RELEASE OF BUILDING PERMIT RESTRICTIONS
WEST'WINDS SUBDIVISON PRASE 5
THIS RELEASE is made this Z5 day of. R t- � , 20 by the CITY OF
BOZEMAN, a municipal corporation of the State of Montana, hereinafter called "City."
RECITALS
A. The City filed a"Notice of Building Permit Restrictions" on December 1, 2008,
advising that no building permits would be issued until all critical infrastructure was completed.
The following real property is identified in the Notice;
Lots 1-7 Block 1, and Lots 1-4 Block 2,West Winds Subdivision Phase 5, City
of Bozeman, Gallatin County, Montana(the"Real Property„).
B. The critical infrastructure improvements have been completed.
C. The City and the Bank of Bozeman,which will obtain ownership of a majority of
the Real Property by way of a deed in lieu of foreclosure,have entered into an Improvements
Agreement to ensure the completion of the remaining improvements.
D. The Improvements Agreement between the City and the Bank of Bozeman calls
for the release of the Building Permit Restrictions.
RELEASE
NOW,THEREFORE, in consideration of the above:
1. The City does hereby release the above-described Real Property from the Notice
of Building Permit Restrictions filed December 1, 2008 as Document#2316304 in the Clerk and
Recorder's Office of Gallatin County, Montana.
