HomeMy WebLinkAboutResolution 1962 SID 594 440-- _.n -- ______u__ ._n - -.-- ----. . 9 ~ -- -- . ~~ ---_.~~ - COMMISSION RESOLUTION NO. 1962 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE- MENT DISTRICT NO. 594 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF AN ASPHALTIC-CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND I GUTTERS, STORM DRAINS AND NECESSARY APPURTENANCES THERETO ON HEALY AND LANGOHR AVENUES, ALL IN BLOCK 5, FIGGINS ADDITION, IN THE CITY OF BOZEMAN. WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman a petition in due form of certain owners of properties situated in the City of Bozeman asking that a Special Improvement District be created for the purpose of construct- ion and installation of an asphaltic-concrete pavement project to include integral concrete curbs and gutters, storm drainage, and other work incidental thereto, and WHEREAS, at a regular meeting of the City Commission of the City of Bozeman, held on the 22nd day of March, 1978, the aforesaid petition was respectively considered and granted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention It is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement District No. 594 for the purpose of construction and installation of pavement and storm drainage on Healy and Langohr Avenues in Block 5, Figgins Addition, in the City of Bozeman. Section 2 Boundaries I The boundaries on said Special Improvement District No. 594 are described as follows: Beginning at the Southeast corner of Block 5, Figgins Addition to the City of Bozeman, said point being North 530 30' 41" West a distance of 49.62 feet from the East quarter corner of Section 24, T2S, R5E, M.P.M., 0 thence North 00 13' 00" East a distance of 304.49 feet; thence South 890 18' 00" West a distance of 463.73 feet; thence South 000 06' 47" West a distance of 304.68 feet; thence 890 17' 05" East a distance of 462.94 feet to the point of beginning and containing portions of Lots 6 through 8,12, 15 ~l and all of Lots 9 through 11, 16 through 20, of Block 5, Figgins Addition to the City of Bozeman, Montana. Section 3 Character of Improvements The character of improvements is the construction and installation of an asphaltic- concrete type pavement project with integral concrete curbs and gutters, storm drains, and necessary appurtenances thereto on Healy and Langohr Avenues. Section 4 Estimate of Cost The estimated cost of the improvements within the district, including engineering, legal, administration, and contingency is $76,000.00. I Section 5 Method of Assessment The cost of said improvement is to be assessed against the entire Block 5, as per the attached request from the property owners in Block 5. Each lot or parcel of land within the block will be assessed for that part of the whole cost which its area bears to the area of the entire Block 5, exclusive of streets, alleys, and public places. The total actual asses- sable area within the entire block is 208,450.38 square feet, and is the area on which all protests will be received, considered and determined. Section 6 Payments I The payments for the improvements shall be made in twenty (20) annual installations over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. lt is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 594 as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 594 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City singly or in multiples and in the order of their registration, whenever funds are available for the purpose on said Special Improvement District No. 594. Said bonds shall draw a simple interest from the date of their registration until called for payment, which interest shall be chargeable as part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title II, of the Revised Codes of Montana, 1947, relating to special improvement districts in cities and towns, and any amendments thereof or thereto. Section 7 Protests and Notices I The regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 10th day of May, 1978, at the hour of 1:15 o'clock p.m. of said day, is the time and place when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 594, the improvements proposed to be made pursuant thereto, and the extent and character thereof, or either thereof; and the Clerk of the City Commission be and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this resolution of intention. ADOPTED by the City Commission of the City of Bozeman, at a regular and stated session of said City Commission, held on the 19th day of April, 1978. NOTICE IS HEREBY GIVEN that on the 19th day of April, 1978, at a regular session of I the City Commission of the City of Bozeman, Commission Resolution No. 1962 entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE- MENT DISTRICT NO. 594 FOR THE PURPOSE OF CONSTRUCTION AND INSTALL- ATION OF AN ASPHALTIC-CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS, STORM DRAINS AND NECESSARY APPURTENANCES THERETO ON HEALY AND LANGOHR AVENUES, ALL IN BLOCK 5, FIGGINS ADDITION, IN THE CITY OF BOZEMAN. was passed and adopted. That Wednesday, the 10th day of May, 1978, at 1:15 o'clock p.m., at the Commission Room of the City Hall, Bozeman, Montana, is designated by Commission Resolution No. 1962 as the time when and where the City Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district. Protests must be made in writing and delivered to the Clerk of the City Commission within 15 days after date of the first publication of this notice. The general character of improvements is the construction and installation of an asphaltic-concrete type pavement project with integral concrete curbs and gutters, storm drains, and necessary appurtenances thereto on Healy and Langohr Avenues. The estimated cost of improvements in Special Improvement District No. 594 is $76,000.00 which will be charged to the property owners on an area basis. Fir description of the boundaries of said Special Improvement District No. 594 reference - I is hereby made to Commission Resolution No. 1962 of the City Commission of the City of Bozeman, declaring the intention to create said district, which is on file in the office of the under- signed Clerk of the said City Commission in the City Hall of said City of Bozeman, Montana, and open for inspection to all interested parties and the public generally. This notice is given pursuant to the provisions of Section 11-2204, Revised Codes of Montana, 1947.
