M I S S OULA City of Missoula Federal Fiscal Year 2013 6 . 5 Community Development Block Grant Application Guidelines Background Information: Community Development Block Grant (CDBG) funds are made available to the City of Missoula on an annual basis from the Federal Government through the U.S. Department of Housing and Urban Development (HUD). The City's CDBG Program was established in 1974, and is administered by the Office of Planning and Grants (OPG). The primary objective of the program is the development of viable urban communities by providing decent housing, a suitable living environment, and expanding economic opportunities for low and moderate-income individuals. All applications must comply with the regulations of the Community Development Block Grant (CDBG) program found at 24 CFR Part 570 and described by the specific guidelines below. Eligible Applicants: Any individual, for-profit or non-profit organization, business, or governmental agency may apply for City CDBG funds. (For-profit and non-profit economic development activities are only eligible for loans.) Applicants must be in compliance with all federal,state,and local laws and regulations. 2013 CDBG Application Timeline Thursday, August 30, 2012 CDBG & HOME Application Workshop (9:30-10:30 a.m., Jack Reidy Conference Room) Monday, September 24, 2012 Deadline for mandatory submission of pre-application form. APPLICATION SUBMISSION The completed application must be submitted in three formats: 1. Original signed application with required attachments on 8 1/2" by 1 1" sheets with holes punched for a three-ring binder (include numbers on each page of the application packet). 2. Six double-sided copies of the original, signed application, including the budget. Do not staple or bind. Please punch holes for a three-ring binder. 3. Electronic copy of application and budget (Word format) emailed to mgordon@co.missoula.mt.us. Signature: Non-profit organizations must have the chairperson of their Board of Directors sign the application to assure the application has been authorized by their governing board. A signature from the executive director is not acceptable. Complete Applications: The applications and attachments must be complete and all requested information attached. Include a completed copy of the application checklist (page 7 of the CDBG application). Incomplete applications will NOT be considered. APPLICANT REQUIREMENTS • Provide proof of corporate authorization, such as a board resolution,to request these funds. PERFORMANCE MEASUREMENT HUD requires performance measurements for all CDBG awardees that include the identification of objectives and expected outcomes of the project or activity. Quarterly performance reports are required until the project is completed. MONITORING The City of Missoula is required by HUD to conduct on-site monitoring of sub-recipient organizations receiving CDBG funds to assure compliance with CDBG regulations. All organizations will receive advance notice of the scope and timing of the monitoring visit. Page 2 of 8 CDBG OBJECTIVES NATIONAL OBJECTIVES Each activity must meet one of the following national objectives: • Benefit lower-income households; OR • Result in the prevention or elimination of slums or blighted conditions; OR • gent CITY OF MISSOULA OBJECTIVES City of Missoula Consolidated Plan objectives,which direct CDBG allocations,include: Objective #1: Assist the homeless by increasing and/or expanding the availability of emergency shelter facilities, transitional and permanent housing opportunities, and supportive services and prevention programs, and place greater emphasis on providing permanent housing as soon as possible for homeless individuals and families. Objective #2: Increase and preserve the supply of affordable rental units for low- and moderate-income households, including special needs persons. Activities may include acquisition, rehabilitation, new construction, tenant-based rental assistance, housing with supportive services, rental and utility deposit assistance, and assistance to make or keep mobile home parks affordable, safe, and available to residents. Objective #3: Increase and preserve affordable homeownership for low- and moderate-income households, including special needs persons, to include assistance to make or keep mobile home parks affordable,safe,and available to residents. Objective#4: Improve neighborhoods by: ■ Identifying and addressing non-housing needs such as neighborhood-level planning, deteriorating or non-existent infrastructure (such as sewer, transportation needs, street lighting), public facilities, community service facilities, and services and by assisting low- and moderate-income households in obtaining these services; and ■ Improving and enhancing neighborhoods and their ability to support economic development and affordable housing by providing necessary infrastructure such as sewer and transportation systems. Objective#5: Promote economic development and invest in the Missoula workforce,through: ■ Support for entrepreneurship, local business growth and business innovation; ■ Worker education and skill enhancement that will strengthen the earning capacity of low- and moderate-income wage earners; ■ Targeting specific areas for re-investment in order to produce a neighborhood impact; ■ Coordinating economic development needs with needs in other arenas (housing, human services, public facilities/infrastructure) and in other regions; and ■ Developing transportation options for the community's workforce. Page 3 of 8 Objective #6: Continue to address community-wide barriers to affordable housing and barriers to fair housing compliance through periodic action plans and analyses of impediments to fair housing. Objective #7: Decrease housing and community environmental hazards by mitigating environmental hazards in housing and neighborhoods,promoting "green" practices and