MINUTES OF THE MEETING OF THE CITY COMMISSION BOZEMAN, MONTANA
March 25, 2013

The Commission met in the City Commission Room, City Hall at 121 North Rouse on Monday,
March 25, 2013. Present were Mayor Sean Becker, Deputy Mayor Jeff Krauss, Commissioner
Carson Taylor, Commissioner Chris Mehl, City Manager Chris Kukulski, City Attorney Greg
Sullivan, and City Clerk Stacy Ulmen.

0:07:57 A. Call to Order – 6 p.m. – Commission Room, City Hall, 121 North Rouse
Mayor Becker called the regular meeting to order at 6:05 p.m.

0:08:39 C. Changes to the Agenda
Mayor Becker asked City Manager Chris Kukulski if there were any changes to the agenda. Mr.
Kukulski stated that there were no changes to the Agenda.
0:08:48 D. Authorize Absence of Commissioner Andrus
It was moved by Cr. Taylor, seconded by Deputy Mayor Krauss to approve the absence of
Commissioner Andrus.
Those voting Aye being Cr. Taylor, Deputy Mayor Krauss, Cr. Mehl and Mayor Becker.
Those voting No being none.
The motion passed 4-0.

1. Authorize Payment of Accounts Payable Claims (LaMeres)
2. Authorize City Manager to enter into an extension of the current sublease agreement
with Montana Rail Link for the Story Mill Spur Trail (Sullivan)
3. Finally Adopt Ordinance No. 1847, establishing an initial zoning designation of RS on
19.42 acres for Ditton, Tract B-1 of Certificate of Survey 2392B as amended by the right-
of-way highway acquisition in conjunction with annexation, Zoning Application Z-12056
(Skelton)

0:09:47 G. Special Presentation - Mayor State of the City Address (Mayor Sean Becker)
Mayor Sean Becker gave the State of the City Address. He spoke regarding the history and
growth of the City, Montana State University, the construction of Gallatin Field, the historic
districts in the Community, current projects in Bozeman, deferred maintenance, the Community
Climate Action Plan, the recent judgment, the creation of jobs, the Parks and Trails bond
implementation, downtown investment, future water supply, a future Police facility, support of
Gallatin College, and those that take part in the Community. Mayor Becker stated that he will not
be running for Mayor in the next term cycle and thanked everyone for allowing him to serve the
community.

1:18:59 Commission Questions for Staff
The Commission and Staff discussed the block length requirements, the topography of the area,
the trail in the area, park allotment areas, the roads and streets in the area including intersections
near the school, collector standards, street names, variances and the block standards, alley loaded
lots, deviations, storm water locations, park credits, restricted size lots, driveway areas and
setbacks, accessibility to Park Land, cascading development, waivers of SIDs, park land
requirement deviations and the transportation corridor and the alley loaded lots.

Applicant representative Trina Wolf gave the applicant presentation for the Knoll at Baxter West
Preliminary Plat Application P-12014, located northeast of the intersection of Baxter Lane and
Harper Puckett Road, north of Baxter Meadows Subdivision, Phase 3B and west of Chief Joseph
Middle School.

The Commission and Applicant spoke regarding right of ways and streets, the park and phase 3
of the project.

Applicant representative Dave Crawford continued the Applicant presentation. He spoke
regarding connectivity, deviations, design of the streets and confusion of names.

Mayor Becker opened public comment.

Mr. Hook stated that he lives south of the project and emphasized that infrastructure needs to be
addressed on the front end of this project.

Ms. Pool of 2375 Lasso Ave stated that the infrastructure part is not being done well and
encouraged the Commission to look more at infrastructure.

