HomeMy WebLinkAboutResolution 1906 Extend Boundaries of the City 31"3 COMMISSION RESOLUTION NO. 1906 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN AND THE INHABITANTS THEREOF, AND OF THE INHABITANTS OF A TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN, AND HEREIN MORE PARTICULARLY DESCRIBED TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACTS WITHIN THE CORPORATE LIMITS THEREOF. I WHEREAS, there has been presented to the City Commission of the City of Bozeman a written and verbal request petitioning the said City Commission to extend the boundaries of the City of Bozeman so as to include certain contiguous tracts of land within the boundaries of the City of Bozeman and having presented to the City of Bozeman proposed plats and certificates of survey of said land; and WHEREAS, the proper legal description according to Certificate of Survey No. 398 of said contiguous tracts located in the county of Gallatin, state of Montana, is as follows: Description of the Legion Housing Annexation Tract A 3.388 acre parcel located in the southwest quarter of Section 1, Township Two South, Range Five East, Principal Meridian of Montana, in Gallatin County, Montana, as shown on Certificate of Survey No. 398, and being more particularly described as follows: Beginning at Corner No. 1, which is on the south line of the southwest quarter, and from which the south quarter corner of said section bears South 89003'17" East a distance of 370.54 feet. From Corner No. 1 a brass capped iron witness post bears North 00005'10" East, 30.00 feet. Thence, from Corner No. 1, North 89003'17" West along the south line of the said southwest quarter a distance of 200.02 feet to Corner No. 2, from which a brass capped iron witness post bears North 00005'10" East, 30.00 feet; Thence, from Corner No. 2, North 00005'10" East along a line parallel to and 570.50 feet distant from the east line of the west half of said section a distance of 737.85 feet to Corner No. 3, which is marked with a brass capped iron monument; I Thence, from Corner No. 3, South 89003'17" East a distance of 200.02 feet to Corner No. 4, which is marked with a brass capped iron monument; thence, from Corner No. 4, South 00005'10" West along a line parallel to and 370.50 feet distant from the east line of the west half of said section a distance of 737.85 feet to Corner No. 1. WHEREAS, it will be for the best interests of the City of Bozeman and the inhabitants thereof and of the inhabitants of the contiguous tracts hereinbefore described to extend the boundaries of the City of Bozeman so as to include the said contiguous tracts hereinbefore described within the corporate limits of the said city of Bozeman. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1 That it is hereby declared to be to the best interests of the City of Bozeman and the inhabitants thereof and of the inhabitants of the contiguous tracts hereinbefore described that the boundaries of the said City of Bozeman be extended so as to include the contiguous tracts hereinbefore described within the boundaries and corporate limits of the City of Bozeman, Montana. Section 2 Pursuant to Section 11-403, R.C.M., 1947, the Clerk of the City Commission shall cause notice to be published in the Bozeman Daily Chronicle, a newspaper nearest the parcels of land to be embraced within the corporate limits and boundaries of the city of Bozeman, at least once a week for two successive weeks, which notice shall be to the effect that such resolution has been duly and legally passed and that for a period of 20 days after the first publication of such notice the Clerk of the City Commission will receive expressions of approval and disapproval in writing as to the proposed I extension of the boundaries of the City of Bozeman from resident freeholders of the territories to be embraced. PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 28th day of September, 1977. / ~ .c- ~.. yor ATTEST: ion COMMISSION RESOLUTION NO. 1906 --....- -..... 31'~4 NOTICE IN RE COMMISSION RESOLUTION NO. 1906 OF THE CITY OF BOZEMAN, MONTANA, STATING THE INTENTION OF THE CITY COMMISSION TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN TO EMBRACE AND INCLUDE A CERTAIN TRACT OF LAND ADJOINING SAID CITY. NOTICE IS HEREBY GIVEN that on the 28th day of September, 1977, at a regular meeting of the City Commission of the City of Bozeman, Montana, said Commission duly and regularly passed and adopted Commission Resolution No. 1906 entitled: I A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN AND THE INHABITANTS THEREOF, AND OF THE INHABITANTS OF A TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN, AND HEREIN MORE APRTICULARLY DESCRIBED TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACTS WITHIN THE CORPORATE LIMITS THEREOF. NOTICE IS HEREBY FURTHER GIVEN, that Wednesday, the 26th day of October, 1977, at 1:15 o'clock p.m., at the Commission Room of the City Hall, Bozeman, Montana, is designated as the time and place for hearing objections to the action proposed to be taken in said Resolution No. 1906, whereby it is proposed to embrace the hereinafter described contiguous territories within the corporate limits of the City of Bozeman, Montana. Expressions of approval or disapproval by resident freeholders of the territories proposed to be embraced must be made in writing and filed with the Clerk of the City Commission of the City of Bozeman not later than twenty (20) days after the date of the first publication of this notice.