encouraging sustainability. Objective #8: Increase accessibility in compliance with state and federal laws, regulations and rules such as: ■ Montana Human Rights Act, which makes it unlawful to discriminate in credit, education, employment, financing, housing, state and local governmental services and employment, insurance (sex and marital status only) and public accommodations because of age, familial status (housing only), marital status, national origin, physical or mental disability, political beliefs or ideas (governmental services and employment only), race/color, religion/creed or sex (including pregnancy, maternity and sexual harassment); ■ Fair Housing Act, Title VIII of the Civil Rights Act of 1968 (Fair Housing Act), as amended, which prohibits discrimination in the sale, rental, and financing of dwellings, and in other housing-related transactions, based on race, color, national origin, religion, sex, familial status (including children under the age of 18 living with parents or legal custodians, pregnant women, and people securing custody of children under the age of 18),and handicap (disability); ■ Title VI of the Civil Rights Act of 1964, which prohibits discrimination on the basis of race, color, or national origin in programs and activities receiving federal financial assistance; ■ Section 504 of the Rehabilitation Act of 1973, which prohibits discrimination based on disability in any program or activity receiving federal financial assistance; ■ Cert:nn i no of Title I of the Housing anri rnmmiinity M) v,PlnnmPnt Art of 107d_ which prohibits discrimination on the basis of race, color, national origin, sex or religion in programs and activities receiving financial assistance from HUD's Community Development and Block Grant Program; ■ Title 11 of the Americans with Disabilities Act of 1990, which prohibits discrimination based on disability in programs, services, and activities provided or made available by public entities. HUD enforces Title 11 when it relates to state and local public housing, housing assistance and housing referrals; ■ Architectural Barriers Act of 1968, which requires that buildings and facilities designed, constructed, altered, or leased with certain federal funds after September 1969 must be accessible to and useable by handicapped persons; ■ Age Discrimination Act of 1975, which prohibits discrimination on the basis of age in programs or activities receiving federal financial assistance; ■ Title IX of the Education Amendments Act of 1972, which prohibits discrimination on the basis of sex in education programs or activities that receive federal financial assistance. Objective #9: Plan effectively for future expenditure of Missoula's federal resources, and seek increased funding for projects that meet community development objectives. INCOME GUIDELINES The primary objective of the CDBG Program is the development of viable urban communities by providing decent housing, a suitable living environment and expanding economic opportunities principally for persons of low and moderate income. Each activity carried out by the City under this program must either be documented to benefit a majority of low and moderate-income individuals or neighborhoods or result in the elimination and / or prevention of slums and blighted conditions. Pre-application Form and Optional Draft Application Review: Applicants seeking CDBG funds must submit a pre-application form to the Office of Planning and Grants (OPG),435 Ryman Street,Missoula,MT 59802 by 5:00 p.m.,Monday, September 24, 2012. Applicants who wish to have proposals reviewed for compliance with program requirements and ranking criteria may submit completed application materials to OPG on or before 5:00 p.m. on Monday, September 24, 2012. Staff will return comments within ten days. All applicants MUST submit a pre-application form in order to be eligible to receive CDBG funding. Full Application: The full application form,along with all requested attachments,must be submitted to the Office of Planning and Grants (OPG), 435 Ryman Street, Missoula, MT 59802, by 5:00 p.m. on Monday, October 29, 2012. OPG staff will review all applications for compliance with HUD regulations. For each factor,a top- ranking application will be selected and awarded the maximum number of points available. Lower ranking projects will be compared with the top rank and will be ranked and scored based on comparison with that description. Scores for each factor will be added into a grand total for each application. An application must receive at least 300 points to be considered for funding. When applications have been scored and ranked, OPG will forward a preliminary list of recommended awards to the Mayor and City Council. Page 6 of 8 FE AL REQUIREMENTS A variety of regulations appI o the use of CDBG funds. Some regulations only apply in certain circumstances but are imp ant when considering a project. For instance, compliance with Federal Labor Standards including t payment of Davis-Bacon Wage Rates for projects proposing construction work in excess of $2,00 ' required on construction projects. One of th ey provisions of the CDBG Program regulations is that most activities or services provided must pr' cipally benefit lower-income individuals, and such benefit must be documented. All successful app ' ants will be required to maintain income data, racial/ethnic characteristics, and head-of-household st us for all individuals receiving services under a CDBG-funded project. Organizations receiving funding ill enter into a sub-recipient agreement with the City and be monitored on site by Office of Planning and Grants staff. Non-profit and tax-exempt status will also be verified. HUD REQUIREMENTS FOR AGREEMENTS WITH SUB-RECIPIENTS — W Organizations receiving funding approval from the City Council will be required to enter into a written a Bement with the City of Missoula covering the following items: 1. Stat�ment of Work & Budget: The agreement shall describe each task to be undertaken, including a sched e for completing each task. It shall also include a budget indicating the amount of CDBG funds a ocated to each task described in the statement of work. The statement of work and budget shall be in sufficient detail to provide a sound basis for the City to effectively monitor performance under the agreement. 