MEETING DATE: January 28, 2013 AGENDA ITEM TYPE: Consent RECOMMENDED MOTION: I move to finally adopt Ordinance No. 1850, amending the Municipal Code by replacing the Department of Finance with Department of Administrative Services, removing references to the Departments of Human Resources and Information Technology and by replacing references to the Director of Finance with Director of Administrative Services. BACKGROUND: In an effort to improve collaboration and service delivery the decision was made to consolidate three critical departments into one. The Administrative Services Department will now contain what were the Finance Department, the Human Resources Department and the Information Technology Department. Finance, Human Resources and Information Technology will now be divisions under Administrative Services. Ms. Rosenberry is now the Director of Administrative Services instead of the Director of Finance and has responsibility for all three divisions. These changes have already been implemented over the last few months and now the Municipal Code needs to be revised to reflect the current organizational structure. The City Commission provisionally adopted this Ordinance on January 7, 2013. The following sections of the Bozeman Municipal Code will be affected by these changes and need to be revised by Municode Corp. Please note that they may find additional areas that need revision as they follow codification instructions. ARTICLE 2. - ADMINISTRATION AND ENFORCEMENT Sec. 12.02.050. - Director of finance; duties. Codification costs $22 per page plus $25 per Ordinance for an approximate cost of $729. Attachment: Final draft of Ordinance 1850 Report and Ordinance primarily prepared by Aimee Brunckhorst 131 1 of 3 ORDINANCE NO. 1850 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, PROVIDING THAT THE BOZEMAN MUNICIPAL CODE BE AMENDED BY REPLACING ALL REFERENCES TO THE DEPARTMENT OF FINANCE WITH DEPARTMENT OF ADMINISTRATIVE SERVICES, REMOVING REFERENCES TO THE DEPARTMENTS OF HUMAN RESOURCES AND INFORMATION TECHNOLOGY, AND BY REPLACING REFERENCES TO THE DIRECTOR OF FINANCE, OR FINANCE DIRECTOR, WITH DIRECTOR OF ADMINISTRATIVE SERVICES AND REMOVING REFERENCE TO THE HUMAN RESOURCES DIRECTOR IN 2.03.550. WHEREAS, the City of Bozeman City Manager has created a new department to be called the Department of Administrative Services; and WHEREAS, the Department of Administrative Services replaces the Department of Finance, the Department of Human Resources and the Department of Information Technology; and WHEREAS, the positions previously held by the Director of Information Technology and the Director of Human Resources are now contained within the position of Director of Administrative Services. NOW THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana, that: Section 1 Chapter 2, Article 4, Division 2 of the Bozeman Municipal Code shall be revised as follows: DIVISION 2. – DEPARTMENT OF FINANCE ADMINISTRATIVE SERVICES 132 Ordinance 1850, Department and Director of Administrative Services 2 of 4 Chapter 2, Article 4, Division 4 of the Bozeman Municipal Code shall be revised as follows: DIVISION 4. – DEPARTMENT OF HUMAN SERVICES (RESERVED) Chapter 2, Article 4, Division 5 of the Bozeman Municipal Code shall be revised as follows: DIVISION 5. – DEPARTMENT OF INFORMATION TECHNOLOGY (RESERVED) All references throughout the Bozeman Municipal Code to the department of finance shall be replaced with the department of administrative services. Section 2 All references throughout the Bozeman Municipal Code to the director of finance and the finance director shall be replaced with director of administrative services. Section 3 Section 2.03.550A.1, BMC, be amended such that such section shall read as follows: Section 4 1. The director of finance and the human resources director administrative services shall certify to the city clerk a list, current as of the previous January 1, of the names and mailing addresses of persons who are required to file a financial statement in the current year. Repealer. All provisions of the ordinances of the City of Bozeman in conflict with the provisions of this ordinance are, and the same are hereby, repealed and all other provisions of the ordinances of the City of Bozeman not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 5 Section 6 Savings Provision. This ordinance does not affect the rights and duties that matured, penalties that were incurred or proceedings that were begun before the effective date of this ordinance. All other provisions of the Bozeman Municipal Code not amended by this Ordinance shall remain in full force and effect. 133 Ordinance 1850, Department and Director of Administrative Services 3 of 4 Section 7 Severability. That should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal, or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof, other than the part so decided to be invalid, illegal or unconstitutional, and shall not affect the validity of the Bozeman Municipal Code as a whole. Section 8 Codification. This Ordinance shall be codified as appropriate in Sections 1-4. Section 9 Effective Date. This ordinance shall be in full force and effect thirty (30) days after final adoption.
