MINUTES OF THE MEETING OF THE CITY COMMISSION
BOZEMAN, MONTANA
March 4,2013
The Commission of the City of Bozeman met in the Commission Room, City Hall at 121 North
Rouse on Monday, March 4, 2013. Present were Deputy Mayor Jeff Krauss, Commissioner
Cyndy Andrus, Commissioner Chris Mehl, Commissioner Carson Taylor, City Manager Chris
Kukulski, City Attorney Greg Sullivan and Deputy City Clerk Aimee Brunckhorst.

Force Annual Report (Jenny Haubenreiser and Jenna Caplette)
0:01:09 Jenny Haubenreiser, Chair of the Community Alcohol Coalition
Ms. Haubenreiser began the presentation on this item. She spoke regarding the impacts of
alcohol abuse upon the entire community and explained that alcohol abuse is the number one
public health safety problem facing colleges. She provided statistics related to these issues and
stressed the importance of looking at the larger community environment for solutions to alcohol
and other substance abuse problems.
0:09:29 Jenna Caplette, Gallatin County DUI Task Force
Ms. Caplette continued the presentation explaining that the Task Force deals with education,
awareness and enforcement. They work on specific projects as well as collect data to make
comparisons. Ms. Caplette provided and explained an annual report and statistics.

Becker.
Those voting Aye being Crs. Andrus, Mehl, Taylor and Deputy Mayor Krauss.
Those voting No being none.
The motion passed 4-0.

1. Authorize Payment of Accounts Payable Claims (LaMeres)
2. Approve Bid Award in the amount of$64,685 to RDO Equipment Company for a
Mini Excavator to be used by Water/Wastewater Operations Department and the
Street Department (Alston)
3. Approve Bid Award in the amount of$174,024 to Tractor and Equipment of
Billings for a Front End Loader for the Streets Department (Van Delinder)
4. Approve Canceling the City Commission meeting the week of March 1 lth
(Ulmen)

Deputy Mayor Krauss opened general public comment.

Mr. Hill explained he serves on the Bozeman Public Schools Wellness Advisory Committee and
said the Committee will be promoting Alcohol Awareness Month, coming in April. Mr. Hill
provided background on Alcohol Awareness Month.

funding for an Economic Development project through the Community Development Block

Ms. Rosenberry provided the staff presentation on this item.
0:21:59 Brit Fontenot, Director of Economic Development
Mr. Fontenot informed the Commission of an error on the Commission memorandum for this
item. He explained the match should have been listed as 50%with $400,000 available for
economic development. Mr. Fontenot then explained he may be applying for this funding
opportunity for the North Park Project in the future. Details would be forthcoming at that time.

replacing the Department of Planning with Department of Community Development and
replacing references to the Director of Planning with Director of Community Development.
It was moved by Cr. Taylor, seconded by Cr. Andrus to provisionally adopt Ordinance
1863, amending the Municipal Code by replacing the Department of Planning with
Department of Community Development and replacing references to the Director of

Citizens' Advisory Board from the Municipal Code by removing all sections of Chapter 2,
Article 5, Division 13 (Brunckhorst)

Mr. Kukulski referenced a transmittal report regarding twenty-two bills that the League of Cities
and Towns is watching.

0:45:31 Greg Sullivan, City Attorney
Mr. Sullivan referenced water bills 37 and 106 that had made it through transmittal. He
explained that staff attorney Tim Cooper looked at these bills and said that he did not see any
potential problems for the city with house bill 37 which allows for leasing of water rights. Mr.
Sullivan spoke further about the affects of this bill. He also explained that bill 106 is a cleanup
bill adding provisions about enforcement.

Deputy Mayor Krauss began a Commission and staff discussion regarding the bills related to Tax
Increment Finance Districts.
0:48:03 Greg Sullivan, City Attorney
Mr. Sullivan spoke regarding House Bill 314 which would amend the special district provisions
and provide a petition process for creation of a special district. The city needs to look into this
further and has questions regarding this bill.
0:49:05 Further Discussion occurred on a bill related to the Tax Increment Finance Districts.
0:50:27 Brit Fontenot, Director of Economic Development
Mr. Fontenot explained that he opposed this bill in committee several weeks ago on behalf of the
city.

Cr. Andrus explained that Representative Woods called her regarding House Bill 435, which is
the ability for grants that come from the coal board to include an opportunity for mitigation of
noise. Each community could apply for money to help mitigate train noise. She believes this bill
is moving on to the Senate.

0:52:38 2. Award from Big Sky Trust Fund
Brit Fontenot, Director of Economic Development
Mr. Fontenot explained that the city received an award from Big Sky Trust Fund for some of the
grant money requested to proceed with a preliminary engineering report for the North Park
project. They will now be able to proceed with the scope of work and Request for Proposal for
this.

Steve Worthington, Director of Community Development - Interim
Mr. Worthington reported that the Department of Community Development has seen an increase
in the volume of applications including four subdivisions under review as well as a number of
homes.
