COMMISSION RESOLUTION NO. 1968
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DE-
CLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL
IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 596
FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF SANITARY SEWER MAINS
AND APPURTENANCES TO SERVE THE ADJOINING PROPERTIES MORE SPECIFICALLY AS I
FOLLOWS: A TWELVE (12) INCH MAIN AND APPURTENANCES UNDER THE NORTHERN
PACIFIC RAILWAY, AN EIGHT (8) INCH MAIN AND APPURTENANCES ON MEADOW
LANE, SOUTH TO GRIFFIN DRIVE, AND ON GRIFFIN DRIVE IN THE CITY OF
BOZEMAN.
THE CONSTRUCTION AND INSTALLATION TO INCLUDE ALL TRENCH EXCAVATION AND
BACKFILL, BEDDING MATERIALS, SEWER PIPE, MANHOLES, WYES, LAMPHOLES,
SERVICE LINES AND OTHER NECESSARY APPURTENANCES.
WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman,
Montana, a petition in due form of certain owners of properties situated within the boundaries
of Special Improvement District No. 596 as hereinafter more specifically described, asking
that a special improvement district be created for the purpose of constructing and installing
of sanitary sewer mains and appurtenances.
WHEREAS, that at a regular meeting of the City Commission of the City of Bozeman held on
the 11th day of January, 1978, the aforesaid petition was respectively considered and granted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
Declaration of Intention
That it is hereby declared to be the intention of the City of Bozeman to create a special
improvement district to be known and designated as Special Improvement District No. 596 of
the City of Bozeman for the purpose of constructing and installing sanitary sewer mains.
Section 2 I
Boundaries
The boundaries of said Special Improvement District No. 596 are described as follows:
Description
Beginning at the Northeast corner of the McChesney Annexation a point on
the North line of Section One, Township Twn South, Range Five East, M.P.M.,
Gallatin County, said point being South 870 33' 22" West a distance of
275.10 feet from the Northeast corner of said Section One, thence South
010 11' 44" East a distance of 1,254.44 feet to a point on the Northerly
right of way of Highway 1-90. Thence along said right of way through the
following courses.
North 740 41' 17" West a distance of 269.11 feet; North 540 58' 09" West
a distance of 850.30 feet; North 740 41' 17" West a distance of 16.00
feet; to a point on the Easterly right of way of U.S. Highway 10. Thence
along Easterly right of way through the following courses: North 000 53'
40" West a distance of 61.00 feet; North 100 55' 24" West a distance of
24S.0G feet; North 000 53' 40" West a distance of 343.72 feet to the North
line of Section One and East right of way of U.S. Highway 10. Thence
South 870 33' 22" West a distance of 105.8 feet to intersection of the
North line of said Section One and West right of way of U.S. Highway 10.

Thence South 87 33' 22" West a distance of 489.75 feet along said North
section line of Section One. Thence South 010 51' 08" East a distance of
339.57 feet, thence North 880 28' 56 II East a distance of 302.78 feet to
the West right of way of U.S. Highway 10, thence South 010 03' 32" East
a distance of 248.35 feet to North right of way of Highway 1-90. Thence
along said right of way South 810 IS' 43" West a distance of 720.73 I
feet thence along a 4187.50 foot radius curve to the right, having a
tangent bearing of North 720 26' 35" West through a central angle of
50 39' 41" for a length of 413.77 feet, thence leaving said right of
way, North 000 49' 44" West a distance of 540.15 feet to center line of
Griffin Drive. Thence along said center line North 880 02' 20" East a
distance of 1485.19 feet to East right of way of U.S. Highway 10. Thence
along said right of way North 000 53' 40" West a distance of 43.02 feet

