HomeMy WebLinkAboutParking Resolution PC2013-02 Lease Agreement Bridger Park 7. 134x ' p�. t BOZEMAN PARKING COMMISSION AV" RESOLUTION PC2013-02 A RESOLUTION OF THE PARKING COMMISSION OF THE CITY OF BOZEMAN,MONTANA AUTHORIZING THE PARKING MANAGER TO ENTER INTO LEASE AGREEMENTS AT THE BRIDGER PARK.; REQUIRING THE CITY TO MAINTAIN CONTROL OVER THE BRIDGER PARK WHEN LEASING PARKING SPACES AND THAT ANY SUCH LEASE SHALL NOT INTERFERE WITH TRANSIT FUNCTIONS; AND THAT REVENUE FROM THE BRIDGER PARK IN EXCESS OF OPERATING AND MAINTENANCE EXPENSES SHALL BE ACCOUNTED FOR SEPERATELY FROM OTHER PARKING FUNCTIONS. WHEREAS, pursuant to city Resolution 3803, the Bozeman Parking Commission has jurisdiction over three parking districts: the downtown B-3 Zoning District, the Montana State University Residential Parking District, and the Bozeman High School Residential Parking District; and WHEREAS, Sect. 7-14-4501(3), MCA, authorizes the Bozeman Parking Commission, to charge for use of parking facilities, and WHEREAS, Sect. 7-14-4622(6), MCA, authorizes the Bozeman Parking Commission to acquire, construct, rent, lease, maintain, and repair real and personal property used for parking services; and WHEREAS, the City of Bozeman (City) is the recipient of a.Congressional appropriation for the construction of the Bridger Park Downtown Intermodal Facility (Bridger Park); and WHEREAS, the City annually enters into an agreement with the FTA called the Master Agreement (FTA MA (19)); and WHEREAS, in 2008, the City and Parking Commission agreed to the creation of a supervisory position, hereinafter referred to as Parking Manager, that would serve as a representative of the Parking Commission, under direct supervision and operational control of the Parking Commission, and who would supervise personnel and operations specific to the parking garage and to issues regarding the three parking districts. Resolution PC2€113-02 Page 1 of 2 RESOLUTION PC2013-02 NOW, THEREFORE, BE IT RESOLVED that: 1. The Parking Commission may enter into agreements for the lease of parking spaces in the Bridger Park and when doing so the City and Parking Commission shall take all necessary steps to maintain continuing control over the Bridger Park. 2. Upon entering into a lease agreement or issuing a permit for use of parking spaces in the Bridger Park the City and Parking Commission shall ensure there will be no interference with transit functions located at the Bridger Park. 3, The City and Parking; Commission shall manage and account for revenues and expenditures of the Bridger Park separate and distinct from other City and Parking Commission facilities and programs. 4. All revenue collected from the Bridger Park in excess of operation and maintenance costs shall be committed by the City and Parking Commission to the provision of public transportation services. 5. The Parking Manager is authorized to enter into agreements for the lease of parking spaces within the Bridger Park subject to the provisions of this Resolution.
