WATER PIPELINE AND ACCESS
EASEMENT AND AGREEMENT
Bozeman Deaconess Foundation, Bozeman, Montana,
("Grantor"), in consideration of One Dollar ($1.00) and other
valuable consideration, receipt of which is hereby
acknowledged, grants to the city of Bozeman, a municipal
corporation of the state of Montana, 411 East Main, Bozeman,
Montana 59771-0640 ("Grantee"), its successors and assigns,
four (4) perpetual easements to lay, construct and maintain
water pipelines with the usual services valves, connections,
accessories and appurtenances for the purpose of transmitting
water across four (4) separate strips of land situated in
Gallatin County, each strip being thirty (30) feet wide,
fifteen (15) feet on either side, of the following described
centerline:
Easement 1
Commencing at the Northwest section corner of Section
17, Township 2 South, Range 6 East, P.M.M., Gallatin
County, Montana; Thence South 81027'01" East, a
distance of 1125.23 feet to the point of beginning;
Thence North 82021'22" West, a distance of 789.54 feet;
Thence, South 52038'38" West, a distance of 233.45
feet; Thence South 37021'22" East, a distance of 156.24
feet to the terminus of the easement.
This easement is reflected in Exhibit A attached hereto
and incorporated herein by reference.
Easement 2
Commencing at the Northwest section corner of section
17, Township 2 South, Range 6 East, P.M.M., Gallatin
County, Montana; Thence South 08005'35" West, a
distance of 842.39 feet to the point of beginning;
Thence North 78018'14" West, a distance of 84.90 feet
to the terminus of the easement.
This easement is reflected in Exhibit B attached hereto
and incorporated herein by reference.
Easement 3
Commencing at the Northwest section corner of section
17, Township 2 South, Range 6 East, P.M.M., Gallatin
County, Montana; Thence, South 06041'54" West, a

distance of 648.70 feet to the point of beginning;
Thence, South 78028'57" East, a distance of 140.25
feet; Thence, South 11031'04" West, a distance of 29.29
feet to the terminus of the easement.
This easement is reflected in Exhibit C attached hereto
and incorporated herein by reference.
Easement 4
Commencing at the Northwest section corner of Section
17, Township 2 south, Range 6 East, P.M.M., Gallatin
County, Montana; Thence, South 16016'32" East, a
distance of 923.95 feet to the point of beginning:
Thence South 80002'17" East, a distance of 24.85 feet:
Thence North 11017'28" East, a distance of 224.59 feet;
Thence, North 56027'29" East, a distance of 56.94
feet: Thence North 33032'31" West, a distance of 45.26
feet to the terminus of the easement.
This easement is reflected in Exhibit D attached hereto
and incorporated herein by reference.
This grant includes the right of the Grantee, its
successors, permittees, licensees, and assigns and its and
their agents and employees, to enter at all times upon the
above described land by using existing roads or trails or
otherwise by a route causing the least damage and
inconvenience to the Grantor in order to:
(1) operate, patrol, repair, substitute, remove,
enlarge, replace, and maintain the pipeline,
services, connections, accessories and
appurtenances: and
(2) Trim, remove, destroy, or otherwise control any
trees and brush inside or outside the boundaries of
the easement which may, in the opinion of the
Grantee, interfere or threaten to interfere with or
be hazardous to the operation and maintenance of the
pipeline:
The Grantee agrees that:
(1) In connection with the operating, patrolling,
repairing, substitution, removing, enlarging,
replacing, and maintaining of said water and sewer
pipeline, it will repair or replace, at its sole
expense, or pay to Grantor, the reasonable value of

any damages to growing crops, existing fences,
buildings, ditches and other appurtenances of said
land that may be disturbed by its operation.
(2) During operations involving excavation, it will
remove the topsoil from the trenched area to a depth
of one foot, or to the full depth of the topsoil,
whichever is less, and stockpile said topsoil for
replacement over the trench. It will remove from
the site any large rocks or surplus excavating
material or any debris that may have been exposed by
the excavation and remains after backfilling is
completed. In addition, it will leave the finished
surface in substantially the same condition as
existed prior to the beginning of operations except
that the surface of backfilled area may be mounded
sufficient to prevent formation of depressions
after final settlement has taken place.
(3) In connection with maintaining said pipeline, it
will not unreasonably hinder or prevent the
operation of Grantor's business activities on the
tract to which this right of way is hereby granted.
The Grantor agrees that:
(1) At no time will it build, construct, erect or
maintain any permanent structure within the
boundaries of said easement without the prior
written consent of Grantee.
(2) Once the pipeline has been constructed and covered,
at no time will they modify the finished grade of
the land over the pipeline by removal of existing
soil or by placement of fill material within the
boundaries of said easement without the prior
written consent of the Grantee.
(3) It is lawfully seized and possessed of the real
property described herein upon which the easement
will run, that they have a lawful right to grant the
easement discussed herein, and that they will
forever defend the title to the property against the
claims of all persons.
(4) The Grantee may peaceably hold and enjoy the rights
and privileges herein granted without any
interruption by the Grantor.
The terms, covenants and provisions of this easement and
agreement shall extend to and be binding upon the successors
and assigns.
