SUBJECT: North 7th Avenue Lighting Memorandum of Agreement
MEETING DATE: December 27, 2012

RECOMMENDATION: Authorize City Manage to sign Memorandum of Agreement with the Montana Department of Transportation (MDT) to identify responsibilities for new decorative luminaire construction, operation, and maintenance on North 7th Avenue.
BACKGROUND: On October 15th, 2012 the City Commission authorized a contract with
Yellowstone Electric Co. to install new decorative lights on N. 7th Avenue from Interstate 90 to West Tamarack Street. This project was funded by the N. 7th Urban Renewal Board (NSURB) and was intended to be the first phase of a multi-phase project to replace all of the street lights
within the Urban Renewal District.
N. 7th Avenue is under the jurisdiction of MDT and any changes within their right of way must be preapproved. This agreement between MDT and the City of Bozeman establishes responsibilities of construction, operation, and maintenance of the proposed lighting
improvements for the corridor.
City legal staff and other staff associated with the NSURB have reviewed the agreement and find the terms acceptable and of benefit to both the City of Bozeman and NSURB.
UNRESOLVED ISSUES: None
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: This agreement 1) reduces maintenance costs for the modified portion of
Special Improvement Lighting District 460, and 2) reduces installation costs for N. 7th Avenue Urban Renewal District since MDT will be installing a portion of the new “decorative” N. 7th Avenue luminaires as part of their West Bozeman Interchange project.
