COMMISSION RESOLUTION NO. 1945
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA
DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA,
TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IM-
PROVEMENT DISTRICT NO. 588 FOR THE PURPOSE OF CONSTRUCTION AND IN-
STALLATION OF TRUNK WATER MAINS AND APPURTENANCES THROUGH A PORTION
I OF THE CITY OF BOZEMAN, MORE SPECIFICALLY AS FOLLOWS: A TWELVE (12)
INCH TRUNK MAIN AND APPURTENCES ON BOND STREET AND GOLD AVENUE EX-
TENDED FROM THE 18" LYMAN CREEK SUPPLY LINE TO NORTH ROUSE, ON
NORTH ROUSE TO GRIFFIN DRIVE, ON GRIFFIN DRIVE TO WEST OF NORTH
7TH AVENUE, ON BRIDGER DRIVE FROM GRIFFIN DRIVE TO THE CITY LIMITS,
A TEN (10) INCH TRUNK MAIN AND APPURTENANCES ON GRIFFIN DRIVE FROM
ROUSE TO STORY MILL ROAD. THE CONSTRUCTION AND INSTALLATION TO
INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIALS,
WATER PIPE, FIRE HYDRANTS, VALVES, FITTINGS, AND OTHER NECESSARY
APPURTENANCES.
WHEREAS, the Planned Community Devolopment Act of 1973 requires Municipalities to plan
for the extension of governmental services to an annexed area, and whereas it is now feasible
to extend City of Bozeman water services to the Northeast, Nelson, and McChesney Annexations.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY CO~1ISSION OF THE CITY OF BOZEMAN:
Section 1
Declaration of Intention
That it is hereby declared to be the intention of the City of Bozeman to create a special
improvement district to be known and designated as Special Improvement District No. 588 of the
City of Bozeman for the purpose of constructing and installing trunk water mains, said project
to include all appurtenant work to provide trunk water lines for all properties within the
district.
Section 2
Boundaries
I The boundaries on said Special Improvement District No. 588 are described as follows:
Beginning at the center of Section Six (6), Township Two (2) South,
Range Six (6) East, M.P.M.; thence North 880 42' East along the South
line of the Northeast Quarter (NE 1/4) of said Section Six (6) a dis-
tance of 1152 feet more or less to a point on the West right of way
line of the Burlington Northern Railroad Story Mill Spur, said point
being the true point of beginning; thence Northeasterly along the
said Story Mill Spur's West right of way line to the point of inter-
section of the East boundary line of Assessor's Tract 17 and the West
boundary line of Assessor's Tract 18; thence North 120 42' East a
distance of 572.2 feet; thence North 80019' West a distance of 290.1
feet; thence North 300 22' West to the point of intersection with the
South right of way line of Griffin Drive; thence Easterly along the
South right of way line of Griffin Drive to the point of intersection
with the West right of line of the Chicago, Milwaukee, St. Paul &
Pacific Railroad Menard Branch; thence Northerly along said Chicago,
Milwaukee, St. Paul & Pacific Railroad West right of way line to
the point of intersection with the North right of way line of Bridger
Drive (F.A.S. No. 293), said point being 135.1 feet Westerly and
320.04 feet Southerly of the East 1/16 cor., Southeast Quarter (SE1/4)
of Section Thirty-one (31), Township One (1) South, Range Six (6)
East; thence along the Northerly right of way line of said Bridger
Drive South 890 55' 00" West a distance of 691.2 feet to a point on
the North right of way at P.T. Sta. 45+25.5 of F.A.S. 293, Bridger
Drive; thence continuing along said North right of way along a
curve to the left through a central angle of 390 05' a distance of
808.9 feet to a point on the Northerly right of way at P.C. Sta.
37+43.8 of F.A.S. 293; thence continuing along said Northerly right
of way bearing South 500 50' 00" West a distance of 274.41 feet to
I point, being the Southeast corner of Block Two (2), Bridger Center
Subdivision; thence North 00 45' 00" West a distance of 719.32 feet
to a point on the North line of the South Half of the Southeast
Quarter (S 1/2 SE 1/4) of said Section Thirty-one (31), said
point being 1786.80 feet Westerly of the East 1/16 cor. Southeast
Quarter (SE 1/4) of said Section Thirty-one (31); thence South 880
35' 12" West along said North line of the South Half of the South-
east Quarter (S 1/2 SE 1/4) of Section Thirty-one (31) a distance
of 840.61 feet to the West 1/16 cor. of Southeast Quarter (SE 1/4)
of Section Thirty-one (31); thence South 890 57' 37" West a dis-
tance of 1000.48 feet; thence South 10 02' 41" a distance of
1295.29 feet to a point on the North right of way line of Griffin

Drive; thence Westerly along the North right of way line of Griffin
Drive, a distance of 5205.78 feet more or less; thence Southerly a
distance of 30.00 feet to the Northwest corner of the Nelson Annex-
ation; thence Southeasterly along the North right of way of Interstate
90 along an arc of radius 4187.50 feet a distance of 1475.98 feet;
thence North 810 15' 43" East a distance of 720.73; thence North
010 03' 32" West a distance of 248.35 feet; thence North 870 05'
37" East a distance of 181.24 feet to the West right of way of U.S.

