HomeMy WebLinkAboutResolution 1890 SID 582 287' COMMISSION RESOLUTION NO. 1890 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 582 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF LATERAL WATER MAINS AND APPURTENANCES TO SERVE THE ADJOINING PROPERTIES, MORE SPECIFICALLY AS FOLLOWS: A SIX (6) INCH WATER MAIN AND APPURTENANCES IN OLIVE, AN EXTENSION FROM OLIVE TO KOCH ON ABOUT I SOUTH 16TH AVENUE AND CUL DE SACS ON APPROXIMATELY 17TH AND 18TH AVENUES, AND VARIOUS EASEMENTS BETWEEN SOUTH 15TH AND SOUTH 19TH, AND BABCOCK AND COLLEGE STREETS. THE CONSTRUCTION AND INSTALLATION TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIALS, CAST IRON WATER MAIN, VALVES AND FITTINGS AND HYDRANTS, SERVICE LINES AND OTHER NECESSARY APPURTENANCES TO PROVIDE WATER TO ALL LOTS IN THE DISTRICT. WHEREAS, at a regular session of the City Commission of the City of Bozeman, held on the 15th day of June, 1977, the said City Commission duly passed Commission Resolution No. 1880 declaring it to be the intention of the said City Commission to create a special improvement district to be known and designated as Special Improve- ment District No. 582 of the said City for the purpose of constructing and installing lateral water mains and appurtenances, and to specially assess the entire cost and expense of making said improvements against the district, and said Commission Resolu- tion No. 1880 is hereby referred to and made a part hereof for further particulars in respect to the boundaries of said Special Improvement District No. 582, the estimated cost of said improvements an~ method of assessing the same against the property of said district; and, WHEREAS, notice ot the passage of said Commission Resolution No. 1880 was duly I pUblished, as required by law in the Bozeman Daily Chronicle, a daily newspaper of general circulation printed and published in the City of Bozeman, Montana, Bnd by sending a copy of such notice by U.S. mail to each person, firm, or corporation having property within the proposed district at his or its last known address, upon the same date that such notice was first published as aforesaid, and due proof having been made of the pUblication and services of said notice; and, WHEREAS, within the time period by law and said published and served notice, there were not sufficient protests against the creation of said proposed Special Improvement District No. 582, and the City Commission was in regular session on the 20th day of July, 1977, at 1:15 o'clock p.m. of said day, at the Commission Chamber in the City Hall Building in the said city of Bozeman, Montana, the same being the time and place designated in said notice for passing upon all protests, if any, against the proposed work or against the creation or extent of said district, or both or either; and it further appearing that all of the proceedings for the creation of said district have been lawful and regular. NOW, THEREFORE, BE IT RESObVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: - I Section I That the said Special Improvement District No. 582 of the City of Bozeman be, and the same is hereby created for the purpose of making the improvements as in said Commission Resolution No. 1880 and hereinafter described. Section 2 That said special improvements be, and the same are, hereby ordered to be made in said Special Improvement District No. 582 as follows: COMMISSION RESOLUTION NO. 1890 '~,288 CONSTRUCTION AND INSTALLATION OF LATERAL WATER MAINS AND APPURTENANCES TO SERVE THE ADJOINING PROPERTIES, MORE SPECIFICALLY AS FOLLOWS: A SIX (6) INCH WATER MAIN AND APPURTENANCES IN OLIVE, AN EXTENSION FROM OLIVE TO KOCH ON ABOUT SOUTH 16TH AVENUE AND CUL DE SACS ON APPROXIMATELY 17TH AND 18TH AVENUES, AND VARIOUS EASEMENTS BETWEEN SOUTH 15TH AND SOUTH 19TH, AND BABCOCK AND COLLEGE STREETS. THE CONSTRUCTION AND INSTALLATION TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIALS, CAST IRON WATER MAIN, VALVES AND FITTINGS AND HYDRANTS, SERVICE LINES AND OTHER NECESSARY APPUR- TENANCES TO PROVIDE WATER TO ALL LOTS IN THE DISTRICT. Section 3 I That the entire cost and expense of maintaining the improvements herein referred to in said Special Improvement District No. 582 shall be assessed against the entire district, each lot or parcel of land within such district to be assessed for that part of the total assessment which its area bears to the total area within the dis- trict. The total area within the district is 1,449,279.84 square feet and is the area on which all protests will be received, considered, and determined, and on which all assessments will be calculated. Section 4 That any and all construction districts within the same boundaries and serving the same area are hereby declared abandoned and terminated.
