WiEREAS. the Ci ty Ccmnission of the Ci ty of Bozeman did on the 8th day of January. 1940. and regularly pass ~dinance No. 696. entitled: AN CRDINAN:E DEFINING GARBAGE FOR'IHE PURFOSE OF '!HIS CRDINANCE PR0- VIDING FOR WE CX1LLECTIOO AND DISFOSITICl\T 'IHEREDF BY AND UNDER THE SUPERVISICl\T AND CONTROL OF '!HE DEPAR1MENI' OF PUBLIC WELFARE AND FOR DEFRAYING 'IHE CDST OF Slrn CDLLECTICl\T AND DISrosITION BY SPECIAL ASSESS- MEN[ AGAINST THE PROPERTY OF WUGf SXH SERVICE IS RENDERED, AND PROVIDING PENALTIES FCR VIOLATICN OF '!HIS ORDINAf'CE. which Ordinance No. 696. passed as aforesaid is hereby referred to and made a part of this Reso- lution for further particulars in respect to the basis and method of assessing the cost against property herein assessed, and WHEREAS. said expense incurred by said City in the collection and disposition of garbage and landfill in accordance with said ~dinance is hereby estimated by the City of Bozeman to be the sum of Two Hundred Thirty-Four Thousand Seven Hundred Fifty Nine and 60/l00ths Dollars ($234.759.60) for the year 1979. over and above all moneys collected from business and profes- sional concerns, or corrbined residence and business or residences and professional business concerns. in accordance wi th said Ordinance 696. and the BoZEmU1 Municipal Code. and WHEREAS. in order to raise said sum to defray the said cost. it is necessary to establish the basic uni t rate, as defined in said Bozerran Municipal Code for Garbage and Landfi 11 - Two Hundred Thirty Four Thousand Seven Hundred Fifty-Nine and 60/100ths Dollars ($234,759.60) Basic Uni t Rate Thirty-Six and OO/lOOths Dollars ($36.00). 'IHEREFORE, pursuant to the provisions of said ~dinance No. 696 and the Bozeman Mtmicipal Code and the laws of the State of Mmtana, BE IT RE3)LVED AND IT IS HEREBY C1IDFlffiD BY TIlE crMvlISSION OF THE CITY OF roZEMAN. STATE OF M:NTANA Sect ion 1. That to defray the estimated cost and expense of collecting and disposing of garbage in the City of Bozeman. for the year 1979. there is hereby levied and assessed against the property and the several lots, pieces and parcels of land thereof within the City of Bozeman as set forth in Schedule "A". v.hi ch is at tached hereto and made a part of, a tax that of a particular description of each lot and parcel of land with the name of the owner and/or owners and the sun assessed against the same is set forth in the assessment list in Schedule "A"; that the several SUITS set opposite the names of said owners and the described lots and parcels of land. be. and the same are hereby levied and assessed upon and against said lots and parcels of land for said purpose; that the several SUITE be collected fram the respective owners of said lots and parcels of land described in said assessment list and owned by them; that the said surrs shall be paid and the collection thereof be made in the manner and in accordance with ~dinance No. 696 of the City of Bozeman, MOntana. and the laws of the State of MOntana governing the collection of Special Lmprovement Taxes; that failure to pay such assessment when the same shall becorre due and payable shall make such persons and such lots and parcels of land 1 iable to the penalties provided by law relative to delinquent taxes. Section 2. That the regular session of the COmmission of the City of Bozeman. MOntana. to be held in the Commission Charmer in the City Hall of said City on the 7th day of Novenber, I 1979. at 1:15 o'clock p.m., and the same is hereby designated as the time and place at which objections to the final adoption of the Resolution will be heard by said Commission. Section 3. NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman held on the 31st day of October, 1979, COmmission Resolution No. 2107 was provisionally passed and adopted; that said Resolution levies and assesses a special assessment of taxes to defray the cost of collection and disposition of garbage in the City of Bozeman for the year 1979, upon all property to \d1.ich such service was rendered. That said Commission Resolution No. 2107 is now on file in the office of the Clerk of the Commission of the City of Bozeman, subject to inspection of all persons interested, for a period of five (5) days; that Wednesday, the 7th of November, 1979, at 1:15 p.m. of said day at a regular session of the Commission of the City of Bozeman, in the Commission Roam, in the City Hall Building, has been designated as the time and place when and where said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said COmmission Resolution No. 2107 and the levying of said assessment; and that said Resolution will be finally passed and adopted at said regular session of said Commission, subject to such corrections and amendrrents that rmy be rmde upon objections trade and filed with the Clerk of the I Comni ss i on wi thin five (5) days I imi t as provi ded by law.
