION TO THE CITY OF BOZEMAN, MONTANA. was passed and adopted. That Wednesday, the 23rd day of March, 1977, at 1:15 o'clock p.m. at the Commis- sion Room of the City Hall, Bozeman, Montana, is designated by Commission Resolution No. 1861 as the time when and where the City Commission of the City of Bozeman will hear and pass upon all protests that may be made against the vacation of said street. Protests must be made in writing and delivered to the Clerk of the City Commission within 15 days after the date of the first publication of this notice.
