HomeMy WebLinkAboutPetition to Recreate the Downtown Business Improvement District Petition to Recreate the Downtown Bozeman Business Improvement District Page 1 of 2 PETITION TO RECREATE DOWNTOWN BUSINESS IMPROVEMENT DISTRICT WHEREAS, the Bozeman Downtown Business Improvement District (the “District”) was created and effective on May 15, 2000 via Ordinance 1517; and WHEREAS, the current District is set to expire on the 10-year anniversary of its creation pursuant to Sect. 7-12-1141, MCA, and the current District board of trustees has asked landowners within the District to consider recreating the District anew; and WHEREAS, the undersigned is the owner, as defined by §7-12-1103, MCA, of real property within the boundaries of the proposed District set out on Exhibit “A” which boundaries match the boundaries of the current District and desires to ensure the District is recreated and in effect for an additional ten (10) years; and WHEREAS, the undersigned desires to petition the City Commission of the City of Bozeman, Montana to pass a resolution of intention and take all other legally required steps to recreate the District whose boundaries shall comprise all of the tracts of real estate set out on Exhibit “A”; and WHEREAS, the undersigned acknowledges that should the Commission adopt a Resolution of Intent to recreate the District the City will publish a Notice of Passage of the Reso lution of Intent and mail a copy to every owner of real property within the proposed District pursuant to § 7 -12-1112, MCA; and WHEREAS, any owner of property liable to be assessed may make written protest against the recreation of the District pursuant to § 7-12-1113, MCA, filed with the Bozeman City Clerk within 15 days of the first publication of the Notice of Passage of the Resolution of Intent ; and WHEREAS, the undersigned acknowledges the City Commission may not act in furtherance of the recreation of the proposed District for a period of one year if protests are filed by: (1) owners of property within the proposed District having a taxable valuation, when aggregated, representing not less than 50% of the total taxable valuation of property within the District; (2) not less than 50% of the owners of property within the District; or (3) owners of property within the proposed District having projected assessments, when aggregated, representing not less than 50% of the total projected assessments for property within the District; and WHEREAS, Petitioner understands that each lot or parcel of land which is owned by the Petitioner or the entity Petitioner represents, including the improvements on the lot or parcel, will be assessed for that part of the whole cost of the proposed District that its taxable valuation bears to the total taxable valuation of the property of the proposed District all subject to the proposed budget for each year; and Petition to Recreate the Downtown Bozeman Business Improvement District Page 2 of 2 WHEREAS, the total assessments for the District for 2009 totaled $114,000 and the total assessments for the District, if re-created, in 2010 are estimated to not exceed $114,000 which represents the entire cost of the District and the Petitioner understands this amount may fluctuate from year to year during the duration of the District. By signing this Petition, the undersigned hereby petitions the City Commission to create the District and in doing so represents that the following information is true and accurate: 1. Petitioner is (1) a person or duly authorized agent of an entity whose name appears on the legal title to the real property as set out on Exhibit “A” by deed recorded in the records of the Clerk and Recorder of Gallatin County, Montana; or (2) a person in possession of real property under claim of ownership for the owner of record or has the personal representative or is the personal representative, agent or guardian of such owner. 2.
