HomeMy WebLinkAboutResolution 1988 Creates SID No. 600 ....--.- ..-... ....------- iB7 COMMISSION RESOLUTION NO. 1988 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 600 FOR THE PURPOSE OF CONSTRUCT- ION AND INSTALLATION OF A WATER MAIN AND APPURTENANCES TO SERVE THE ADJOINING I PROPERTIES AND MORE SPECIFICALLY DESCRIBED AS FOLLOWS: A TEN (10) INCH WATER MAIN AND APPURTENANCES ON WESTRIDGE DRIVE AND A SIX (6) INCH WATER MAIN AND APPURTENANCES ON LANDOE AVENUE AND ACROSS EASEMENTS BETWEEN SAME IN FIGGINS ADDITION ALL IN THE CITY OF BOZEMAN, MONTANA. THE CONSTRUCTION AND INSTALLATION OF THE WATER MAIN TO INCLUDE ALL TRENCH EX- CAVATION AND BACKFILL, BEDDING MATERIAL, CAST IRON WATER MAIN, VALVES, FITTINGS, HYDRANTS, SERVICE LINE STUBS, AND OTHER NECESSARY APPURTENANCES. WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, a petition in due form of certain owners of properties situated within the boundaries of Special Improvement District No. 600 as hereinafter more specifically described, asking that a special improvement district be created for the purpose of constructing and installing water mains to provide water service to lots within the district. WHEREAS, that at a regular meeting of the City Commission of the City of Bozeman held on the 17th day of May, 1978, the aforesaid petition was respectively considered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement District No.600 of the City of Bozeman for the purpose of constructing and installing water mains, said project to in- I elude all appurtenant work for the construction and installation of water mains to provide water service to all lots within the district. Section 2 Boundaries The boundaries of said Special Improvement District No. 600 are described as follows: Description A tract of land located in the East one-half (E 1/2) of the Northeast one- quarter (NE 1/4) of Section Twenty-four (Sec. 24), Township Two South (T2S), Range Five East (R5E) of the Montana Principal Meridian (M.P.M.) and being more particularly described as follows: Beginnina at the East 1/4 corner, a C.I. monument, of said Section 24, thence South 89 17' 05" West, along the East-West 1/4 lineo a distance of 1050.46 feet to the true point of beginning, thence South 89 17' 05" West a distance of 272.56 feet, thence North 000 06' 47" East a distance of 1440.27 feet, thence northerly along a 1382.5 foot radius curve to the right having a central angle of 300 18' 13" with an arc distance of 731.20 feet, thence North 300 25' 00" East a distance of 271.66 feet, thence South 590 35' 00" East a distance of 146.29 feet, thence South 310 42' 00" East a distance of 60.00 feet, thence easterly along a 250.00 foot radius curve to the right, having a central angle of 160 04' 46" with an arc distance of 61.74 feeto thence South 000 07' 00" West a distance of 105.08 feet, thence South 33 47' 00" West a distance of 92.59 feet, thence South 450 23' 00" East a dis- tance of 71.96 feet, thence South 000 07' 00" West a distance of 736.15 feet, o 0 thence South 89 18' 00" West a distance of 370.13 feeto thence South 00 I 06' 47" West a distance of 170.00 feet, thence North 89 18' 00" East a distance of 102.56 feet, thence South 000 06' 47" West a distance of 1126.03 feet, to the point of beginning and containing Lots 26 through 39 of Block 6, Lots 1 through 14 of Block 7, Lots 6 through 24 of Block 8 and Lots 1 through 15 of Block 9, Figgins Addition to the City of Bozeman, Montana. Section 3 Character of Improvements The character of the improvements to be made is the installation and construction of a six and ten inch watermain, including trench excavation and backfill, bedding material, cast iron watermains, valves, hydrants and fittings, copper service lines and fillings, and other neces- sary appurtenances thereto. COMMISSION RESOLUT~ON NO. 1988 .--....-.-- --.....----- - . --"..--.....---- ~(\R ;~..J,- Section 4 Estimate of Cost The total estimated cost of the improvements within the district is including engineering, legal and contingency is $105,000.00. Section 5 I Method of Assessment The cost of such improvement is to be assessed against the entire district. Each lot, block, tract or parcel of land within the district will be assessed for that portion of the whole cost which its area bears to the area of the entire district exclusive of streets, avenues, alleys and public places. The total actual assessable area within the entire district is 528,093.43 square feet and is the area on which all protests will be received, considered and determined. It is also the area on which all assessments will be figured. Section 6 Payments The payments for said improvements shall be made in twenty (20) annual installments extending over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 600 as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improve- ment District No. 600 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are avail- I able for the purpose in said Special Improvement District No. 600. Said bonds shall draw a simple interest from the date of their registration until called for payment, which interest shall be chargeable as part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, relating to special improvement districts in cities and towns, and any amendments thereof or thereto. Section 7 Protests and Notices That the regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 16th day of August, 1978, at the hour of 1:15 o'clock p.m. of said day, is the time and place, when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 600, the improvements proposed to be made pursuant thereto and the extent and character thereof, or either thereof; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this Resolution of Intention. ADOPTED by the Commission of the City of Bozeman, Montana, at a regular and stated session of said Commission held on the 19th day of July, 1978. That Wednesday, the 16th day of August, 1978, at 1:15 o'clock p.m. at the Commission Room of the City Hall, Bozeman, Montana is designated by Commission Resolution No. 1988 as the time and place when and where the City Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements or the creation of said district. Protests must be made in writing and delivered to the Clerk of the City Commission within 15 days after date of the first publication of this notice. The general character of improvements is the construction and installation of a six and ten inch water main, including trench excavation and backfill, bedding material, cast iron water mains, valves hydrants and fittings, copper service lines and fillings, and other necessary appurtenances thereto. I The estimated cost of improvements in Special Improvement District No. 600 is $105,000.00 which will be charged to the property owners on an area basis. For description of the boundaries of said Special Improvement District No. 600 reference is hereby made to Commission Resolution No. 1988 of the City Commission of the City of Bozeman, de- claring the intention to create said district, which is on file in the office of the undersigned Clerk of the said City Commission in the City Hall of said City of Bozeman, Montana, and open for inspection to all interested parties and the public generally.
