A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
DECLARING IT TO BE THE INTENTIDN OF THE CITY OF BOZEMAN TO CREATE A,;

FROM A POINT APPROXIMATELY 117 FEET WESTERLY OF THE WEST LINE OF NORTH
TWENTY-FIRST AVENUE TO A POINT APPROXIMATELY 117 FEET WESTERLY OF THE
WEST LINE OF NORTH TWENTY-SECOND AVENUE: AN EIGHT (8) INCH
SANITARY
SEWER LATERAL MAIN AND THE NECESSARY APPURTENANCES ON THE ENTIRE
LENGTH OF NORTH TWENTY-SECOND AVENUE BETWEEN BEALL STREET AND DURSTON
ROAD TO SERVE LOTS 16 THROUGH 31 OF BLOCK 3 AND LOTS 1 THROUGH 16 OF
BLOCK 4 OF WEST PARK MANOR, SECOND ADDITION TO THE CITY OF BOZEMAN,
MONTANA.
THE CONSTRUCTION AND INSTALLATION OF THE WATERMAIN TO INCLUDE ALL
TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIAL, CAST IRON WATERMAIN,
VALVES, FITTING, HYDRANTS, SERVICE LINE STUBS, AND OTHER NECESSARY
APPURTENANCES. THE CONSTRUCTION AND INSTALLATION OF THE SANITARY
SEWER MAINS SHALL INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING
MATERIAL, INSTALLATION OF SEWER MAIN, NECESSARY WYES, SERVICE LINE
STUBS, MANHOLES, AND OTHER NECESSARY APPURTENANCES THERETO.
WHEREAS, there has been filed with the Clerk of the City Commission of the City
of Bozeman, Montana, a petition in due form of certain owners of properties situated
within the boundaries of Special Improvement District No. 576 as hereinafter more
specifically described, asking that a special improvement district be created for
the purpose of constructing and installing watermains and sanitary sewer lateral
mains to provide water and sanitary sewers to lots within the district.
I WHEREAS, that at a regular meeting of the City Commission of the City of Bozeman
held on the 22nd day of September 1976, the aforesaid petition was respectively
considered and granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
Declaration of Intention
That it is hereby declared to be the intention of the City of Bozeman to create
a special improvement district to be known and designated as Special Improvement
District No. 576 of the City of Bozeman for the purpose of constructing and installing
watermains and sanitary sewer lateral mains, said project to include all appurtenant
work for the construction and installation of watermains and sanitary sewer system
to provide water and sanitary sewers for all lots within the district.
Section 2
Boundaries
The boundaries of said Special Improvement District No. 576 are described as
follows:
I A tract of land lying in the East one-half of the Northeast one-quarter
of Section 11, Township 2 South, Range 5 East, Montana principal Meri-
dian, City of Bozeman, Gallatin County, Montana, further described as
follows:
Beginning at a point which bears South 88009'23" West a distance of
750.61 feet from the northeast corner of said Section 11; thence South
0051'38" West a distance of 1,262.02 feet along the centerline of Block 3
to a point on the north line of Beall Street; thence South 89016'07"
West a distance of 294.02 feet along the north line of West Beall Street;
thence South 89016'07" West a distance of 294.02 feet along the north
line of West Beall Street; thence North 0048'06" East a distance of

1,256.70 feet to a point on the north line of said Section 11; thence
North 88009'23" Eastadistance of 294.22 feet to the point of beginning.
Containing within the above described exterior boundaries the following
tracts, parcels, lots and blocks of land: All of Lots 16-31 inclusive
of Block 3. All of Lots 1-16 inclusive of Block 4, all in West Park
Manor, Second Addition, a subdivision of the City of Bozeman, Montana.
Section
3 I
Character of Improvements
The character of the improvements to be made is the installation and construction
of a six inch watermain, ten inch watermain and an eight inch sanitary sewer including
trench excavation and backfill, bedding material, cast iron watermains, valves,
hydrants and fittings, copper service lines and fittings, sanitary main, manholes,
clean outs, service lines and other necessary appurtenances thereto.

Estimate of Cost
The total estimated cost of the improvements within the district including
engineering, legal and con~ingency is $88,000.

Method of Assessment
The cost of such improvement is to be assessed against the entire district,
each lot, block, tract or parcel of land within the district will be assessed for
that portion of the whole cost which its area bears to the area of the entire dis-
trict exclusive of streets, avenues, alleys, and public places.

The total actual assessable area within the entire district is 287,761.57
square feet and is the area on which all protests will be received, considered and
determined.

Payments
The payments for said improvements shall be made in twenty (20 )
annual install-
ments extending over a period of nineteen (19) years, but this shall not be con-
strued to prevent payment in full at any regular payment date by any property owner
who desires to do so. It is proposed to pay the entire cost and expense of the
construction and installation of said improvements with cash to be obtained from
the sale of bonds of said Special Improvement District No. 576 as authorized by
law. Such bonds will be in denominations of $100.00 each, and fractions or multi-
ples of $100.00 where necessary, to be issued and chargeable against a fund to be
known and designated as Special Improvement District No. 576 Fund of the City of
Bozeman. The bonds will be redeemable at the option of the City, singly or in
mUltiples, and in the order of their registration, whenever funds are available I
for the purpose in said Special Improvement District No. 576. Said bonds shall
draw simple interest from the date of their registration until called for payment,
which interest shall be chargeable as part of the cost of construction and installa-
tion of said improvements. The bonds will be issued and sold in accordance with
the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana,
1947, and all other applicable provisions of Title 11 of the Revised Codes of

Montana, 1947, relating to special improvement districts in cities and towns, and
any amendments thereof or thereto.
Section 7
Protests and Notice
I That the regular session of the City Commission of the City of Bozeman, to be
held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday,
the 2nd day of March, 1977, at the hour of 1:15 o'clock p.m. of said day, is the
time and place, when and where the City Commission will hear and pass upon all
protests duly and regularly made and filed against the creation of said proposed
Special Improvement District No. 576, the improvements proposed to be made pursuant
thereto and the extent and character thereof, or either thereof; and the Clerk of
the City Commission be, and she is hereby directed to give notice in the manner
and for the time as by law required, of the adoption of this Resolution of Intention.
ADOPTED by the Commission of the City of Bozeman, Montana, at a regular and
stated session of said Commission 2nd day of February 1977.

was passed and adopted.
I That Wednesday, the 2nd day of March, 1977, at 1:15 o'clock p.m. at the Commis-
sion Room of the City Hall, Bozeman, Montana, is designated by Commission Resolution
No. 1858 as the time when and where the City Commission of the City of Bozeman will
hear and pass upon all protests that may be made against the making of such improve-
ments, or the creation of said district. Protests must be made in writing and
delivered to the Clerk of the City Commission within 15 days after the date of the
first pUblication of this notice.

The general character of improvements is the construction and installation
of a watermain and sanitary sewer main and appurtenances necessary thereto.
The estimated cost of said improvements within the districts, including
engineering, legal, administration, and contingency is $88,000.00.
For a description of the boundaries of said Special Improvement District No. I
576 reference is hereby made to Commission Resolution No. 1858 of the City Commission
of the City of Bozeman, declaring the intention to create said district, which is
on file in the office of the undersigned Clerk of the said City Commission in the
City Hall of said City of Bozeman, Montana, and open for inspection to all
interested parties and the public generally.
This notice is given pursuant to the provisions of Section 11-2204, Revised
Codes of Montana, 1947.
