HomeMy WebLinkAboutResolution 1885 SID 584 216 COMMISSION RESOLUTION NO. 1885 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA., DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 584 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF AN ASPHALTIC:CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS, AND NECESSARY APPURTENANCES THERETO ON SOUTH 15TH AVENUE IN THE CITY OF BOZEMAN. I WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman a petition in due form of certain owners of properties situated in the City of Bozeman asking that a special improvement district be created for the purpose of construction and installation~of an asphaltic-concrete pavement project to include integral concrete curbs and gutters and other work incidental thereto, and WHEREAS, at a regular meeting of the. City Commission of the City of Bozeman, held on the 15th day of June, 1977, the aforesaid petition was respectively consi- dered and granted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention - It is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement Dis- tri<.:t No. 584 for the purpose of construction and installation of pavement on South 15th Avenue in the City of Bozeman. Said pavement project to include construction of an asphaltic-concrete type pavement, integral concrete curbs and gutters, and I necessary appurtenances thereto. Section 2 Boundaries -~--- The boundaries on said Special Improvement District No. 584 are described as follows: Beginning at the West Ij16th corner in the South line of Section 12, Township 2 South, Range 5 East, Montana Principal Meridian, said point being the centerline intersection of West College Street and South 15th Avenue; Lhence Westerly along the centerline of West College Street a distance of 157.04 feet; thence Northerly along the East line of Ap9llo Subdivision extended a distance of 1274.04 feet; thence continuing Southerly parallel to the West Ij16th line of said Section 12, a dis- tance of 60.00 feet to the South line of the proposed Richards Subdivi- sion; thence Easterly along said South line a distance of 52.73 feet to the Southwest corner of Lot 7, Block 3, of the proposed Richards Subdivi- sion; thence Northeasterly to the Northeast corner of said Lot 7; thence Easterly along the South line of West Koch Street a distance of 184.46 feet to the West line of the alley through Blocks 12, 13, 20, and 21 of the Normandy Rearrangement of West Side Addition; thence Southerly along said alley a distance of 1496.64 feet to the centerline of West College Street; thence Westerly along said centerline a distance of 150.60 feet to the point of beginning and containing 332,909.51 square feet of assessable area. Section 3 I Character of Im~vements The character of improvements is the construction and installatiDn of an asphaltic-concrete type pavement project with integral concrete curbs and gutters and necessary appurtenances thereto on South 15th Avenue in the City of Bozeman. Section 4 ------ Estimate of Cost The estimated cost of the lmprovements within the district, including engineer- ing, legal, administration, and contingency is $150,000.00. Section 5- Method of Assessment The cost of said improvement is to be assessed against the entire district, each lot or parcel of land within such district to be assessed for that part of the I whole cost which its area bears to the area of the entire district, exclusive of streets, alleys, and public places. The total actual assessable area within the entire district is 332,909.51 square feet and is the area on which all protests will be received, considered, and determined. It is also the figure on which all assessments will be calculated. Section: 6 Payments The payments for the improvements shwal be made in twenty (20) annual install- ments over a period of nineteen (19 ) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 584, as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 584 Fund of the City of Bozeman. I The bonds will be redeemable at the option of the City singly or in multiples and in the order of their registration, whenever funds are available for the purpose on said Special Improvement District No. 584. Said bonds shall draw a simple interest from the date of their registration until called for payment, which interest shall be chargeable as part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title II, of the Revised Codes of Montana, 1947, relating to special improvement districts in cities and towns, and any amendments thereof or thereto. Section 7 Protests and Notice The regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 20th day of July, 1977, at the hour of 1:15 o'clock p.m. of said day, is the time and place when and where the City Commission will hear and pass upon all protests I duly and regularly made and filed against the creation of said proposed Special Improvement District No. 584, the improvements proposed to be made pursuant thereto, and the extent and character ~ereof, or either thereof; and the Clerk of the City Commission be and she is hereby directed to give notice in the manner and for the .... time as by law required, of the adoption of this resolution of intention. That Wednesday, the 20th day of July, 1977, at 1:15 o'clock p.m. at the I Commission Room of the City Hall, Bozeman, Montana, is designated by Commission Resolution No. 1885 as the time when and where the City Commission of the City of Bozeman will hear and pass upon all protests ~hat may be made against the making of such improvements, or the creation of said district. Protests must be made in writing and delivered to the Clerk of the City Commission within 15 days after the date of the first publication of this notice. The general character of improvements is the construction and installation of an asphaltic-concrete type pavement and necessary appurtenances thereto. The estimated cost of said improvements within the district, including engineering, legal, administration, and contingency is $150,000.00. For a description of the boundaries of said Special Improvement District No. 584 reference is hereby made to Commission Resolution No. 1885 of the City Commission of the City of Bozeman, declaring the intention to create said district, which is on file in the office of the undersigned Clerk of the said City COIT~ission in the CiLy Hall of said City of Bozeman, Montana, and open for inspection to all I interested parties and the public generally.
