HomeMy WebLinkAboutResolution 1952 SID 591 -.- . -- -.-- - .. -. .~..- _.~- .,_~~._~~ __ __T ___ . ~ ~" 417 COMMISSION RESOLUTION NO. 1952 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 591 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF TRUNK WATER MAINS I AND APPURTENANCES THROUGH A PORTION OF THE CITY OF BOZEMAN, MORE SPECIFIC- ALLY AS FOLLOWS: A TWELVE (12) INCH TRUNK MAIN AND APPURTENANCES ON BOND STREET AND GOLD AVENUE EXTENDED FROM THE 18" LYMAN CREEK SUPPLY LINE TO NORTH ROUSE, ON NORTH ROUSE TO GRIFFIN DRIVE, ON GRIFFIN DRIVE TO WEST OF NORTH 7TH AVENUE, ON BRIDGER DRIVE FROM GRIFFIN DRIVE TO THE CITY LIMITS. THE CONSTRUCTION AND INSTALLATION TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIALS, WATER PIPE, FIRE HYDRANTS, VALVES, FITTINGS, PRESSURE REDUCING STATION AND OTHER NECESSARY APPURTENANCES. WHEREAS, the Planned Community Development Act of 1973 requires Municipalities to plan for the extension of Governmental services to an annexed area, and whereas it is now feasible to extend City of Bozeman water services to the Northeast, Nelson and McChesney Annexations. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement District No. 591 of the City of Bozeman for the purpose of constructing and installing trunk water mains, said project to include all appurtenant work to provide trunk water lines for all properties within the district. Section 2 I Boundaries The boundaries on said Special Improvement District No. 591 are described as follows: Beginning at the center of Section Six (6), Township Two South (T2S), Range Six (R6E), M.P.M.; thence North 880 42' East along the South line of the NortheastQuarter (NE~) of said Section Six (6) a distance of 1152 feet more or less to a point on the West right of way line of the Burlington Northern Railroad Story Mill Spur, said point being the true point of beginning; thence Northeasterly along the said Story Mill Spur's West right of way line a distance of 1170 feet more or less to the point of intersection of the South boundary line of Assessor's Tract 17 and the North Boundary line of Assessor's Tract 7; thence South 880 37' 58" West a distance of 384.6 feet; thence North a distance of 867.40 feet; thence South 880 42' West a distance of 1023.15 feet; thence North a distance of 858.34 to the center line of Griffin Drive, thence North 880 43' 30" East a distance of 155.55 feet; thence South 680 57' 51" East along said centerline a distance of 245 feet more or less; thence leaving said centerline North 400 21' 20" East along the east line of Assessor's Tract 27 extended a distance of 386.45 feet; thence North 310 09' 13" East a distance of 81.28 feet to the Southwest Corner of Tract 26; thence South 69009'35" West a dis- . 0 tance of 988.64 feet; thence South 88 33' 35" West a distance of 361.79 feet to the West right of line of the Chicago, Milwaukee, St. Paul and Pacific Railroad Menard Branch; thence Northerly along said Chicago, Milwaukee, St. Paul and Pacific Railroad West right of way line a dis- tance of 686.97 to the North right of way line of Bridger Drive (F.A.S. Thence continuing along said North risht of way along a curve to the left through a central angle of 39 05' a distance of 808.9 feet to a point on the Northerly right of way at P.C. Section 3 Character of Improvements The character of improvement to be made is the installation and construction of 12 inch trunk water mains, including trench excavation and abackfill, bedding material, valves, fire hydrants, fittings, and other appurtenant work thereto. Section 4 I Estimate of Cost The total estimated costs of the improvements within the district, including engineering, legal, and contingency is $440,000.00. Section 5 Method of Assessment The cost of such improvement is to be assessed against the entire district, each lot, block, tract or parcel of land within the district will be assessed for that portion of the whole cost which its area bears to the area of the entire district exclusive of public streets, avenues, alleys and public places. The total actual assessable area within the district is 8,643,678.50 square feet, and is the area on which all protests will be received, considered, and determined. It is also the figure on which all assessments will be figured. Section 6 Payments The payments for said improvements shall be made in twenty (20) annual installments ex- tending over a period of nineteen (19) years, but this shall not be construed to prevent pay- ment in full at any regular payment date by any property owner who desires to do so. lt is I proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Imp. Dist.No;.')9l as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 591 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for the purpose in said Special Improve- ment District No. 591. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title II of the Revised Codes of Montana, 1947, relating to special improvement districts in cities and towns, and any amendment thereof or thereto. I Section 7 Protests and Notices That a regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 5th day of April, 1978, at the hour of 1:15 o'clock p.m. of said day, is the timemd place when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 591 the improvements proposed to be made pursuant thereto and the extent and character thereto, or either thereof; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law requried, of the adoption of this Resolution of Intention. That Wednesday, the 5th day of April, 1978, at 1:15 o'clock p.m., at the Commission Room I of the City Hall, Bozeman, Montana, is designated by Commission Resolution No. 1952 as the time when and where the City Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district. Protests must be made in writing and delivered to the Clerk of the City Commis- sion within 15 days after date of the first publication of this notice. The general character of improvements is the installation and construction of 12 inch trunk water mains, including trench excavation and backfill, bedding material, valves, fire hydrants, fittings, and other appurtenant work thereto. Estimated cost of improvements in Special Improvement District No. 591 is $440,000.00 which will be charged to the property owners on an area basis.
