HomeMy WebLinkAboutResolution 1859 Special Improvement District 577 21~J COMMISSION RESOLUTION NO. 1859 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE- MENT DISTRICT NO. 577 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLATION OF AN ASPHALTIC-CONCRETE TYPE PAVING, INTEGRAL CONCRETE CRUB AND GUTTERS, NECESSARY APPURTENANCES THERETO, ALSO CONSTRUCTION AND INSTALLATION OF I NECESSARY STORM DRAINAGE PIPE AND DITCHES, STORM DRAINAGE INLETS, MANHOLES, DIVERSION STRUCTURES OR OTHER APPURTENANCES TO STORM DRAINAGE AS NEEDED ON A PORTION OF BEALL STREET FOR A DISTANCE OF 117 FEET EACH SIDE OF NORTH 22ND AVENUE, ALSO NORTH 22ND AVENUE BETWEEN BEALL STREET AND DURSTON ROAD. WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, a petition in due form of certain owners of properties situated on North 22nd Avenue and a portion of Beall Street as shown in the above caption asking that a Special Improvement District be created for the purpose of constructing and installing an asphaltic-concrete pavement project to include integral concrete curb and gutters, storm drainage, relocation of irrigation facilities and to include other work incidental thereto, and WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held on the 22nd day of September, 1976, the aforesaid petition was respectively considered and granted: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention I That it is hereby declared to be the intention of the City<)of Bozeman to create a Special Improvement District to be known and designated as Special Improve- ment District No. 577 for the purpose of constructing and installing pavement on North 22nd Avenue between Beall Street and Durston Road and on a portion of Beall Street being approximately 117 feet each side of North 22nd Avenue. Said pavement project to include construction of an asphaltic-concrete type pavement, integral concrete curb and gutters, storm drainage facilities, relocation of an irrigation ditch and appurtenances thereto and other work incidental thereto. Section 2 Boundaries The boundaries of said Special Improvement District No. 577 are described as follows: A tract of land lying in the East one-half of the Northeast one-quarter of Section 11, Township 2 South, Range 5 East, Montana Principal Meri- dian, City of Bozeman, Gallatin County, Montana, further described as follows: Beginning at a point which bears South 88009'23" West a dis- tance of 750.61 feet from the northeast corner of said Section 11; .!" thence South 0051'38>1 West a distance of 1,262.02 feet along the center- line of Block 3 to a point on the north line of Beall Street; thence South 89016'07" West a distance of 294.02 feet along the north line of I West Beall Street; thence South 89016'07" West a distance of 294.02 feet along the north line of West Beall Street; thence North 0048'06" East a distance of 1,256.70 feet to a point on the north line of said Section 11; thence North 88009'23" East a distance of 294.22 feet to the point of beginning. Containing within the above described exterior boundaries the following tracts, parcels, lots and blocks of land: All of Lots 16-31 inclusive of Block 3. All of Lots 1-16 inclusive of Block 4, all in West Park Manor, Second Addition, a subdivision of the City of Bozeman, Montana. Section 3 Character of Improvements Construction of a pavement project with integral concrete curb and gutter, storm drainage facilities, and necessary appurtenances to said construction on a --. ~ COMMISSION RESOLUTION NO. 1859 ... __ . - no __........__.__....___ -.---..---...- ijltJ. portion of Beall Street approximately 117 feet each side of North 22nd Avenue and on North 22nd Avenue between Beall Street and Durston Road in West Park Manor, Second Addition to Bozeman, Montana, said pavement project to include excavation, installation of gravel sub-base and asphaltic-concrete base and surfac~ course, - storm drainage facilities, and other necessary appurtenant work to complete a paving I project. Section 4 Estimate of Cost The preliminary estimate of cost is $110,000 including all street excavation, all materials, labor, installation costs, engineering and incidentals. Section 5 Method of Assessment The cost of such improvement is to be assessed against the entire district, each lot or parcel of land within such district will be assessed for that part of the whole cost, which its area bears to the area of the entire district, exclusive of streets, avenues, alleys and public places, and further each square foot of land within the district lying within 25 feet of the line of the street on which the improvements herein provided for are made, shall bear double the amount of the costs of such improvements per square foot of such land that each square foot of any other land within the district shall bear. The total actual assessable area within the entire district is 355,154.82 square feet, and is the area on which all protests will be received, considered I and determined. It is also the figure on which all assessments will be figured. Section 6 Payments That the payments for said improvements shall be made in twenty (20 ) annual installments extending over a period of nineteen (19 ) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 577, as authorized by law. Such bonds will be in denominations of $100 each, and fractions or multi- ples of $100 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 577 Fund of the City of Bozeman. The bonds will be redeemable at the option of the city, singly or in multiples, and in the order of their registration, whenever funds are available for that purpose in said Special Improvement District No. 577. Said bonds will I draw a simple interest from the date of their registration until called for pay- ment, which interest shall be chargeable as a part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title 11 of the Revised Codes of Montana, 1947, relating to special improvement districts in cities and towns, and any amendments thereof or thereto. n. __" ..___ ._._."..._." Section 7 Protests and Notice That the regular session of the City Commission of the City of Bozeman to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, I the 2nd day of March 1977, at the hour of 1:15 p.m. of said day, is the time and place, when and where the City commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improve- ment District No. 577, the improvements proposed to be made pursuant thereto and the extent and character thereof, or either thereof, and the Clerk of the City Com- mission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this resolution of intention. Notice is hereby given that on the 2nd day of February, 1977, at a regular session of the City Commission of the City of Bozeman, Commission Resolution No. 1859, entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS S.I.D. That Wednesday, the 2nd day of March, 1977, at 1:15 o'clock p.m. at the Commis- I sion Room of the City Hall, Bozeman, Montana, is designated by Commission Resolution No. 1859 as the time when and where the City Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such~prove- ments, or the creation of said district. Protests must be made in writing and delivered to the Clerk of the City Commission within 15 days after the date of the first publication of this notice. The general character of improvements is the construction and installation of asphaltic-concrete type paving and necessary appurtenances thereto. For a description of the boundaries of said Special Improvement District No. 577 reference is hereby made to Commission Resolution No. 1859 of the City Commission of the City of Bozeman, declaring the intention to create said district, which is on I file in the office of the undersigned Clerk of the said City Commission in the City Hall of said City of Bozeman, Montana, and open for inspection to all interested parties and the public generally.
