A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, STATING THE COMMISSION'S INTENT TO CREATE A BUSINESS
IMPROVEMENT DISTRICT IN THE CITY'S DOWNTOWN AREA.
WHEREAS, on the 20th day of November 1995, the Commission adopted Ordinance
No. 1409, adopting by reference the Urban Renewal Plan; and
WHEREAS, the Downtown Bozeman Improvement District Board was created under the
Urban Renewal Plan; and
WHEREAS, the Downtown Bozeman Improvement District Board has determined the
need for the creation of a Business Improvement District; and
WHEREAS, on the 6th day of December 1999, the Commission acknowledged receipt
of a petition for the creation of a Business Improvement District; and
WHEREAS, said petition contained the signatures of owners of more than 60 percent
of the area of the property to be included in the district.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:
Section 1
The City Commission of the City of Bozeman states its intent to create a Business
Improvement District which will serve a public use, and promote the health, safety, prosperity,
security and general welfare of the inhabitants thereof. The purpose of the proposed Business
Improvement District is to improve retail marketing in the district, promote private investment
and business expansion in this district, the general management of the district, and such other
functions as are authorized by, and necessary to carry out the purposes of, Section 7-12-1 102,
Montana Code Annotated.
Section 2
The boundaries of the district, as set forth in Exhibit "A", attached hereto, shall be as
follows:
Beginning at the intersection of the centerline of West Babcock Street and the
centerline of South Grand Avenue; thence extending eastward along the
centerline of Babcock Street to the intersection of the centerline of East
Babcock Street and the centerline of South Rouse Avenue; thence extending
northward along the centerline of Rouse Avenue to the intersection of the
centerline of East Mendenhall Street and the centerline of North Rouse
Avenue; thence extending westward along the centerline of Mendenhall Street
to the intersection of the centerline of West Mendenhall Street and the
centerline of North Grand Avenue; thence extending southward along the
centerline of Grand Avenue to the intersection of the centerline of West
Babcock Street and the centerline of South Grand Avenue, the point of
beginning, excluding those properties whose ownership is held on May 15,
2000, by government entities, by non-profit ownerships having Section
501 (c)3 IRS approval, and properties whose primary use is considered
residential under the Bozeman zone code.
Section 3
The regular session of the City Commission of the City of Bozeman to be held at the
Commission Room in the Municipal Building, 411 East Main Street, Bozeman, Montana, on
Monday, the 1 st day of May 2000, at the hour of 7:00 p.m. of said day is the time and place
where and when the City Commission will hear all objections to the creation of a Business
Improvement District.
Section 4
Pursuant to Section 7-12-1 1 12, M.C.A., the Clerk of the City Commission shall:
a. Immediately notify in writing, every owner of real property within the
proposed district listed on the last completed assessment role, at the
owners' last known address; and
b. Cause a notice to be published in the Bozeman Daily Chronicle for a
period of five days.
The notice to be given by the Clerk of the City Commission shall be to the effect that
such resolution has been duly and legally passed, and that the Clerk of the City Commission will
receive written comments of approval or disapproval of the proposed creation of a Business
Improvement District from real property owners within the proposed district, and that the written
comments, if any, must be filed with the Clerk of Commission not later than 5:00 p.m. on
Thursday, April 27, 2000.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at
a regular session thereof held on the 3rd day of April 2000.

description of the boundaries.
The purpose of the proposed Business Improvement District, which includes properties
between the centerlines of Babcock Street and Mendenhall Street between the centerlines of
Rouse Avenue and Grand Avenue, is to improve retail marketing in the district, promote private
investment and business expansion in this district, the general management of the district, and
such other functions as are authorized by, and necessary to carry out the purposes of, Section
7-12-1102, Montana Code Annotated.
For a period of fifteen (15) days following the first publication of this Notice, the Clerk
of Commission will receive comments, in writing, of approval or disapproval of the proposed
creation of a Business Improvement District from the owners of real property within the proposed
district. The deadline for this written comment is 5:00 p.m. on Thursday, April 27, 2000. In
addition, a public hearing shall be held on Monday, May 1, 2000, at 7:00 p.m. in the
Commission Room of City Hall, at 41 1 East Main Street,Bozeman, Montana, for the purpose of
hearing testimony in support of or in opposition to the proposed creation of a Business
Improvement District.
