WHEREAS, there has been filed with Clerk of the City Commission of the City of Bozeman, MOntana, a petition in due fonn of certain owners of properties situated in the district asking that a Special Lmprovement District be created for the purpose of constructing and installing an asphaltic concrete type pavement, together with integral concrete curb and gutter, and necessary appurtenances thereto, and necessary stonn drainage facilities appurtenant to such pavement; and, \~S, at a regular rreeting of the City Cbrrnrlssion of the City of Bozeman held on the 15th day of August, 1979, the aforesaid petition was respectively considered and granted; NCW, THEREFORE, BE IT REOOLVED BY THE CITY aM.1ISSICN OF THE CITY OF roZ.EMt\N: Section 1. Declaration of Intention. It is hereby declared to be the intention of the City of Bozeman to create a Special hnprovement District to be known and designated as Special Improvement District No. 616 for the purpose of constructing and installing an asphaltic con- crete type pavement on West Koch Street between South 20th and South 23rd Avenue, said project to include construction and installation of integral concrete curb and gutter and necessary appurtenances thereto, together with necessary stonn drainage facilities appurtenant to such paving. Sect ion 2. Boundar i es . The boundaries of said Special Inproverrent District No. 616 are described as follows: .;;t: Those properties fronting on Koch Street between Blocks 3A and 4A as dedi- cated in the amended subdivision plat of portions of Blocks 3 and 4 of Kirk I Subdivision No. 4 in the SEt of Section 11, T2S, R5E, M.P.M., City of Bozeman, Gallatin County~ MOntana. The frontage distance is 1589.40 feet. The north line of said Koch Street begins 650.19 feet north on a line bearing N 00000107" E fran the 3V corner of said Block 4, thence N 89059153" E a distance of 100.79 feet, thence a cord distance of 193.93 feet on an arc with a radius of 217.97', and an angle of 50058'36", thence N 39001'31" E a distance of 60.00 feet, thence a cord distance of 334.77 feet on an arc with radius of 379.27 feet and an angle of 5003412611, thence N 89035'57" E a distance of 105.21 feet to the SE corner of Block 3, now Block 3A of Kirk's Subdivision No. 4 to the City of Bozeman. Sect ion 3. Character of Improvements. The character of irnproveme~ts in Special Improve- ment District No. 616 is the construction of an asphaltic concrete pavement project with in- tegral concrete curb and gutter together with stann drainage and necessary appurtenances to said construction on West Koch between 20th Avenue and 23rd Avenue, said project to include con- struction of gravel subbase, an asphaltic concrete type base and surface course, all necessary excavation and backfill, and all other work appurtenant thereto; together with all stonn drainage appurtenant to said project. Section 4. Estimate of Cost. The preliminary estimate of cost of the improvements in Special Improvement District No. 616 including all construction costs, meterial costs, engi- neering, legal, adhrinistration,and contingency is $90,000.00. Section 5. Method of Assessrrent. The cost of said improvement is to be assessed against the entire district; each lot or parcel of land within such district will be assessed for that part of the whole cost which its frontage bears to the frontage of the entire district, ex- clusive of streets, avenues, alleys, and public places. I The total number of feet of assessable frontage within the entire district is 1589.40 feet Which is the frontage on \\hich all protests wi 11 be received, considered, and detennined, and on which all assessments will be calculated. Sect ion 6. Pa~nts. The payxrents for said improvements shall be made in twenty (20) annual installrrents extending over a period of nineteen (19) years, but this shall not be con- strued to prevent payrrent in full at any regular payrrent date by any property owner who desires to do so. Such bonds will be in denanination of $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Inprovement District No. 616 Fund of the Ci ty of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, Whenever funds are available for the purpose on said Special Improvement I District No. 616. Said bonds shall draw simple interest fran the date of their registration until called for payrrent, which interest shall be chargeable as part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of MOntana, 1947, and all other applicable provisions of Title II of the Revised Codes of MOntana, 1947, relating to special improvement districts in cities and towns, and any amendments thereof or thereto. Sect ion 7. Protests and Notices. The regular session of the City Commission of the City of Bozerran, to be held at the Cammission Olamber, Ci ty Hall Bui lding, Bozeman, Montana, on Wednesday, the 31st day of October, 1979, at the hour of 1:15 o'clock p.m. of said day, is the time and place, when and where the Ci ty Comnission wi 11 hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 616 , the improvements proposed to be made pursuant thereto, and the extent and character thereof, or either thereof; and the Clerk of the City COmmission be, and she is hereby authorized to give notice in the manner and for the time as by law required, of the adoption of this reso- lution of intention.