Included within the above described boundary are the McChesney Annexation, Shaefer-Jursnick
Annexation, and Wheat Commercial Subdivision.
Section 3
I Character of Improvements
The character of the improvements to be made is the installation and construction of twelve
(12) inch and eight (8) inch sanitary sewer mains, including trench excavation and backfill,
bedding material, manholes, lampholes or clear outs, wyes, and sanitary sewer service lines and
other appurtenant work thereto.
Section 4
Estimate of Cost
The total estimated cost of the improvements within the district, including engineering,
legal and contingency is $105,000.00.
Section 5
Method of Assessment
The cost of such improvement is to be assessed against the entire district, each lot, block,
tract or parcel of land within the district will be assessed for that portion of the whole cost
which its area bears to the area of the entire district exclusive of streets, avenues, alleys,
and public places.
The total actual assessable area within the entire district is 1,433,401.69 square feet and
is the area on which all protests will be received, considered, and determined. It is also
the
figure on which all assessments will be figured.
I Section 6
Payments
The payments for said improvements shall be made in twenty (20) annual installments ex-
tending over a period of nineteen (19) years, but this shall not be construed to prevent pay-
ment in full at any regular payment date by any property owner who desires to do so. lt is
proposed to pay the entire cost and expense of the construction and installation of said im-
provements with cash to be obtained from the sale of bonds of said Special Improvement Dis-
trict No. 596 as authorized by law. Such bonds will be in denominations of $100.00 each,
and fractions or multiples of $100.00 where necessary, to be issued and chargeable against
a fund to be known and designated as Special Improvement District No. 596 Fund of the City
of Bozeman. The bonds will be redeemable at the'option of the City, singly or in multiples,
and in the order of their registration, whenever funds are available for the purpose in said
Special Improvement District No. 596. Said bonds shall draw a simple interest from the date
of their registration until called for payment, which interest shall be chargeable as part of
the cost of construction and installation of said improvements. The bonds will be issued
and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised
Codes of Montana, 1947, and all other applicable provisions of Title II of the Revised Codes
of Montana, 1947, relating to special improvement districts in cities and towns, and any
amendments thereof or thereto.

Protests and Notice
That the regular session of the City Commission of the City of Bozeman, to be held at the
Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 17th day of May,
1978, at the hour of 1:15 o'clock p.m. of said day, is the time and place,
then and where the
City Commission will hear and pass upon all protests duly and regularly made and filed against
the creation of said proposed Special Improvement District No. 596, the improvements proposed
to be made pursuant thereto and the extent and character thereof, or either thereof; and the
Clerk of the City Commission be, and she is hereby directed to give notice in the manner and

for the time as by law required, of the adoption of this Resolution of Intention.
ADOPTED by the Commission of the City of Bozeman, Montana, at a regular and stated
session of said Commission held on the 26th day of April, 1978.

NOTICE IS HEREBY GIVEN that on the 26th day of April. 1978, at a regular session of the
City Commission of the City of Bozeman, Commission Resolution No. 1968 entitled:

was passed and adopted.
That Wednesday, the 17th day of May, 1978, at 1:15 o'clock p.m, at the Commission Room
of the City Hall, Bozeman, Montana, is designated by Commission Resolution No. 1968 as the
time when and where the City Commission of the City of Bozeman will hear and pass upon all
protests that may be made against the making of such improvements, or the creation of said
district. Protests must be made in writing and delivered to the Clerk of the City Commission
within 15 days after date of the first publication of this notice.
The general character of improvements is the construction and installation of a twelve
(12) inch main under the Northern Pacific Railway and an eight (8) inch main on Meadow Lane,
including trench excavation and backfill, bedding materials, sewer pipe, manholes, wyes, 1amp-
holes, service lines and other necessary appurtenances.
The estimated cost of improvements in Special Improvement District No. 596 is $105,000.00
which will be charged to the property owners on an area basis.
For description of the boundaries of said Special Improvement District No. 596 reference
is hereby made to Commission Resolution No. 1968 of the City Commission of the City of Bozeman,
declaring the intention to create said district, which is on file in the office of the under-
signed Clerk of the said City Commission in the City Hall of said City of Bozeman, Montana,
and open for inspection to all interested parties and the public generally. III
This notice is given pursuant to the provisions of Section 11-2204, Revised Codes of
Montana, 1947.
