SUBJECT: Authorize the City Manager to sign the Notice of Award to award the
contract for the 2013 Street Improvements to Big Sky Asphalt, Inc. in the amount of
$374,464.40.

RECOMMENDATION: Authorize the City Manager to sign the Notice of Award to award the
contract for the 2013 Street Improvements to Big Sky Asphalt, Inc. in the amount of
$374,464.40.
BACKGROUND: Bids were opened May 21, 2013, for the 2013 Street Improvements
project. The project consists of cold milling and asphalt overlays of Ferguson Ave. from Huffine
Lane to Babcock Street, S. 12th, S. 13th, and S. 14th, from College Street to Dickerson Street, Dickerson Street from S. 11th to S. 15th, Technology Blvd and Research Drive, and a portion of
Professional Drive, and chip sealing of streets in Brentwood Subdivision, Stoneridge
Subdivision, and portions of Annie Subdivision. Two bids were received for the project, with the
low bid being submitted by Big Sky Asphalt, Inc. of Bozeman in the amount of $374,464.40. The bids appear to be competitive with the low bid being approximately 6% below the construction estimate ($398,652). A copy of the Certified Bid Tabulation is attached.
UNRESOLVED ISSUES: None
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: Funding for this work has been planned for from the Fuel Tax
fund.

CONTRACT FOR: Cold milling and hot mix overlays, and seal coat improvements
You are notified that your Bid dated May 21, 2012, for the above Contract has been considered. You are the
apparent Successful Bidder and have been awarded a Contract for Cold milling and hot mix overlays, and
seal coat improvements
The Contract Price of your Contract is: three hundred seventy four thousand four hundred sixty four and
40/100 Dollars ($374,464.40).
Three copies of the proposed Contract Documents accompany this Notice of Award.
You must comply with the following conditions precedent within fifteen (15) days of the date of this
Notice of Award, that is, by .
1. You must deliver to the OWNER 3 fully executed counterparts of the Agreement including all the
Contract Documents and Drawings.
2. You must deliver with the executed Agreement the Contract Security (Bonds) as specified in the
Instruction to Bidders (page 7), General Conditions (paragraph 5.01) and Supplementary Conditions
(paragraph SC-5.02).
3. List other conditions precedent:
You must deliver with the executed Agreement the Certificates of Insurance as specified in
the General Conditions (paragraph 5.03) and Supplementary Conditions (paragraph SC-5.04).
Failure to comply with these conditions within the time specified will entitle OWNER to consider your
Bid abandoned, to annul this Notice of Award, and to declare your Bid Security forfeited.
Within ten (10) days after you comply with these conditions, OWNER will return to you one fully
signed counterpart of the Agreement with the Contract Documents attached.