2:35:44 Applicant rebuttal
The Applicant representative spoke regarding the concerns of developers walking away and
proposed to bond Harper Puckett road. She also spoke regarding the name of the subdivision.
2:37:48 Motion that having reviewed application materials, considered public comment,
and the staff analysis, I hereby adopt the findings presented in the staff report for
application P-12014 and move to approve the requested variances to the following sections
of Chapter 38 of the Bozeman Municipal Code: 1) Section 38.23.040.B "Block Length" to

exceed the maximum block length of 400 feet for Blocks 9, 10, 11, 14 and 18, and 2) Section
38.23.040.C "Block Width" to allow block widths to be less than 200 feet in width for
Blocks 9, 14, and 18. It was moved by Cr. Mehl , seconded by Cr. Taylor that Having
reviewed application materials, considered public comment, and the staff analysis, I hereby
adopt the findings presented in the staff report for application P-12014 and move to
approve the requested variances to the following sections of Chapter 38 of the Bozeman
Municipal Code: 1) Section 38.23.040.B "Block Length" to exceed the maximum block
length of 400 feet for Blocks 9, 10, 11, 14 and 18, and 2) Section 38.23.040.C "Block Width"
to allow block widths to be less than 200 feet in width for Blocks 9, 14, and 18.
2:39:12 Commission Discussion
The Commission discussed the topography and the trail connection, the adjoining property and
design concerns, alleys and the size of lots, hardships and block widths.
2:50:34 Vote on the Motion that having reviewed application materials, considered public
comment, and the staff analysis, I hereby adopt the findings presented in the staff report
for application P-12014 and move to approve the requested variances to the following
sections of Chapter 38 of the Bozeman Municipal Code: 1) Section 38.23.040.B "Block
Length" to exceed the maximum block length of 400 feet for Blocks 9, 10, 11, 14 and 18,
and 2) Section 38.23.040.C "Block Width" to allow block widths to be less than 200 feet in
width for Blocks 9, 14, and 18.
Those voting Aye being Crs. Mehl, Taylor, Deputy Mayor Krauss and Mayor Becker.
Those voting No being none.
The motion passed 4-0.

that having reviewed application materials, considered public comment,
and the staff analysis, I hereby adopt the findings presented in the staff report for
application P-12014 and move to approve the preliminary plat application for The Knoll at
Baxter West Subdivision authorizing to subdivide 26.314 acres and create 65 residential,
single household lots and the remaining area as open spaces, trails and streets subject to
the conditions, as listed in Planning Board Resolution P-12014.
It was moved by Cr. Mehl , seconded by Cr. Taylor that Having reviewed application
materials, considered public comment, and the staff analysis, I hereby adopt the findings
presented in the staff report for application P-12014 and move to approve the preliminary
plat application for The Knoll at Baxter West Subdivision authorizing to subdivide 26.314
acres and create 65 residential, single household lots and the remaining area as open
spaces, trails and streets subject to the conditions, as listed in Planning Board Resolution
P-12014.

2:52:28 Amendment to the Motion to add a condition of subdivision approval that the
developer, bond their share of construction costs of Harper Puckett road with the added
Clarification to the condition that the construction of Harper Puckett be bonded prior to final
plat of the first phase (instead of last phase) or when the road be built (if it is build early).

It was moved by Deputy Mayor Krauss, seconded by Cr Mehl to add a condition of
subdivision approval that the developer, bond their share of construction costs of Harper
Puckett road with the added clarification that the condition that the construction of Harper
Puckett be bonded prior to final plat of the first phase (instead of last phase) or when the road
be built (if it is build early).
The Commission discussed the roads and the developer's willingness to step forward, protecting
the public interest and access to schools.

The Commission and Staff discussed the different phases of the subdivision, credits, green space,
block width, parking, maintenance and upkeep of the subdivision parks and open space corridors.

regarding The Crossing at Baxter Meadows, Phase 4B-4I Preliminary Plat Application P-12017,

and east of the Gallatin County Regional Park.

block length of 400 feet for Blocks 2, 4, 6, 7, 8 and Block 10, and 2) from Section

It was moved by Cr. Taylor, seconded by Deputy Mayor Becker that having reviewed
application materials, considered public comment, and the staff analysis, I hereby adopt
the findings presented in the staff report and move to approve the preliminary plat
application for The Crossing at Baxter Meadows Subdivision, Phase 4B-4I requested in
application P-12017 authorizing to subdivide 36.94 acres and create 95 residential, single
household lots, one multi-household lot, and the remaining area as open spaces, trails and
streets subject to the conditions, as listed in Planning Board Resolution P-12017.

The Commission agreed that the motion incorporates the name change in Condition No. 3. The
Commission discussed the tree plantings and the park.
