MINUTES OF THE MEETING OF THE CITY COMMISSION
BOZEMAN, MONTANA
March 18, 2013

The Commission met in the City Commission Room, City Hall at 121 North Rouse on Monday,
March 18, 2013. Present were Mayor Sean Becker, Deputy Mayor Jeff Krauss, Commissioner
Cyndy Andrus, Commissioner Carson Taylor, Commissioner Chris Mehl, City Manager Chris
Kukulski, City Attorney Greg Sullivan, and City Clerk Stacy Ulmen.

A. Call to Order – 6 p.m. – Commission Room, City Hall, 121 North Rouse
Mayor Becker called the Meeting to order at 6 p.m.
B. Pledge of Allegiance and a Moment of Silence
C. Changes to the Agenda
Mayor Becker asked City Manager Chris Kukulski if there were any changes to the agenda. Mr.
Kukulski stated no.
D. Minutes – Special meeting minutes from January 25, 2013 and regular minutes from
February 11, 2013 and February 25, 2013
Motion and Vote to approve the special meeting minutes from January 25th, 2013 and the
regular minutes from February 11th and February 25th, 2013 as submitted.
It was moved by Cr. Taylor, seconded by Cr. Mehl to approve the special meeting minutes
from January 25th, 2013 and the regular minutes from February 11th and February 25th,
2013 as submitted.
Those voting Aye being Crs. Taylor, Mehl, Deputy Mayor Krauss, Cr. Andrus and Mayor
Becker.
Those voting No being none.
The motion passed 5-0.

E. Consent
1. Authorize Payment of Accounts Payable Claims (LaMeres)
2. Authorize City Manager to sign an Amendment to the Professional Services
Agreement with Tetra Tech Inc. for post-closure soil gas investigation at the Story
Mill Landfill (Woolard)
3. Authorize City Manager to sign Amendment 5 to the Professional Services
Agreement with Great West Engineering for the 2008 Sewer Rehabilitation
Project (Murray)
4. Authorize City Manager to sign a Public Access Easement for Park Place
Bozeman, LLC (Johnson)
5. Authorize City Manager to sign a Public Access Easement for Dairy Queen
(Johnson)
6. Approve Mayor's signature on the 2013-2014 Certified Local Government Grant
Agreement with Montana State Historic Preservation Office (Kramer)
7. Approve a Beer and Wine License for the Emerson Cultural Center, Soup & Bowl
Fundraiser event at 111 South Grand Avenue (Neibauer)
8. Approve a Beer and Wine License for the Emerson Cultural Center, Bingo in the
Ballroom non-profit Fundraiser at 111 South Grand Avenue (Neibauer)
9. Approve Resolution No. 4432, authorizing Change Order 1 with Lutey
Construction for the Renovation of the Water Department Building in Laurel Glen
Subdivision for the installation of connections for phone and data in the amount
of $442.99 (Goehrung)
10. Finally adopt Ordinance No. 1857, Establishing the Trails, Open Space and Parks
Committee (Overton)
11. Finally adopt Ordinance No. 1860, authorizing the City Manager to sign a private
access easement and agreement granting NorthWestern Energy legal access
across a portion of the City owned Lower Yards property, Tract 2 of C.O.S. 2818,
to the south end of the existing NorthWestern Energy gas gate station facility,
Tract 1 of C.O.S. 2818 (Heaston)
12. Finally adopt Ordinance No. 1863, amending the Municipal Code by replacing
the Department of Planning with Department of Community Development and
replacing references to the Director of Planning with Director of Community
Development (Brunckhorst)
13. Finally Adopt Ordinance No. 1864, removing all sections of Chapter 2, Article 5,
Division 13, thus removing the Bozeman Senior Citizens’ Advisory Board
(Brunckhorst)
Public Comment on the Consent Agenda.
Mayor Becker opened public comment on the Consent agenda.

It was moved by Cr. Mehl, seconded by Deputy Mayor Krauss to approve Consent items E.
1-13 as submitted.
Those voting Aye being Cr. Mehl, Deputy Mayor Krauss, Crs. Andrus, Taylor and Mayor
Becker.
Those voting No being none.
The motion passed 5-0.
F. Public Comment
Mayor Becker opened public comment.
Nick Landeros, Public Comment
Mr. Landeros of 184 Juilliard spoke regarding his concerns related to warning parking tickets
that he and his neighbors were issued over the weekend. The neighborhood is near Michael
Grove.
Mayor Becker closed public comment.
G. Special Presentation – Integrated Water Resources Plan Update (Heaston)
Staff Engineer Brian Heaston gave the Staff presentation for the Integrated Water Resources
Plan.
Commission Discussion
The Commission and staff discussed the need for financial comparisons and costs, scoring the
alternatives, the need for a robust discussion on the alternatives, the current status of the water
rights Attorney, exempt wells, the suggestion to start with a self help model in water
conservation, comparisons with other cities, the percentage of loss rate, building codes related to
water conservation, the 2% growth rate used in the analysis, the amount of updating of the plan
that will need to take place, economic overlay, public outreach efforts, costs of maintenance and
water rights.
This item is estimated to return to the Commission the end of June where they will look at
recommendations.
