WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman a petition in due form of certain owners of properties situated in the City of Bozeman asking that a Special Improvement District be created for the purpose of construc- tion and installation of an asphaltic concrete pavement project to include integral curbs and gutters and other work incidental thereo, and WHEREAS. at a regular meeting of the City Commission of the City of Bozeman. held on the 18th day of October. 1978. the aforesaid petition was respectively considered and granted. NOW, THEREFORE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention It is hereby declared to be the intention of the City of Bozeman to create a Special Improvement District to be known and designated as Special Improvement District No. 608 for the purpose of construction and installation of pavement on Westridge Drive and Landoe Avenue. Figgins Addition. in the City of Bozeman. Section 2 Boundaries The boundaries on said Special Improvement District No. 608 are described as follows: A tract of land located in the East one-half (E~) of the Northeast I one-quarter (NE!t;) of Section Twenty-Four (Sec. 24), Township Two South (T2S). Range Five East (R5E), of the Montana Principal Meridian (M.P.M.) and being more particularly described as follows: Beginning at the East 1/4 corner, a C.I. monument. of said Section 24, thence South 890 17' 05" West. along the East-West 1/4 line. a distance of 1050.46 feet to the true point of beginning, thence South 890 17' 05" West a distance of 272.56 feet, thence North 000 06' 47" East a distance of 1440.27 feet, thence Northerly along a 1382.50 foot radius curve to the right having a central angle of 300 18' 13" with an arc distance of 731. 20 feet. thence North 0 30 27' 00" East a distance of 271.66 feet; Thence South 590 35' 00" East a distance of 66.29 feet, thence North 190 28' 30" East a distance of 38.55 feet. thence Easterly along a 360 foot radius curve to the right having a central angle of 310 00' 00" with an arc distance of 194.78 feet, -- 0 00" West a distance of 400.39; Thence South 89 18' thence southerly along a 120.00 foot radius curve to the right having a central angle of 900 00' 00" with an arc distance of 30.32 feet. I Section 4 Estimate of Costs The estimated cost of the improvements within the district, including engineering, legal, administration and contingency is $300,000.00. Section 5 Method of Assessment The cost of said improvement is to be assessed against the entire district. Each lot or parcel of land within the district will be assessed for that part of the whole cost which its area bears to the area of the entire district, exclusive of streets, alleys and public places. The total actual assessable area within the entire district is 745,047.68 square feet, and is the area on which all protests will be received, considered and determined. It is also the figure on which all assessments will be calculated. Section 6 Payments The payments for the improvements shall be made in twenty (20) annual installments over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 608 as authorized by law. Such bonds_~ill be in denominations of $100.00 each, and fractions or multiples of $100.00 where neces-sary to be issued and chargeable against a fund to be known and designated I as Special Improvement District No. 608 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City singly or in multiples and in the order of their registration, whenever funds are available for the purpose on said Special Improvement District No. 608. Said bonds shall draw a simple interest from the date of their registration until called for payment, which interest shall be chargeable as part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title II, of the Revised Codes of Montana, 1947, relating to Special Improvement Districts in cities and towns, and any amendments thereof or thereto. Section 7 Protests and Notices The regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall-Building, Bozeman, Montana, on Wednesday, the 8th day of November, 1978, at the hour ~f 1:15 o'~lock p.m. of said day, is the time and place when and where the City Commission will heir and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 608, the improvements proposed to be made pursuant thereto, and the extent and character thereof, or either thereof; and the Clerk of the City Commission be and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this Resolution of Intention. That Wednesday, the 8th day of November, 1978, at 1:15 o'clock p.m. at the Commission Room of the City Hall Building, Bozeman, Montana, is designated by Commission Resolution No. 2022 as the time and place when and where the City Commission of the City of Bozeman will hear and pass upon all protests that may be made against the creation of said special improve- ment district. Protests must be made in writing and delivered to the Clerk of the City Commission within fifteen (15) days after the date of the first publication of this notice.