2. Records &Reports: The following records and reports must be maintained and submitted to the City of Missoula in order to assist the City in meeting its record keeping and recording requirements: • Equal Employment Opportunity Reports: Information on the percentages of women and minorities employed. • Minority Business Enterprise Report: Information on contracts and subcontracts funded in whole C/ or in part with CDBG funds (as applicable). • National O�00 ective: In mat showing com ance with the nano 'ective of benefiting low- and ndera -income 'idividuals areas. activities ent that at least 51 the individuals e iting from CDBG funds are low or moderate-income. 3. Program Income: (U.S. Treasury Circular 1075, "Regulations Governing Withdrawal of Cash from the U.S. Treasury for Advances under Federal Grants and Other Programs) Treasury Circular 1075 requires that cash advances to a recipient organization shall be limited to the minimum amounts needed and shall be timed to be in accord only with actual, immediate cash requirements of the recipient organizations in carrying out the purpose of the approved project or program. This requirement prevents the City from advancing funds to CDBG sub-recipients. As such, all requests for CDBG funding by a CDBG sub-recipient will be on a reimbursement basis. 4. Other Program Requirements: The City and its sub-recipients will be required to conform to the following Federal Laws as applicable: • Fair Housing: Affirmatively furthering fair housing (Public Laws 88-352 and 90-284, Executive Order 1 1063) and comply with The Fair Housing Act (42 U.S.C. 3601-3620) its implementing regulations (24 CFR Part 100-1 15). • Discrimination: Section 109 of the Housing and Community Development Act prohibits discrimination on the grounds of race, color,national origin, or sex in the uses of CDBG funds. In addition, discrimination on the grounds of creed is prohibited in Montana. The City and its sub-recipients will be required to comply with the Montana Human Rights Act (49-2-305, MCA) which prohibits discrimination in the sale or rental of housing, the financing of housing or the provision of brokerage services against any person on the basis of race, color, religion,creed, sex,age, marital status, national origin,handicap or familial status. They will Page 7 of 8 also be required to comply with M ssoula Ci Ordinance 3428, which prohibits discriminatory practices in the areas of e loy t, public accommodations and housing on the basis of race,color, national origin, ances ry, religion, creed, sex, age, marital or familial status, physical or mental disability,sexual orientation,gender identity or gender expression. • Labor Standards: Federal Davis-Bacon Act Wage Rates apply to construction work in excess of $2,000. ? • Environmental Standards: The City of Missoula will assume responsibility for completing the environmental review requirements for each CDBG assisted activity. Generally services provided by public service organizations are exempt from this requirement; however, depending on the nature of the project, an environmental review may have to be completed. This process generally takes 45-60 days to perform the review, publicize notices, and allow for a review and comment period. • Employment and Contracting Opportunities: Sub-recipient organizations will be required to comply with Executive Order 11246 prohibiting discrimination in employment on federally ti Q� assisted construction contracts and Section 3 of the Housing and Urban Development Act of 1968 requiring, to the greatest extent feasible, employment opportunities for residents from lower-income areas. Lead-Based Paint: The use of lead-based paint is prohibited and rehabilitation work on l� residential structures built prior to 1978 must be conducted according to HUD regulations on lead-based paint. Use of Debarred,Suspended,or Ineligible Contractors: CDBG funds cannot be used to employ Ndebarred contractors. A determination of the eligibility of a contractor to perform work on a CDBG assisted project must be obtained from OPG. • Uniform Administrative and Cost Principles: Public service organizations will be required to NIY� comply with the policies, guidelines, and requirements of OMB Circular No.'s A-87,A-122,A- 1, 128,and Part 85 the Common Rule as applicable. • Conflict of Interest: No person who is an employee, grant consultant officer, elected official, or appointed official to the City or of any public agency receiving funds, who exercises and functions or responsibility with respect to CDBG funds or who are in a position to participate on a decision-making process or gain inside information with regard to such activities, may obtain a personal financial interest or benefit from the activity, or have an interest in any contract with respect thereto,or the proceeds there under, either for themselves,or those with whom they have family or business ties during their tenure or for one year thereafter. �• � ohibition Regarding Displacement of Lower-Income Households: Displacement is generally not 1pplicable to public service activities. All projects funded with CDBG are subject to this prohibition. 5. Reversion of Assets: The agreement shall specify that if an organization ceases to use any assets acquired with CDBG funds for the purpose described in the agreement, the sub-recipient shall either pay to the City the fair market value of the asset or transfer control of the asset to the City.
