Home My WebLink AboutResolution 1930 Taxes for Sidewalks and Curbs During 1976 .m. ~". ._~,~ __ .... _ ._~-- ~-------~-~- -----_.. - .--- - --.- ---~--_..- - - .. - 369 COI1MISSION RESOLUTION NO. 1930 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND INSTALLING ~ND/OR REPAIRING MISCELLANEOUS SIDEWALKS AND CURBS DURING THE YEAR 1976.; I WHEREAS, the Commission of the City of Bozeman, pursuant to the provisions of Chapter 9.36 of the Bozeman Municipal Code and of Section 11-2226, Political Code, R.C.M., 1947, provide for the construction of sidewalks and curbs in the City of Bozeman during the year 1976 without the formation of Special Improvement District; WHEREAS, proceedings were had for the construction and installation and/or repair of Miscellaneous Sidewalks and Curbs in the City of Bozeman for the year 1976, and WHEREAS, miscellaneous Sidewalks and Curbs were constructed and installed and/or repaired bordering on various properties in the City of Bozeman, pursuant to Chapter 9.36 of the Bozeman Municipal Code and the provisions of Section 11-2226, Political Code, R.C.~l., 1947, which are hereby referred to and made a part of this Resolution, and WHEREAS, the miscellaneous Sidewalks and Curbs have been constructed and completed and/ or repaired in accordance with the terms and conditions of said proceedings, and the City Engineer has duly certified to the Commission a Schedule showing the sidewalks and curbs ~vhich have been constructed and installed and/or repaired, and the properties which are subject to assessment thereunder and the total cost of said construction and installation and lor repair- ing is the sum of Twenty-One Thousand Eight-Hundred Seventy-Five and 65/l00ths ($21,875.65) dollars, which schedule marked Schedule "A" is hereto attached and made a part hereof. NOW, THEREFORE, pursuant to the provisions of Chapter 9.36 of the Bozeman Municipal Code and Section 11-2226, Political Code, R.C.M., 1947, as aforesaid. BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA: I Section l. That to defray the cost of constructing and installing and/or repairing Mis- cellaneous Sidewalks and Curbs as set forth in Schedule "A" hereto attached and made a part hereof, there is hereby levied and assessed a tax amounting to the sum of Twenty-One Thousand Eight-Hundred Seventy-Five and 65/100ths ($21,875.65) dollars. Section 2. That a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such construction and installation and/ or repair and the amount of each payment to be made and the day when the same shall become delinquent is set forth in the assessment list hereto attached marked Schedule "A" and made a part hereof; that the several sums set opposite the name of the owner and the description of the lots and parcels of land be, and the same are hereby respectively levied and assessed upon said lots and parcels of land to defray the cost and expense of constructing and installing and/or repairing said Sidewalks and Curbs; that the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assessment list as required by law; that the payment of said sums shall be made in five (5) installments; that the payment of said installments shall be made on or before the 30th day of November of each year until payment of all installments together with the interest thereon, shall be made; that said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collection of Special Improvement Taxes; that failure to pay such assessments when the sum shall become due and payable shall make such persons and said lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Section 3. That the regular session of the Commission of the City of Bozeman to be I held in the Commission Chamber in the City Hall Building of said City on the 30th of November, 1977 at 1:15 o'clock p.m. be, and the same is hereby designated as the time and place at which objections to the final adoption of this resolution will be heard by said Commission. Section 4. That the Clerk of the Commission of the City of Bozeman, be and she is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and ~- published in the said City of B~eman a notice signed by the Clerk of the Commission and stat- ing that a Resolution levying and assessing a special assessment of taxes to defray the cost and expense of constructing .and installing and/or repairing sidewalks and curbs in the City - .-""'---.. .-'-. ~_.. _ ___~_~_. NOTICE IS HEREBY GIVEN, that during a regular session of the Commission of the City of Bozeman held on Wednesday, the 23rd day of November, 1977, Commission Resolution levies and assesses a special assessment of taxes upon certain lots and parcels of land in front, or 0 n the side of which sidewalks and curbs have been constructed and/or repaired pursuant to the provisions of Chapter 9.36 of the Bozeman Municipal Code and of Section 11-2226, Political Code, R.C.M., 1947, to defray the cost and expense of constructing and installing and/or re- pairing said Sidewalks and Curbs. That said Commission Resolution is now on file in the office of the Clerk of the Commis- sion, subject to inspection for a period of five (5) days by any persons interested. That Wednesday, the 30th day of November, 1977, 1:15 o'clock p.m. of said day, at a regular session of the Commission of the City of Bozeman at the Commission Chamber, City Hall Building of said City, has been designated as the time and place when and where the said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Commission REsolution No. 1930 and the levying of said assessment, and that said Resolution will be finally passed and adopted at said regular session.