Highway 10; thence Easterly a distance of 105.8 feet to the East
right of way of U.S. Highway 10; thence South 100 55' 24" East a
distance of 248.00; thence South 000 53' 40" East a distance of
61.00 feet; along the North right of way of Interstate 90; thence
South 540 58' 09" East a distance of 850.30 feet; thence South 740
41' 17" West a distance of 269.11 feet; thence leaving said right

of way North 01 11' 40" West a distance of 1224.44 feet to the
South right of way line of Griffin Drive; thence Easterly along the
South right of way line of Griffin Drive a distance of 1401.04 feet
to the West line of the Northeast Annexation; thence South 380 24'
East along the East right of way line of the Burlington Northern
Railroad mainline a distance of 2791.59 feet tothe North right of
way of Interstate 90; thence South 700 35' 22" East along said
right of way a distance of 996.15; thence North 380 57' East a
distance of 20 feet more or less to the true point of beginning
and containing 294 acres more or less.
Section 3
Character of Improvements
The Character of improvement to be made is the installation and construction of 10 and
12 inch trunk water mains, including trench excavation and backfill, bedding material, valves,
fire hydrants, fittings, and other appurtenant work thereto.
Section 4
Estimate of Cost
The total estimated cost of the improvements within the district, including engineering,

legal and contingency is $470,000.00.
Section 5
Method of Assessment
The cost of such improvement is to be assessed against the entire district, each lot,
block, tract or parcel of land within the district will be assessed for that portion of the
whole cost which its area bears to the area of the entire district exclusive of public streets,
avenues, alleys and public places. The total actual assessable area within the district is
11,058,685.08 square feet, and is the area on which all protests, will be received, consid-
ered and determined. It is also the figure on which all assessments will be figured.
Section 6
Extended District
The City Commission is of the opinion that the contemplated improvement is of more than
local or ordinary public benefit. Therefore, the City Commission hereby makes the costs
and expenses of such work and improvement chargeable upon an extended district which shall
include lots not fronting on the improvement, which lots and district the City Commission
hereby declares to be the district benefited by said work or improvement and to be assessed
to pay the costs and expenses thereof.
Section 7
Payments

The payments for said improvements shall be made in twenty (20) annual installments
extending over a period of nineteen (19) years, but this shall not be construed to prevent
payment in full at any regular payment date by any property owner who desires to do so.
It is proposed to pay the entire cost and expense of the construction and installation of
said improvements with cash to be obtained from the sale of bonds of said Special Improve-
ment District No. 588 as authorized by law. Such bonds will be in denominations of $100.00

each, and fractions or multiples of $100.00 where necessary to be issued and chargeable
against a fund to be known and designated as Special Improvement District No. 588 Fund
of the City of Bozeman. The bonds will be redeemable at the option of the city, singly
or in multiples, and in order of their registration, whenever funds are available for the
purpose in said Special Improvement District No. 588. Said bonds shall draw a simple
I interest from the date of their registration until called for payment, which interest
shall be chargeable as part of the cost of construction and installation of said improve-
ments. The bonds will be issued and sold in accordance with the provisions of Section
11-2232 and Section 11-2271, Revised Codes of Montana 1947, and all other applicable pro-
visions of Title II of the Revised Codes of Montana 1947, relating to special improvement
districts in cities and towns, and any amendments thereof or thereto.
Section 8
Protests and Notices
That the regular session of the City Commission of the City of Bozeman, to be held at
the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 22nd day
of February, at the hour of 1:15 o'clock p.m. of said day, is the time and place, when and
where the City Commission will hear and pass upon all protests duly and regularly made
and filed against the creation of said proposed Special Improvement District No. 588 the
improvements proposed to be made pursuant thereto and the extent and character thereof,
or either thereof; and the Clerk of the City Commission be, and she is hereby directed to
give notice in the manner and for the time as by law required, of the adoption of this
Resolution of Intention.
ADOPTED by the Commission of the City of Bozeman, Montana, at a regular and stated
session of said Commission held on the 1st day of February, 1978.

That Wednesday, the 22nd day of February, 1978, at l:lSo'clock P.M., at the Commission
Room of the City Hall, Bozeman, Montana, is designated by Commission Resolution No.
1945
as the time when and where the City Commission of the City of Bozeman will hear and pass
upon all protests that may be made against the making of such improvements, or the creation
of said district. Protests must be made in writing and delivered to the Clerk of the City
Commission within 15 days after date of the first publication of this notice.

The general character of improvements is installation and construction of 10 and 12

fire hydrants, fittings and other appurtenant work thereto.
The estimated cost of improvements in Special Improvement District No. 588
is
$470,000.00 which will be charged to the property owners on an area basis.
For description of the boundaries of said Special Improvement District No. 588

erence is hereby made to Commission Resolution No. 1945 of the City Commission of the City
of Bozeman, declaring the intention to create said district, which is on file in the office
of the undersigned Clerk of the said City Commission in the City Hall of said City of Bozeman,
Montana, and open for inspection to all interested parties and the public generally.
This notice is given pursuant to the provisions of Section 11-2204, Revised Codes of
Montana, 1947.
