Order No. 11.

RECOMMENDATION: Motion and vote to authorize the City Manager’s signature on the Bozeman Water Reclamation Facility, Phase 1 Improvements – Change Order No. 11.
BACKGROUND: Attached is a copy of change order number eleven for the above referenced
project. This change order includes two items. Both of these items were part of an earlier
change order that added the items as a unit price with an estimate for what the total cost would be. This change is to resolve the quantities on the two items and set the final contract price on this phase of the project. The first item was for asphalt paving. The original change order
estimated this item at 19,717 square yards, but in the end, 21,355 square yards were installed.
This results in and increase of $20,475.00 for this item over the original estimate.
The second item was to change the wage rates that were used on the project from the state prevailing wage rates, to the federal rates. This was a requirement of the State Revolving Fund
program which was one of the funding mechanisms used on the project. At the time of the
change that added this item, the contractor estimated it would cost $300,000 over the life of the
project. In the end, the contractor and many of the trades were already paying at or above the required federal rate. As a result, the final cost of this item was only $47,284.00.
There is no adjustment in contract time associated with this change. The final recommended
increase in cost and time extension for this change is reasonable and commensurate with the
work involved.
UNRESOLVED ISSUES: None
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: Overall this change order decreases the contract amount by $232,241.00
from $36,901,291.90 to $36,669,050.90. This will increase the contingency on the project from
$1,341,485.99 to $1,573,726.99. These are the final contract numbers for this phase of the

project. The contingency is included in the overall budget for the project but not in the
construction contract which is why the change order must be processed.

COMMISSION RESOLUTION NO. 4427
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT
WITH WILLIAMS BROTHER CONSTRUCTION, LLC., BILLINGS,
MONTANA.
WHEREAS, the City Commission did, on the 10th day of November 2008, authorize award of the
bid for the Bozeman Water Reclamation Facility Phase I Improvements project, to Williams Brother
Construction, LLC., Billings, Montana; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and/or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman, a
municipal corporation, and Williams Brother Construction, LLC., as contained in Change Order No. 11,
attached hereto, be and the same are hereby approved; and the City Manager is hereby authorized and directed
to execute the contract change order for and on behalf of the City; and the City Clerk is authorized and
directed to attest such signature.
