'''~''__.....,.......- _......."..._....-.- - 41;4 COMMISSION RESOLUTION NO. 1951 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE- MENT DISTRICT NO. 590 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURB AND GUTTER, STORM DRAINS AND NECESSARY APPURTENANCES THERETO ON SOUTH BLACK FROM I COLLEGE TO ARTHUR, COLLEGE FROM BLACK TO TRACY, HARRISON FROM BLACK TO TRACY, AND THE CUL DE SACS ADJOINING BLACK IN THE CITY OF BOZEMAN. WHEREAS, there has been filed with the Clerk of Comm~ity of Bozeman, Montana, a petition in due form of certain owners of properties situated in the district asking that a Special Improvement District be created for the purpose of constructing and installing an asphaltic concrete type pavement, together with integral concrete curb and gutter, and necessary appur- tenances thereto, and necessary storm drainage facilities appurtenant to such pavement; and WHEREAS, at a regular meeting of the City Commission of the_City of Bozeman held on the 9th day of November, 1977,the aforesaid petition was respectively considered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention It is hereby declared to be the intention of the City of Bozeman to create a Special Improvement District to be known and designated as Special Improvement District No. 590 for the purpose of constructing and installing an asphaltic concrete type pavement on South Black Avenue between West College Street and West Arthur Street, College between Black and Tracy, Harrison between Black and Tracy, and the cul de sacs adjoining Black Avenue, and project to include construction and installation of integral concrete curb and gutter and necessary appurtenances thereto, together with necessary storm drainage facilities appurtenant to such paving. I Section 2 Boundaries The boundaries of said Special Improvement District No. 590 are described as follows: Beginning at the Northeast corner of Lot 16, Block G, Hoffman's Addition to the City of Bozeman; thence South along the West line of South Black Avenue a distance of 52.00 feet to the North line of East College Street; thence East a distance of 60.00 feet to the East line of South Black Avenue; thence South a distance of 60.00 feet to the South line of East College Street; thence East along said line a distance 66.10 feet to the Northeast corner of Lot 4, Block 1, Springde11 Addition; thence South along the East - line of said Lot 4 a distance of 109.00 feet; thence East along the North line of Lots 5, 6 and 7 a distance of 200.00 feet to the East line of Springde11 Addition, which is common with the west right of way of the Chicago, Milwaukee, St. Paul & Pacific Railroad; thence South along said line a distance of 25.17 feet; thence along a curve to the right of radius 1407.70 feet an arc distance of 604.20 feet; thence along a curve to the right an arc distance of 146.00 feet; thence Southwesterly along said line a distance of 317.06 feet; thence Northwesterly along the South line of said Springde1l Addition a distance of 233.90 feet to the Southwest corner of Lot 8, Block 2 of said addition; thence North along the West line of said Lot 8 and Lot 7 a distance of 254.10 feet tothe Northwest corner of said Lot 7, thence Easterly along the North line of said Lot 7, a distance of 50.95 feet; thence North a distance of 340.00 feet to a point in Lot 4 of Dudley's First Addition, said point being 50.00 feet South of the South line of Harrison Street; thence West along the South line extended of Lot 7, of said Dudley's First Addition a distance of 177.00 feet to the East line of South Tracy Avenue; thence South along said line a distance of 160.00 feet; thence East along the North line of Lot 12, Block I, Butte I Addition, a distance of 167.00 feet; thence North along the East line of said Block 1 a distance of 230.00 feet; thence West a distance of 167.00 feet toithe East line of South Tracy; thence North a distance of 162.00 feet; thence East along the North line extended of Lots 16 and 19, Block G, Hoffman's Addition a distance of 369.60 feet tothe point of beginning. Section 3 Character of Improvements The character of improvements in Special Improvement District No. 590 is the construction of an asphaltic concrete pavement project with integral concrete curb and gutter together with storm drainage and necessary appurtenances to said construction on South Black between College ~---- .- -~..~.~-_.~-_...~_. -.. - --. ~~-~ _.~&. .__& . .~ -. __n_GOMMISSION.....RESOL.U'J:.lON .19?j,_._u~_~. ~ .~~....---~---..- .~. -. .- ~ __ .__~__ _.... _, L -"'" -~_.--- 415 and Arthur Streets, College between Black and Tracy, Harrison between Black and Tracy, and the cuI de sacs adjoining Black, said project to include construction of gravel subbase, an asphaltic concrete type base and surface course, all necessary excavation and backfill, and all other work appurtenant thereto; together with all storm drainage appurtenant to said project. I Section 4 Estimate of Cost The preliminary estimate of cost of the improvements in Special Improvement District No. 590 including all construction costs, material costs, engineering, legal, administration, and contingency is $220,000.00. Section 5 Method of Assessment The cost of said improvement is to be assessed against the entire district; each lot or parcel of land within such district will be assessed for that part of the whole cost which its area bears to the area of the entire district, exclusive of streets, avenues, alleys, and public places. The total number of square feet of assessable area within the entire district is 379,075.21 square feet which is the area on which all protests will be received, considered, and determined, and on which all assessments will be calculated. Section 6 Payments The payments for said improvements shall be made in twenty (20) annual installments extending over a period of nineteen (19) years, but this shall not be construed to prevent I payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 590 as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 590 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for the purpose on said Special Improvement District No. 590. Said bonds shall draw simple interest from the date of their registration until called for payment, which interest shall be chargeable as part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana 1947, and all other applicable provisions of Title II of the Revised Codes of Montana, 1947, relating to special improvements districts in cities and towns, and any amendments thereof or thereto. Section 7 Protests and Notice The regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 22nd day of March, 1978, at the hour of 1:15 P.M. of said day, is the time and place, when and where the I City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 590 the improvements proposed to be made pursuant thereto, and the extent and character thereof, or either thereof; and the Clerk of the City Commission be, and she is hereby authorized to give notice in the manner and for the time as by law required, of the adoption of this resolution of intention. I NOTICE IS HEREBY GIVEN that on the 1st day of March, 1978, at a reg- ular session of the City Commission of the City of Bozeman, Commission Resolution No. 1951, . entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE- MENT DISTRICT NO. 590 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURB AND GUTTER, STORM DRAINS AND NECESSARY APPURTENANCES THERETO ON SOUTH BLACK FROM COLLEGE TO ARTHUR, COLLEGE FROM BLACK TO TRACY, HARRISON FROM BLACK TO TRACY, AND THE CUL DE SACS ADJOINING BLACK IN THE CITY OF BOZEMAN. was passed and adopted. That Wednesday, the 22nd day of March, 1978, at 1:15 P.M., at the Commission Room of the City Hall,Bozeman, Montana, is designated by Commission Resolution No. 1951 as the time when and where the City Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district. Protests must be made in writing and delivered to the Clerk of the City Commission within 15 days after date of the first publication of this notice. The general character of the improvements is construction of an asphaltic concrete pavement project with integral concrete curb and gutter together with storm drainage and necessary appurtenances to said construction of South Black between College and Arthur Streets, College between Black and Tracy, Harrison between Black and Tracy, and the cuI de sacs adjoin- I ing Black. Estimated cost of improvements in Special Improvement District No. 590 is $220,000.00 which will be charged to the property owners on an area basis. For description of the boundaries of said Special Improvement District No. 590 ref- erence is hereby made to Commission Resolution No. 1951 of the City Commission of the City of Bozeman, declaring the intention to create said district, which is on file in the office of the undersigned Clerk of the said City Commission in the City Hall of said City of Bozeman, Montana, and open for inspection to all interested parties and the public generally.
