HomeMy WebLinkAboutResolution 1874 Environmental/Economic Impact Statements Prior to Issuance of Building Permits . --.... 2'5B COMMISSION RESOLUTION NO. 1874 A RESOLUTION DECLARING THE CONCERN OF THE BOZEMAN CITY COMMISSION WITH THE ENVIRONMENTAL IMPACT OF MAJOR RESIDENTIAL, COMMERCIAL, AND INDUSTRIAL DEVELOPMENTS UPON THE COMMUNITY, AND ITS INTENT TO REQUIRE ENVIRONMENTAL/ ECONOMIC IMPACT STATEMENTS PRIOR TO ISSUANCE OF BUILDING PERMITS FOR SUCH DEVELOPMENTS. I WHEREAS, the City of Bozeman is a growing community, faced with problems which accompany growth in all areas: residential, commercial, and industrial; and _ WHEREAS, such growth invariably has an impact on the community and its - facilities, namely water services, sewage treatment requirements, storm drainage, pOlice, fire, recreation, public works, and all other municipal service departments; and WHEREAS, as the demands for such services increase, the costs are sometimes disproportionate to the benefits realized by the community; and WHEREAS, certain populations can support only prescribed limits of residential, commercial, and industrial development, to the extent they are able to supply the personnel, manpower, resources, and customers to support such developments; and WHEREAS, although it might be expected that anyone contemplating a substantial business investment, would safeguard that investment by conducting exhaustive research into the extent of the market to be served by such development, the likeli- hood of a satisfactory return on the investment, and a reasonable assurance that the pUblic necessity and public convenience were being served; and I WHEREAS, however, in the absence of assurance that such individual effort has been expended -- at least to the extent of pUblic knowledge -- then it behooves _ the community to require assurance that such developments will be in the public interest, and will not become economic liabilities or disasters; NOW, THEREFORE, BE IT RESOLVED that, in order to ensure that proposed resi- dential, commercial, and industrial developments will not be of an adverse environmental nature to the community, nor that such developments will adversely affect an existing sector, economic interest, or the general public welfare of the community at large, an environmental/economic impact statement will be required prior to the issuance of a building permit for any proposed major development of either a residential, commercial, or industrial nature; and BE IT FURTHER RESOLVED that the City staff and City Attorney are herewith instructed to draft an ordinance to this effect at the earliest opportunity, and that such ordinance contain the exact specifications and criteria which must be answered in such an environmental/economic impact statement, so that any proposed developer will know exactly the nature of information required and which will be I evaluated by the City Commission in its deliberations, prior to issuing a building permit for such a proposed development. -- PASSED AND ADOPTED by the City Commission of the City of Bozeman at a regular session thereof held on the 27th day of April, 1977.
