COMMISSION RESOLUTION NO. 1871
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO
CREATE A SPECIAL IMPROVEMENT DISTRICT NO. 579 FOR THE PURPOSE OF CON-
STRUCTION AND INSTALLATION OF AN ASPHALTIC CONCRETE TYPE PAVEMENT,
INTEGRAL CONCRETE CURB AND GUTTER, AND NECESSARY APPURTENANCES THERETO;
ALSO CONSTRUCTION AND INSTALLATION OF NECESSARY STORM DRAINAGE PIPE,
INLETS, MANHOLES, DITCHES, AND APPURTENANCES NECESSARY TO STORM DRAINAGE I
OF PORTIONS OF HAYES STREET SHOWN ON THE SUBDIVISION PLAT OF TRACT 12,
BOZEMAN CREEK ANNEXATION, TO THE CITY OF BOZEMAN, MONTANA.
WHEREAS, there has been filed with the Clerk of the City Commission of the City
of Bozeman a petition in due form of certain owners of property situated within the
boundaries of Special Improvement District No. 579 as hereinafter more specifically
described, asking that a special improvement district be created for the purpose
of constructing and installing an asphaltic concrete type pavement, together with
integral concrete curb and gutter, and necessary appurtenances thereto, and necessary
storm drainage facilities appurtenant to such pavement to serve the lots within the
district; and,
WHEREAS, that at a regular meeting of the City Commission of the City of Bozeman,
held on the 20th day of October 1976, the aforesaid petition wa$ respectively consi-

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF-THE CITY OF BOZEMAN:
Section 1
Declaration of Intention
It is hereby declared to be the intention of the City Commission of the City of I
Bozeman to create a special improvement district to be known and designated as Special
Improvement District No. 579 of the City of Bozeman for the purpose of constructing
and installing an asphaltic concrete type pavement on portions of Hayes Street, said
project to include construction and installation of integral concrete curb and gutter
and necessary appurtenances thereto, together with necessary storm drainage facilities
appurtenant to such paving.
Section 2

Boundaries
The boundaries of Special Improvement District No. 579 are described as follows:
A parcel of land containing 1.18 acres located in the northwest quarter
of Section 18, Township Two South, Range Six East, principal Meridian of
Montana, in Gallatin County, Montana, and being more particularly described
as follows:
Beginning at the northeast corner of Lot 10, Block 14, Butte Addition to
the City of Bozeman, thence North 89056'00" East a distance of 245.4 feet
to the east line of Tract 12, Bozeman Creek Annexation, thence South
30016100" West a distance of 486.5 feet to the southern tip of said
Tract 12, thence North 00002'46" West a distance of 419.73 feet to the
point of beginning.
Included in these exterior boundaries are the following tracts, to wit:

Section 3
~haracter of Improvements
The character of improvements is the construction and installation of a pavement
project with integral concrete curb and gutter, together with storm drainage and
necessary appurtenances to said construction on portions of Hayes Street as shown on
the Butte Addition and Bozeman Creek Annexation to the City of Bozeman, said project

to include construction of gravel subbase, an asphaltic concrete type base and
surface course, all necessary excavation and backfill, and other appurtenant work
thereto.
Section 4

Estimate-df- Cost
The estimated cost of the improvements within the district, including engineering
legal, administration, and contingency is $11,500.
Section 5
Method of Assessment
The cost of the improvements is to be assessed against the entire district; each
lot, block, tract, or parcel of land within the district will be assessed for that
portion of the whole cost which its area bears to the area of the entire district,
exclusive of streets, avenues, alleys, and public places.
The total actual assessable
area within the entire district is 51,503.06 square feet, which is the area on which
all protests will be received, considered, and determined, and on which all assess-
ments will be calculated.
Section 6
Payments
The payments for the improvements shall be made in twenty (20 )
annual install-
ments over a period of nineteen (19 ) years, but
this shall not be construed to prevent
I payment in full at any regular payment dated by any property owner who desires to do
so. It is proposed to pay the entire cost and expense of the construction and
installation of said improvements with cash to be obtained from the sale of bonds
of said Special Improvement District No. 579, as authorized by law.
Such bonds will
be in denominations of $100.00 each, and fractions or multiples of $100.00 where
necessary, to be issued and chargeable against a fund to be known and designated as
Special Improvement District No. 579 Fund of the City of Bozeman.
The bonds will be
redeemable at the option of the City, singly, or in multiples,
and in the order of
their registration, whenever funds are available for the purpose of said Special
Improvement District No. 579. Said bonds shall draw a simple interest from the date
of their registration until called for payment, which interest shall be char,eable
as part of the cost of construction and installation of said improvements. The bonds
will be issued and sold in accordance with the provisions of Section 11-2232 and
Section 11-2271, Revisee Codes of Montana, 1947, and
all other applicable provisions
of Title II of the Revised Codes of Montana, 1947, relating
to special improvement
districts in cities and towns, and any amendments thereof or thereto.

Section 7
Protests and Notice
The regular session of the City Commission of the City of Bozeman to be held at
the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday,
the 27th
day of April, 1977, at the hour of 1:15 o'clock p.m. of said
day, is the time and
the place, when and where the City Commission will hear and pass upon all protests
duly and regularly made and filed against the creation of said proposed Special

Improvement District No. 579, the improvements proposed to be made pursuant thereto,
and the extent and character thereof, or either thereof; and the Clerk of the City
Commission be, and she is hereby directed to give notice in the manner and for the
time as by law required of the adoption of this resolution of intention.
ADOPTED by the City Commission of the City of Bozeman at a regular and stated I
session of the said City Commission held on the 6th day of April 1977.

NOTICE is hereby given, that on the 6th day of April 1977, at a regular session
of the City Commission of the City of Bozeman, Commission Resolution No. 1871,
entitled:

was passed and adopted.
That Wednesday, the 27th day of April 1977, at 1:15 o'clock p.m. at the
Commission Room of the City Hall, Bozeman, Montana, is designated by Commission
Resolution No. 1871 as the time when and where the City Commission of the City of
Bozeman will hear and pass upon all protests that may be made against the making of
such improvements, or the creation of said district. Protests must be made in
writing and delivered to the Clerk of the City Commission within 15 days after the
date of the first publication of this notice.
The general character of improvements is the construction and installation of
asphaltic concrete type paving and necessary appurtenances thereto.
The estimated cost of said improvements within the district, including
engineering, legal, administration, and contingency is $11,500.
For a description of the boundaries of said Special Improvement District No. I
579 reference is hereby made to Commission Resolution No. 1871 of the City Commission
of the City of Bozeman, declaring the intention to create said district, which is
on file in the office of the undersigned Clerk of the said City Commission in the
City Hall of said City of Bozeman, Montana, and open for inspection to all
interested parties and the public generally.
