'..-."'..-L i27 COMMISSION RESOLUTION NO. 1956 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN AND THE IN- HABITANTS THEREOF, AND OF THE INHABITANTS OF A TRACT OF LAND CONTIG- UOUS TO THE SAID CITY OF BOZEMAN, AND HEREIN MORE PARTICULARLY DES- I CRIBED TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACTS WITHIN THE CORPORATE LIMITS THERE- OF. WHEREAS, there has been presented to the City Commission of the City of Bozeman a written and verbal request petitioning the City Commission to extend the boundaries of the City of Bozeman so as to include certain contiguous tracts of land within the boundaries of the City of Bozeman and having presented to the City of Bozeman existing plats of said land; and WHEREAS, the proper legal description of said contiguous tracts located in the county of Gallatin, state of Montana, is as follows: Description of the Schaefer - Jursnick Annexation A tract of land located in the Southeast one-quarter of (SE~) of Section Thirty-six (36), Township One (1) South, Range Five (S):East, Montana Principal Meridian, Gallatin County, Montana; and being Lots Twenty-two (22) and Twenty-five (25) of the Gordon Mandeville State School Section Subdivision as recorded at the Gallatin County Court- house and more precisely described as follows: Beginning at a found iron pin taken to be the Southeast section corner of Section Thirty- six (36); thence North 340 45' 41" West a distance of 812.37 feet to a found pin at the Northwest corner of said Lot Twenty-two (22), being the true point of beginning; thence North 890 45' 00" East a distance of 230.04 feet; thence South 000 14' 40" East a distance of 625.24 feet to the new North right of way of Griffin Drive; thence South 890 42' 53" West on and along said new right of way a dis- tance of 230.10 feet; thence North 000 14' 23" West a distance of I 625.38 feet to the true point of beginning. The above tract of land contains 3.30 acres, more or less, and is subject to any easement of records. WHEREAS, it will be for the best interests of the City of Bozeman and the inhabitants thereof and of the inhabitants of the contiguous tracts hereinbefore described to extend the boundaries of the city of Bozeman so as to include the said contiguous tracts hereinbefore described within the corporate limits of the said City of Bozeman. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1 That it is hereby declared to be the best interest of the city of Bozeman and the inhab- itants thereof and of the inhabitants of the contiguous tracts hereinbefore described that the boundaries of the said City of Bozeman be extended so as to include the contiguous tracts here- inbefore described within the boundaries and corporate limits of the City of Bozeman, Montana. Section 2 Pursuant to Section 11-403, R.C.M., 1947, the Clerk of the City Commission shall cause notice to be published in the Bozeman Daily Chronicle, a newspaper nearest the parcels of land to be embraced within the corporate limits and boundaries of the City of Bozeman, at least once a week for two successive weeks, which notice shall be to the effect that such resolution has been duly and legally passed and that for a period of 20 days after the first publication of I such notice the Clerk of the City Commission will receive expressions of approval or disapproval in writing as to the proposed extension of the boundaries of the City of Bozeman from resident freeholders of the territories to be embraced. NOTICE IS HEREBY GIVEN that on the 15th day of March, 1978, at a regular meeting of I the City Commission of the City of Bozeman, Montana, said Commission duly and regularly passed and adopted Commission Resolution No. 1956 entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN AND THE IN- HABITANTS THEREOF, AND OF THE INHABITANTS OF A TRACT OF LAND CONTIG- UOUS TO THE SAID CITY OF BOZEMAN, AND HEREIN MORE PARTICULARLY DES- CRIBED TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACTS WITHIN THE CORPORATE LIMITS THEREOF. NOTICE IS HEREBY FURTHER GIVEN that Wednesday, the 19th day of April, 1978, at 1:15 o'clock p.m., at the Commission Room of the City Hall, Bozeman, Montana, is designated as the time and place for hearing objections to the action proposed to be taken in said Res- olution No. 1956, whereby it is proposed to embrac~ the hereinafter described contiguous territories within the corporate limits of the City of Bozeman, Montana. Expressions of approval or disapproval by resident freeholders of the territories proposed to be embraced must be made in writing and filed with the Clerk of the City Commission of the City of Bozeman not later than twenty (20) days after the date of the first publication of this notice.
